COMMON COUNCIL Minutes 20101123 COMMON COUNCIL - CITY OF MUSKEGO Approved: 12/14/2010 MINUTES OF MEETING HELD NOVEMBER 23, 2010 Mayor Johnson called the meeting to order at 7:31 p.m. Present were Ald. Fiedler, Schaumberg, Soltysiak, Werner, Borgman and Snead, and Deputy Clerk Blenski. Ald. Harenda was absent. Those present recited the Pledge of Allegiance. The Deputy stated that the meeting was noticed in accordance with the open meeting law on November 19. COMMUNICATION FROM THE MAYOR The Mayor stated that he recently made an announcement that he would not seek re- election in April. No one registered to speak under Public Comment. CONSENT AGENDA Ald. Soltysiak requested that the 11/8/2010 Council minutes be removed from the Consent Agenda. Ald. Borgman moved to approve the remaining items under the Consent Agenda. Ald. Snead seconded. Motion carried 6 in favor. The following items were approved: Operator’s License for Sarah Auer, Tina Blackman, Kirsten Capps, Nicole (Nikki) Desrocher, Dina Lech, Lori Terrill and Alicia Wysocki Reso. #119-2010 - Approval of Fire Department Agreement with Tess Corners Volunteer Fire Department for 2011 Reso. #120-2010 - Re-Approval of Certified Survey Map - Knudsen Reso. #121-2010 - Resolution Authorizing the Submittal of an Urban Wildlife Damage Abatement and Control (UWDAC) Grant Application Reso. #122-2010 - Authorization to Order Two Police Department Vehicles Reso. #123-2010 - Approval of Purchase of 6” Portable Pumps APPROVAL OF 11/8/2010 COMMON COUNCIL MINUTES Ald. Schaumberg moved to approve. Ald. Snead seconded. Ald. Soltysiak requested that the minutes be corrected to reflect that Ald. Schaumberg called for the question regarding Reso. #110-2010 and Ald. Werner called for the question regarding Reso. #117-2010. Motion to approve the minutes as corrected carried 6 in favor. UNFINISHED BUSINESS Ord. #1332 - An Ordinance to Amend the Zoning Map of the City of Muskego (Willow Glen - RM-1 and RS-2 to PD). On the floor, deferred 11/8/2010. Ald. Borgman moved to defer because the Plan Commission has not made a recommendation yet. Ald. Werner seconded; motion carried. Reso. #108-2010 - Denial of Claims - July 22, 2010 Flooding and Sewer Backup. On the floor, deferred 11/8/2010. Ald. Borgman distributed various documents and gave Common Council Minutes Page 2 November 23, 2010 his explanation of what may have caused the sewer backups in the Freedom Square area. The grate under the Freedom Square Foot Bridge was blocked with debris from the main pond, which resulted from the tornado that occurred earlier. On the night of the storm, the water rose to the top railing of the bridge. Various residents from the condominiums attempted to open the grate, but were unsuccessful. In addition, Ald. Borgman stated that the sewer line was under designed and not inspected regularly. He does not want this issue to be shrugged off. The City was responsible for cleaning the pond and grate as well as the maintenance and update of the spillway. The City is responsible for checking the pipes to make sure they are working. Ald. Borgman stated that he understands that there is a timing issue regarding the denial of the claims. However, he wants the issue to go back to the Finance Committee. Ald. Fiedler acknowledged that he had several constituents on the claim list as well. The City is not in a position to adjust claims. However, the Public Works Committee has been directed to address the issues that caused the backups that were experienced. Money has been budgeted to assist homeowners to prevent this from happening again. He encouraged any resident who believes the City has liability regarding this matter to file a claim. The Mayor stated almost a million dollars was being allocated to correct these problems, which is money well spent to protect the community. Motion carried 5 in favor and Ald. Borgman abstaining. REVIEW OF COMMITTEE REPORTS The following minutes were reviewed: 10/26/2010 Finance Committee, 10/6/2010 Public Safety Committee, 10/18/2010 Public Works Committee, 10/11/2010 Parks & Recreation Board and 8/19/2010 and 9/16/2010 Teen Advisory Board. FIRST READING OF ORDINANCES Ord. #1335 - An Ordinance to Establish Salaries for Certain Elected Officials. Ord. #1336 - An Ordinance to Amend Chapter 28, Section 28.05 (2) (a), of the Municipal Code of the City of Muskego (Testing of Private Wells). VOUCHER APPROVAL Ald. Snead moved for approval of payment of General Vouchers in the amount of $109,794.63. Ald. Fiedler seconded. Motion carried 6 in favor. Ald. Snead moved for approval of payment of Utility Vouchers in the amount of $22,617.52. Ald. Fiedler seconded. Motion carried 6 in favor. Ald. Snead moved for approval of payment of Wire Transfers for Debt Service in the amount of $554,800. Ald. Fiedler seconded. Motion carried 6 in favor. CITY OFFICIALS’ REPORTS The December calendar was reviewed. COMMUNICATIONS AND MISCELLANEOUS BUSINESS Ald. Borgman expressed his gratitude for all the good wishes he received while ill. Ald.
