COMMON COUNCIL Minutes 20101026 COMMON COUNCIL - CITY OF MUSKEGO Unapproved MINUTES OF MEETING HELD OCTOBER 26, 2010 Mayor Johnson called the meeting to order at 8:18 p.m. Present were Ald. Fiedler, Schaumberg, Soltysiak, Werner, Harenda, and Snead, and Deputy Clerk Blenski. Ald. Borgman was absent. Those present recited the Pledge of Allegiance. The Deputy stated that the meeting was noticed in accordance with the open meeting law. COMMUNICATIONS FROM THE MAYOR’S OFFICE Mr. Mike Lemens was present on behalf of the Wisconsin Chapter of the American Public Works Association. He presented an award to the City for the construction of Well #13. No one registered to speak under Public Comment. PUBLIC HEARING The Public Hearing notice was read to consider the petition of Curt Klenz, on behalf of Carl Wauer, to rezone property on Janesville Road (known as part of Tax Key Number 2229.989) from M-3 - Landfill & Extractive District to M-2 - General Industrial District and to grant a 2020 Comprehensive Plan Amendment from Landfill and Extractive to Industrial for the purpose of a future land division and construction of an auto repair facility. Mayor Johnson stated that the current zoning, M-3, only allows land and extractive uses. The proposed zoning of M-2 is less intensive. The rezoning is proposed so the existing BP Gas Station and Auto Repair Shop can relocate to the site. The business is currently located on the southwest corner of Janesville Road and Lannon Drive. Only the operation of the repair shop would be moved to the new location. The business is proposing to move to the new site because of the Janesville Road reconstruction project. The Mayor noted that the Plan Commission would have to approve the Building, Site and Operation Plan in the future. Several Council members were pleased that this business would remain in Muskego. No one requested to be heard. The Mayor closed the hearing at 8:26 p.m. CONSENT AGENDA Ald. Werner moved to approve the items under the Consent Agenda. Ald. Fiedler seconded. Motion carried 6 in favor. On the floor, deferred 10/12/2010. Ald. Werner moved to defer because the Plan Commission has not made a recommendation yet. Ald. Harenda seconded; motion carried. Ord. #1334 - An Ordinance to Create Regulations to Ensure Compliance with Administrative Regulations of the Wisconsin Department of Natural Resources for Private Water Supply Wells in the City of Muskego. Second Reading. Ald. Werner moved for adoption. Ald. Fiedler seconded. Motion carried 6 in favor. NEW BUSINESS Reso. #108-2010 - Denial of Claims - July 22, 2010 Flooding and Sewer Backup. The Mayor stated that Ald. Borgman was not present because he was ill and requested tht this issue be deferred. Ald. Harenda moved for adoption. Ald. Schaumberg seconded. Ald. Harenda moved to defer. Ald. Soltysiak seconded; motion carried. Reso. #109-2010 - Consideration of Grievance No. 10-539 Filed by Muskego Police Association Local #360 Regarding Protective Body Armor. Ald. Fiedler moved to deny the grievance. Ald. Werner seconded. Motion carried 6 in favor. REVIEW OF COMMITTEE REPORTS The following minutes were reviewed: 9/14 and 9/28/2010 Finance Committee, 9/13/2010 Parks & Recreation Board, 9/20/2010 Public Works Committee and 9/21/2010 Community Development Authority. FIRST READING OF ORDINANCE Ord. #1333 - An Ordinance to Amend the Zoning Map and 2020 Comprehensive Plan of the City of Muskego (Wauer M-3 to M-2). LICENSES Ald. Werner moved to approve a Temporary License to Sell Wine and Fermented Malt Beverages for the Muskego Chamber of Commerce on November 20, 2010 for the Country Christmas event. Ald. Fiedler seconded. Fiedler seconded. Motion carried 6 in favor. Ald. Snead moved for approval of payment of Utility Vouchers in the amount of $306,678.58. Ald. Fiedler seconded. Motion carried 6 in favor. Ald. Snead moved for approval of payment of Wire Transfers for Debt Service in the amount of $194,936.74. Ald. Fiedler seconded. Motion carried 6 in favor. CITY OFFICIALS’ REPORT The November calendar was reviewed. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Mayor stated that grand opening for the new Wal-Mart Store was Wednesday, October 27.
