MINUTES OF MEETING HELD JULY 27, 2010
Mayor Johnson called the meeting to order at 7:52 p.m. Present were Ald. Fiedler,
Schaumberg, Soltysiak, Werner, Borgman, Harenda, and Snead, and Finance and
Administration Director Mueller. Those present recited the Pledge of Allegiance. Ms.
Mueller stated that the meeting was noticed in accordance with the open meeting law
on July 23, 2010
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Mayor Johnson commented on the severe weather that has been experienced in the
last month. The City Departments as well as Veolia have done an exceptional job with
all the cleanup efforts. The Mayor stated there are a few areas in the City where storm
water problems occur regularly. He proposes that a discussion take place at a
Committee of the Whole meeting so the City can determine how to move forward and
prevent problems in the future. Ald. Snead encouraged constituents to initially contact
their aldermanic representatives with any issues that need to be addressed.
Reso. #084-2010 - Recognition of 25 Years of Service - David A. Adamczyk - Muskego
Police Department. Ald. Snead moved for adoption. Ald. Borgman seconded.
Motion carried 7 in favor.
Reso. #085-2010 - Recognition of 25 Years of Service - Craig A. Moser - Muskego
Police Department. Ald. Werner moved for adoption. Ald. Borgman seconded.
Motion carried 7 in favor.
Reso. #086-2010 - Recognition of 25 Years of Service - Todd G. Nelson - Muskego
Police Department. Ald. Soltysiak moved for adoption. Ald. Schaumberg
seconded. Motion carried 7 in favor.
No one registered to speak under Public Comment.
Ms. Mueller read the public hearing notice to consider revisions to Chapter 17 - Zoning
Ordinance, Chapter 18 - Land Division Ordinance, and Chapter 35 - Property
Maintenance Ordinance. The amendments related to various Zoning, Land Division
and Property Maintenance Code sections requiring clarification and updates.
Community Development Director Muenkel stated the Plan Commission recommended
some of the revisions while others are a result of State Statute changes. Mr. Muenkel
reviewed the following proposed amendments:
Chapter 17 - Zoning Code Changes
Section 5.02 (6) - Change to officially assert how far a structure may be from another
structure on a residential property.
Section 15.05 (8) - Text added to the City’s fence code for further clarification.
Section 6.02 - The State Statute changed for non-conforming structures affected by
natural events; the City needs to change the language in the municipal code.

Sections 8.01 (3) B., 8.01 (3) C. and 8.35 (3) C. - Plan Commission has discussed
allowing Bed & Breakfast establishments in the City with a Conditional Use Grant.
Chapter 18 - Land Division Code Changes
Sections 18.31 (2) and 18.32 (3) g - State Statues changed this year to allow the
platting process to be longer. The City needs to make changes to comply.
Chapter 35 - Property Maintenance Code Changes
35.04 (2), 35.04 (5), 35.04 (7), 35.05 and 35.06 (4) -The City is experiencing issues with
the existing grass cutting ordinance. The proposed changes allow for steeper charges if
the landowner continues to ignore grass cutting. Mr. Muenkel stated the ordinance is
based on language used in Elm Grove. He noted that the code changes also pertain to
cutting grass on vacant lots.
No one was present that requested to speak. The Mayor declared the hearing closed.
CONSENT AGENDA
Ald. Borgman moved to approve the Consent Agenda. Ald. Fiedler seconded.
Motion carried 7 in favor.

UNFINISHED BUSINESS
Ord. #1325 - An Ordinance to Amend the Zoning Map of the City of Muskego and the
2020 Comprehensive Plan (Casey - RS-2 to B-1). Second Reading. Ald. Borgman
moved for adoption. Ald. Fiedler seconded. Ald. Borgman moved to defer. Ald.
Fiedler seconded; motion carried. A recommendation from the Plan Commission is
still needed.
REVIEW OF COMMITTEE REPORTS
The following minutes were reviewed: 6/21/2010 Public Works Committee, June 8 and
June 22, 2010 Finance Committee and 6/15/2010 Community Development Authority.

Ord. #1326 - An Ordinance to Amend Chapter 17, Sections 5.02 (6), 6.02, 8.01 (3) B., 8.01 (3)
C., 8.35 (3) C. and 15.05 (8), of the Municipal Code of the City of Muskego. (Zoning
Ordinance).
Ord. #1327 - An Ordinance to Amend Chapter 18, Sections 18.31 (2) and 18.32 (3) (g), of the
Municipal Code of the City of Muskego. (Land Division Ordinance - Preliminary Plat).
Ord. #1328 - An Ordinance to Amend Chapter 35, Sections 35.04 (2), 35.04 (5), 35.04 (7),
35.05, and 35.06 (4), of the Municipal Code of the City of Muskego. (Property Maintenance
Code).
LICENSE APPROVAL
Ald. Borgman moved to approve an Outside Dance Permit and Amendment to
Licensed Premise for JDDS Investments d/b/a J.D.’s on Hillendale, W191 S6409
Hillendale Drive, for August 21, 2010. Ald. Werner seconded. Motion carried 7 in
favor.
VOUCHER APPROVAL
Ald. Snead moved for approval of payment of General Vouchers in the amount of
$350,325.35. Ald. Fiedler seconded. Motion carried 7 in favor.
Ald. Snead moved for approval of payment of Utility Vouchers in the amount of
$327,380.23. Ald. Fiedler seconded. Motion carried 7 in favor.
CITY OFFICIALS’ REPORTS
The August calendar was reviewed.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
Ald. Snead gave an update regarding upcoming events, including National Night Out
and the Community Festival. Mayor Johnson stated the school district would receive
the prestigious Wisconsin Forward Award in Madison on August 31. Ald. Fiedler
expressed his gratitude to Public Works Superintendent Delikat and staff for their clean
up efforts as a result of the severe weather. Ald. Werner also commended those
communities that provided assistance to Muskego.
