MINUTES OF MEETING HELD JULY 13, 2010
Mayor Johnson noted that several people from the Bay Breeze Condominiums were present.
He stated that the “Bring Back the Lake” issue was not on the agenda. In addition, the City
received correspondence from Mr. Dilworth indicating that he does not want to be involved in
the project. The City is still dealing with the Lemke property.
Mayor Johnson called the meeting to order at 6:30 p.m. Present were Ald. Fiedler,
Schaumberg, Soltysiak, Werner, Borgman, Harenda, and Snead, and Deputy Clerk Blenski.
Those present recited the Pledge of Allegiance. The deputy stated that the meeting was
noticed in accordance with the open meeting law on July 9, 2010
COMMUNICATIONS FROM THE MAYOR’S OFFICE
The Mayor recognized the Department of Public Works and all other groups that assisted with
the storm cleanup. He also acknowledged the school district for receipt of the Forward
Wisconsin award.
CONSENT AGENDA
Ald. Borgman moved to approve the Consent Agenda. Ald. Werner seconded. Motion
carried 7 in favor.
The following items were approved:
Operators’ Licenses for Robert Bankenbusch, Kim Coubol, Lynn Henneberry, Frederick

Comprehensive Plan (Casey - RS-2 to B-1). Ald. Borgman moved to defer. Ald. Harenda
seconded; motion carried.
NEW BUSINESS
Reso. #083-2010 - Relocation Order of the City of Muskego, Waukesha County, Wisconsin
(Durham Drive Reconstruction). Ald. Fiedler stated he would leave the room and abstain from
voting because his property is affected by the relocation order. Ald. Borgman moved for

adoption. Ald. Schaumberg seconded. Motion carried 6 in favor and Ald. Fiedler
abstaining. Ald. Fiedler returned to the meeting.
REVIEW OF COMMITTEE REPORTS
The following minutes were reviewed: 6/1/2010 Plan Commission and 5/17/2010 Public Works
Committee.
LICENSE APPROVAL
Ald. Snead moved to approve a Temporary License to Sell Fermented Malt Beverages
and Dance License for the Muskego Community Festival to be held August 27, 28 and 29,
2010. Ald. Werner seconded. Motion carried 7 in favor.
Ald. Snead moved to approve a Temporary License to Sell Fermented Malt Beverages for
the Muskego Corvette Club for event to be held on August 28, 2010. Ald. Soltysiak
seconded. Motion carried 7 in favor.
VOUCHER APPROVAL
Ald. Snead moved for approval of payment of General Vouchers in the amount of
$428,660.11. Ald. Fiedler seconded. Motion carried 7 in favor.
Ald. Snead moved for approval of payment of Utility Vouchers in the amount of
$234,578.93. Ald. Fiedler seconded. Motion carried 7 in favor.
Ald. Snead moved for approval of payment of Tax Checks in the amount of $759.84. Ald.
Fiedler seconded. Motion carried 7 in favor.
CITY OFFICIALS’ REPORTS
Ald. Harenda gave an update regarding the Teen Idol contest.
CLOSED SESSION
Ald. Borgman moved to convene into closed session at 6:42 p.m. pursuant to Wis. Stats.
§19.85(1)(g) Conferring with legal counsel for the governmental body who is rendering
oral or written advice concerning strategy to be adopted by the body with respect to
litigation in which it is or is likely to become involved, more specifically Parkland
Venture, LLC vs. City of Muskego. Ald. Harenda seconded. Motion carried 7 in favor.
The Deputy Clerk was dismissed. Atty. Remzy Bitar was present for the closed session.
OPEN SESSION
Ald. Borgman moved to reconvene into open session at 7:35 p.m. Ald. Fiedler seconded;
motion carried.
ADJOURNMENT
Ald. Snead moved to adjourn at 7:36 p.m. Ald. Fiedler seconded; motion carried.
