COMMON COUNCIL Minutes 20100511 COMMON COUNCIL - CITY OF MUSKEGO Approved: 05/25/2010 MINUTES OF MEETING HELD MAY 11, 2010 The meeting was called to order at 7:30 p.m. by Mayor Johnson. Present were Ald. Fiedler, Schaumberg, Soltysiak, Werner, Borgman, Harenda, Snead, and Deputy Clerk Blenski. Those present recited the Pledge of Allegiance. The Deputy stated that the meeting was noticed in accordance with the open meeting law on May 7, 2010. There were no Communications from the Mayor and no one registered to speak under Public Comment. PUBLIC HEARING The Deputy read the public hearing notice to consider the petition of Andrew Drefahl to rezone property known as Tax Key Number 2195.058 located at S77 W18512 Janesville Road from RS-3 - Suburban Residence District to DR-1 - Downtown Revival District for the purpose of allowing existing and future business uses. Mayor Johnson stated that the DR-1 zoning would allow the existing use as a conforming use. The current use on the RS-3 property is legal; however the petition also operates a limited office business from the property. The DR-1 district conforms to the commercial uses found in the 2020 Comp Plan; it would allow the expanded use of the office business if needed. The DR-1 would also allow other future commercial uses with Plan Commission approval pursuant to the 2020 Comp Plan. Carol Giesegh, S77 W18582 Janesville Road spoke:  She explained that when her property was purchased in the early ‘70’s, she was told it was zoned residential or commercial. The 2020 Comp Plan depicts the property as residential only.  Why aren’t the four homes on Janesville Road all zoned the same?  She would like her property to have the commercial zoning on it. She is concerned that she will not be able to sell her property as residential in the future with the road reconstruction. Ald. Werner stated that the parcels located on Janesville Road from Drefahl to the Muskego Nursing Home are identified as commercial in the 2020 Comp Plan. He told Ms. Giesegh that she could petition to have her property rezoned to commercial in the future. No one else requested to be heard; the Mayor declared the hearing closed at 7:40 p.m. CONSENT AGENDA Ald. Borgman moved to approve the items under the Consent Agenda. Ald. Soltysiak seconded.
