MINUTES OF MEETING HELD SEPTEMBER 8, 2009
The meeting was called to order at 7:30 p.m. by Mayor Johnson. Also present were
Ald. Schaumberg, Schneider, Werner, Borgman, Harenda, and Snead, Planner
Trzebiatowski, and Clerk-Treasurer Moyer. Ald. Fiedler was absent. Those present
recited the Pledge of Allegiance. The Clerk stated that the meeting was noticed in
accordance with the open meeting law on September 4, 2009.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Mayor Johnson acknowledged the efforts of the Festival Committee on organizing
another successful event.
Reso. #127-2009 - Recognition of 30 Years of Service - Scott Kloskowski - Sewer and
Water Utilities. Borgman moved for adoption. Snead seconded. Motion carried 6
in favor. The Mayor presented the resolution to Mr. Kloskowski and thanked him for his
service and dedication.
Saturday, September 12, 2009 was proclaimed, “Muskego Food Pantry Day.” Ald.
Borgman stated that the “Neighbor to Neighbor” Bake Sale was organized because the
Library Board expressed concern for the needs of the community. He urged everyone
to participate.
PUBLIC HEARING
The Clerk read the public hearing notice to consider revisions to Chapter 17 Zoning
Ordinance, Section 13, of the Municipal Code relating to the Wellhead Protection
Overlay District.
Mr. Trzebiatowski stated the proposed revisions have been discussed for several
months. He presented a brief overview regarding the issue. The City currently has a
Wellhead Protection Ordinance that applies to some municipal wells. The ordinance
prohibits some uses within certain distances of the affected wells. Staff researched the
issue to propose language that would consistently protect all the City’s wells. The new
proposal recommends that the City follow the DNR requirements. The City’s ordinance
would adopt the DNR regulations by reference; all City wells would be protected.
Mr. Trzebiatowski stated that the ordinance could be amended in the future if a unique
situation had to be addressed. Mayor Johnson stated that by adopting the DNR
regulations, the City does not have to stay on top of the issue. The DNR will do that
and assume the cost. Mr. Trzebiatowski noted that the ordinance would allow any
existing use to continue.
Rene Farias, W167 S7294 Briargate Lane, stated he believed the proposal was
lowering the standards regarding the quality of the environment. He believes the issue
needs more investigation.
The Mayor stated the Plan Commission had to review and make a recommendation
regarding the new ordinance language, which would be done at the October meeting.
He declared the hearing closed at 7:50 p.m.

OLD BUSINESS

18.21 and 18.46, of the Municipal Code of the City of Muskego (Open Space Dedication
Requirements). On the floor, deferred 8/25/2009. Motion to adopt carried 6 in favor.
VOUCHER APPROVAL
Ald. Snead moved for approval of payment of General Vouchers in the amount of
$915,386.16. Ald. Borgman seconded. Motion carried 6 in favor.
Ald. Snead moved for approval of payment of Utility Vouchers in the amount of
$41,561.31. Ald. Schneider seconded. Motion carried 6 in favor.
Ald. Snead moved for approval of payment of Tax Checks in the amount of
$5,454.87. Ald. Schneider seconded. Motion carried 6 in favor.
CITY OFFICIALS’ REPORTS
Mayor stated that he would obtain quotes to replace one of the City Hall compressors.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
Ald. Snead thanked the aldermen who participated in the Muskego Community Festival.
