MINUTES OF MEETING HELD MAY 26, 2009
Mayor Johnson called the meeting to order at 7:32 p.m. Present were Ald. Fiedler,
Schaumberg, Schneider, Werner, Borgman, Harenda, and Snead, Clerk-Treasurer
Moyer and City Attorney Molter. Those present recited the Pledge of Allegiance. The
Clerk stated that the meeting was noticed in accordance with the open meeting law on
May 22, 2009.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Reso. #075-2009 - Honoring City of Muskego Eagle Scout Sam Weiss. Werner moved
for adoption. Snead seconded. Motion carried 7 in favor. For his Eagle Scout
project, Mr. Weiss constructed an outdoor amphitheater at the Muskego Public Library.
Several Council members acknowledged that the amphitheater is a wonderful asset that
will be used by the community for many years. Mayor Johnson presented the resolution
to Eagle Scout Weiss.
PUBLIC HEARING
The Clerk read the Notice of Public Hearing to consider the petition of Keith Hammitt to
rezone property on Janesville Road (Tax Key Numbers 2198.991.002 and 2198.992)
from B-4 - Highway Business District to DR-1 - Downtown Revival District for the
purpose of future commercial development.
Mayor Johnson stated that the petition is to allow a commercial structure to be located
up to 10 feet from the right-of-way rather than 40 feet. The existing zoning for the
parcel already allows auto repair use subject to a Conditional Use Grant. The Plan
Commission will hold a public hearing regarding the conditional use on June 2, 2009.
Suzi Link, W172 S7297 Lannon Drive, stated she has concerns about the business
being located on this parcel. Rezonings should only be done for a good reason. Ms.
Link noted that the proposed use could pose a hazard to the water system and Little
Muskego Lake.
The Mayor declared the hearing closed.
CONSENT AGENDA
Fiedler requested that Reso. #079-2009 be removed from the Consent Agenda.
Borgman moved to approve the remaining items under the Consent Agenda.
Fiedler seconded. Motion carried 7 in favor.

NEW BUSINESS
Reso. #079-2009 - Approval of Countywide Mutual Aid Agreement. Fiedler moved for
adoption. Borgman seconded. Fiedler requested that the Mayor or staff contact the
County to determine if there is liability protection for the municipality. Motion carried 7
in favor.
REVIEW OF COMMITTEE REPORTS
The following minutes were reviewed: 4/28/2009 Finance Committee, 4/20/2009 Public
Works Committee, 2/17/2009 Community Development Authority, 4/21/2009 Mayor’s
Task Force and 4/20/2009 Parks & Recreation Board.

Reso. #081-2009 - Relocation Order of the City of Muskego, Waukesha County,
Wisconsin (Water Distribution System Improvements). Borgman moved for adoption.
Harenda seconded. Motion carried 7 in favor.
Reso. #082-2009 - Resolution to Amend City Policy for Depositing and Investing City
Funds. Schneider moved for adoption. Schaumberg seconded. Motion carried 7
in favor.
Reso. #083-2009 - A Resolution Authorizing Entry into an Intergovernmental
Cooperation Agreement Relating to the “Wisconsin Investment Series Cooperative” and
Authorizing Participation in the Investment Programs of the Fund. Borgman moved for
adoption. Schneider seconded. Motion carried 7 in favor.
Ord. #1299 - An Ordinance to Amend the Zoning Map of the City of Muskego (Firestone
- B-4 to DR-1). First Reading.
LICENSES
Fiedler moved to approve an Outside Dance Permit for Loreen Klauser (Hunter’s
Nest), S80 W14401 Schultz Lane, for 6/20/2009. Harenda seconded. Motion
carried 7 in favor.
VOUCHER APPROVAL
Fiedler moved for approval of payment of General Vouchers in the amount of
$487,868.02. Snead seconded. Motion carried 7 in favor.
Fiedler moved for approval of payment of Utility Vouchers in the amount of
$54,974.36. Snead seconded. Motion carried 7 in favor.
Fiedler moved for approval of Tax Checks in the amount of $2,385.60. Snead
seconded. Motion carried 7 in favor.
Fiedler moved for approval of Wire Transfers for Tax Settlements in the amount of
$2,431,192.88. Snead seconded. Motion carried 7 in favor.

Fiedler moved for approval of Wire Transfers for Debt Service in the amount of
$1,324,306.25. Snead seconded. Motion carried 7 in favor.
CITY OFFICIALS’ REPORTS
The June calendar was reviewed.
CLOSED SESSION
Werner moved to convene into closed session pursuant to Wis. Stats. §19.85(1)(e)
Deliberating or negotiating the purchasing of public properties, the investing of
public funds, or conducting other specified public business, whenever
competitive or bargaining reasons require a closed session, more specifically
settlement with Muskego Police Association. Borgman seconded. Motion carried
7 in favor. The City Attorney and Clerk-Treasurer were dismissed.
OPEN SESSION
Fiedler moved to reconvene into open session. Schneider seconded; motion
carried.
Reso. #084-2009 - Authorize Execution of the Labor Agreement Between the Muskego
Police Association and the City of Muskego - January 1, 2009 - December 31, 2010.
Schaumberg moved to deny the agreement. Borgman seconded; motion carried.
ADJOURNMENT
Snead moved to adjourn at 9:07 p.m. Fiedler seconded; motion carried.
