COMMON COUNCIL - CITY OF MUSKEGO Approved: 05/26/2009
MINUTES OF MEETING HELD MAY 12, 2009
Mayor Johnson called the meeting to order at 7:30 p.m. Present were Ald. Fiedler,
Schaumberg, Schneider, Werner, Borgman, Harenda, and Snead, Community
Development Director Muenkel, Deputy Clerk Blenski and City Attorney Molter. Those
present recited the Pledge of Allegiance. The Deputy Clerk stated that the meeting was
noticed in accordance with the open meeting law on May 8, 2009.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Reso. #053-2009, which was adopted on April 21, 2009, was presented to former Ald.
Tina Schaefer. Ms. Schaefer accepted the resolution and thanked the residents of
District 6, Mayor Johnson, members of Council, and City staff.
Reso. #069-2009 - Recognition of 30 Years of Service - Wayne Delikat - Department of
Public Works. Fiedler moved for adoption. Schneider seconded. Motion carried 7
in favor.
Reso. #070-2009 - Recognition of 30 Years of Service - Marvin Palubicki - Department
of Public Works. Borgman moved for adoption. Harenda seconded. Motion
carried 7 in favor.
CONSENT AGENDA
Fiedler moved to approve the Consent Agenda. Schneider seconded. Motion
carried 7 in favor.

OLD BUSINESS
Ord. #1295 - An Ordinance to Repeal and Recreate the Chapter 17 Zoning Code of the
City of Muskego. On the floor, deferred 4/28/2009. Mr. Muenkel stated the Plan
Commission has recommended adoption subject to a few amendments. The proposed
amendments intend to make the Conservation subdivision more appealing and reduce
the amount of open space required and allow more bonus lots depending on the
acreage. The guidelines for the bonus parcels would be outlined in Chapter 18.
Borgman stated that the requirement for a historical narrative to justify the number of
bonus parcels allowed too much discretion. Mr. Muenkel stated the Plan Commission
does use discretion when making many of its decisions. Fiedler stated the Plan
Commission recommendation was based on the fact that every parcel that is developed
is different. The Plan Commission does have discretion, but the nine guidelines are
quite specific. Fiedler moved to amend as presented by Mr. Muenkel (attached).
Borgman seconded. Motion carried 7 in favor. Ord. #1295, as amended, adopted
7 in favor.
Ord. #1296 - An Ordinance to Repeal and Recreate the Chapter 18 Land Division Code
of the City of Muskego. On the floor, deferred 4/28/2009. Mr. Muenkel stated the same
changes need to be made in Chapter 18. Fiedler moved to amend as presented.
Borgman seconded. Motion carried 7 in favor. Ord. #1296, as amended, adopted
7 in favor.
LICENSES
Borgman moved to approve a Temporary License to Sell Fermented Malt
Beverages for Muskego Lions Club for 6/27/2009 subject to receipt of Parks &
Recreation Board approval. Werner seconded. Motion carried 6 in favor and
Snead abstaining because her husband is an officer of the club.
Werner moved to approve a change of corporate agent to Stephanie R. Johnson
for the “Class A” License held by Ultra Mart Foods, LLC (d/b/a Pick ‘n Save).
Borgman seconded. Motion carried 7 in favor.
Schneider moved to approve a Salvage and Recycling Permit for Kohne Salvage,
W200 S7203 Williams Drive. Werner seconded. Motion carried 7 in favor.
VOUCHER APPROVAL
Fiedler moved for approval of payment of General Vouchers in the amount of
$404,726.20. Snead seconded. Motion carried 7 in favor.
Fiedler moved for approval of Tax Checks in the amount of $508.34. Snead
seconded. Motion carried 7 in favor.
Fiedler moved for approval of payment of Utility Vouchers in the amount of
$31,802.79. Snead seconded. Motion carried 7 in favor.

COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
Ald. Harenda noted that the Teen Advisory Board would be recruiting new members, as
several teens on the board will be leaving.
