COMMON COUNCIL Minutes 20090210 COMMON COUNCIL - CITY OF MUSKEGO Approved 2/24/2009 MINUTES OF MEETING HELD FEBRUARY 10, 2009 Mayor Johnson called the meeting to order at 7:30 p.m. Present were Ald. Schneider, Werner, Borgman, Pavelko, and Snead, Clerk-Treasurer Moyer, and City Attorney Trindl. Ald. Fiedler and Schaefer were absent. Those present recited the Pledge of Allegiance. The Clerk stated that the meeting was noticed in accordance with the open meeting law on 2/6/2009. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor stated that the City has submitted the applicable plans to the State that could be covered under the Stimulus bill. No one registered to speak under Public Comment. NEW BUSINESS Reso. #016-2009 - Proceedings by the Common Council of the City of Muskego to Discontinue and Vacate a Road Right-of-Way in the City of Muskego, Wisconsin (Bridgeway Court and Commerce Drive). Borgman moved for adoption. Schneider seconded. Motion carried 5 in favor. CONSENT AGENDA Borgman moved to approve the items under the Consent Agenda. Schneider seconded. Motion carried 5 in favor. The following items were approved: Approval of Operators’ Licenses for Margaret Bissell, Shannon Lesniewski, Christa Lewis-Getz, Jeffrey Ryan and Heather Stigler. Common Council Minutes - 1/27/2009 Reso. #013-2009 - Approval of Certified Survey Map - Muskego Commerce Center West Reso. #014-2009 - Re-approval of Certified Survey Map - William Carity Reso. #015-2009 - Authority to Accept an Offer to Purchase by Brad and Shannon May for Sale of Portion of City-Owned Lot (S75 W13950 Bluhm Drive) REVIEW OF COMMITTEE REPORTS Minutes of the 1/13/2009 Finance Committee, 1/6/2009 Plan Commission, 1/19/2009 2020 Comprehensive Planning Committee, 12/29/2008 Teen Advisory Board were reviewed. Ord. #1289 - An Ordinance to Amend Chapter 42, Section 42.02 and Section 42.03 (c), of the Municipal Code of the City of Muskego (Sexual Offenders Residency and Loitering Restrictions). On the floor, deferred 1/27/2009. Borgman moved to defer. Werner seconded; motion carried. Ord. #1290 - An Ordinance to Amend Chapters 17 and 18 of the Municipal Code of the City of Muskego (Wetland Protection Offsets). Second Reading. Borgman moved for Common Council Minutes Page 2 February 10, 2009 adoption. Schneider seconded. Borgman moved to defer. Schneider seconded; motion carried. LICENSES Werner moved to approve a Temporary License to Sell Wine for the Friends of Muskego Public Library for an event to be held May 16, 2009. Borgman seconded. Motion carried 5 in favor. VOUCHER APPROVAL Pavelko moved for approval of payment of Utility Vouchers in the amount of $669,072.09. Borgman seconded. Motion carried 5 in favor. Snead moved for approval of payment of General Vouchers in the amount of $642,039.07. Werner seconded. Motion carried 5 in favor. Snead moved for approval of Tax Checks in the amount of $19,885.54. Schneider seconded. Motion carried 5 in favor. CITY OFFICIALS’ REPORTS Ald. Werner stated the District Attorney investigated the allegation that he and Frank Waltz had a conflict of interest because of their affiliation with the Atonement Church. The District Attorney has completed the investigation and has concluded that there were no violations. ADJOURNMENT Snead moved to adjourn at 7:45 p.m. Schneider seconded; motion carried.
