CCM20070508 COMMON COUNCIL - CITY OF MUSKEGO Approved: 05/22/2007 MINUTES OF MEETING HELD MAY 8, 2007 The meeting was called to order at 7:30 PM by Mayor Johnson. Present were Ald. Fiedler, Schaefer, Melcher, Werner, Borgman, Pavelko, and Snead, City Attorney Molter, City Administrator Sheiffer, and Clerk-Treasurer Moyer. City Engineer White, Police Chief Geiszler, Finance Department Supervisor Mueller and Information Systems Director Sommers were also present. Those present recited the Pledge of Allegiance. Ms. Moyer stated that the meeting was noticed in accordance with the open meeting law on 5/4/2007. COMMUNICATIONS FROM THE MAYOR’S OFFICE A Proclamation declaring May 18 and 19, 2007 as American Legion Auxiliary Poppy Days was read. PUBLIC COMMENT The following individuals registered to speak regarding Reso. #105-2007: Dean Bartosh, W210 S10320 Janis Lane, Muskego. Mike Godsell, 26358 Even Heg Court, Wind Lake Steve Whittow, S76 W19804 Prospect Drive, Muskego All spoke in favor of the resolution and encouraged the Council to do what it could to get the County to take action regarding the Racine/Kelsey intersection. CONSENT AGENDA Borgman moved to approve the Consent Agenda items engross. Melcher seconded. Melcher requested that Resolution #102-2007 be removed from the Consent Agenda. Motion and second withdrawn. Borgman moved to approve the Consent Agenda items engross with the exception of Resolution #102- 2007. Schaefer seconded. Motion carried 7-0. The following items were approved: Common Council Minutes of 4/24/2007 Reso. #100-207 - Resolution Supporting LRB-2103/P3, An Act to Create 125.07 (3) (a) 3g. of the Wisconsin State Statutes, Relating to the Prohibition Against Underage Persons Entering or Being on Any Premises Operating Under an Alcohol Beverage License. Reso. #101-2007 - Resolution Accepting the Muskego NOW as the Official Newspaper of the City of Muskego. Common Council Page 2 May 8, 2007 Reso. #103-2007 - Appointment of Citizen Member to the Board of Review. Reso. #104-2007 - Approval of Reduction in Letter of Credit - Oakridge Glen Subdivision. NEW BUSINESS Reso. #102-2007 - Resolution Approving By-Laws and Rules of Procedure for the City of Muskego Economic Development Committee. Melcher moved for adoption. Borgman seconded. Motion carried 6 in favor and Melcher voting no. REVIEW COMMITTEE REPORTS Minutes of the Finance Committee 4/10/2007, Plan Commission 4/17/2007 and Library Board 3/28/2007 were reviewed. OLD BUSINESS Reso. #027-2007 -Approval of Condominium Plat, Developer’s Agreement and Letter of Credit for St. Andrews Phase 2. On the floor, deferred 4/24/2007. Borgman moved to defer. Fiedler seconded. Motion carried 7-0. Reso. #068-2007 - Resolution to Amend the City’s Official Map Regarding Durham Drive Realignment. On the floor, deferred 4/24/2007. Mayor Johnson stated that staff have met with the DNR. A resolution has been proposed, which staff want to consider and then forward to the Public Works Committee. Borgman moved to withdraw. Fiedler seconded. Motion carried 7-0. Reso. #061-2007 - Granting Placement of Water Ski Jump on Bed of Little Muskego Lake (Water Bugs Ski Team). (Possible Reconsideration). Borgman moved to reconsider. Melcher seconded. Mayor Johnson stated that the agreement has been revised and the jump has been relocated. Motion carried 7-0. Melcher moved to amend to include revised agreement. Werner seconded. Motion carried 7-0. Schaefer moved for adoption. Fiedler seconded. Motion to adopt Reso. #061-2007, as amended, carried 7-0. NEW BUSINESS (Continued) Reso. #105-2007 - Resolution of the City of Muskego Common Council to Request Waukesha County Address the Concerns on Racine Avenue/Kelsey Drive. Schaefer moved for adoption. Borgman seconded. Schaefer stated she has been working on this issue since taking office. The County has done a traffic study, which supports that the intersection should be signaled. Currently, it is seventh on the County’s Prioritized Traffic Signal list. Schaefer stated she has been working with the County to move the intersection up on the list and to implement some things that could be done in the meantime. She would like the Common Council Page 3 May 8, 2007 County to do more than two signals from the list per year. If the intersections on the list are dangerous, let’s reduce the hazards. The Mayor suggested that the resolution be amended to request that the County increase the number of intersections it signalizes from two to three or more per year. Schaefer moved to amend to add, “BE IT FURTHER RESOLVED That the Common Council of the City of Muskego further requests that Waukesha County increase the number of traffic signals that are installed (from the Prioritized Traffic Signal List) from two to three or more per year.” Melcher seconded. Melcher suggested that someone from the City attend the County’s budget hearing to provide input regarding the importance of these safety issues. The Mayor stated that he would be forwarding actual data he obtained from the Police Department to Waukesha County regarding the Racine/Kelsey intersection. Motion to amend carried 7-0. Reso. #105-2007, as amended, carried 7-0. Reso. #106-2007 - Resolution Establishing an Ad Hoc Committee to Make Recommendations on Addressing the Fire Study Recommendations Found in the April, 2007 Master Plan for the Provision of Fire/Rescue Service. Fiedler moved to defer until August 1. Werner seconded. Fiedler stated he was encouraged by the communication that has begun between the two departments. Schaefer and Snead suggested that the Council members forward the goals they would like to see accomplished to Jennifer or the Mayor. Motion carried 7-0. LICENSES Borgman moved for approval of an Operator’s License for Cheri Andrews, Dawn Brust, Julie Hakala, Donald Richter, Lawrence Schneider, Gerard Sneesby and approval of a Renewal Operator’s License for William Faber. Werner seconded. Motion carried 7-0. The Mayor noted that approval of the “Class B” Beer and Liquor License for Dingers, the Hitter’s Hideaway, Inc. has been withdrawn. VOUCHER APPROVAL Schaefer moved for approval of payment of Utility Vouchers in the amount of $46,421.58. Borgman seconded. Motion carried, 7-0. Melcher moved for approval of payment of General Vouchers in the amount of $507,852.32. Borgman seconded. Motion carried, 7-0. Melcher moved for approval of payment of Tax Checks in the amount of $8,287.07. Borgman seconded. Motion carried, 7-0. CITY OFFICIALS’ REPORTS Melcher stated today was National Teacher’s Day. He congratulated Ald. Snead and all the Muskego School system teachers. Common Council Page 4 May 8, 2007 CLOSED SESSION Borgman moved to convene into closed session pursuant to Wis. Stats. §19.85(1)(c) Considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility, more specifically setting salaries for recently promoted Captains, Lieutenants and Sergeants. Pavelko seconded. Motion carried 7-0. Borgman moved to convene into closed session pursuant to Wis. Stats. §19.85(1)(e) Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, more specifically purchase of property in the floodway (S76 W18109 Janesville Road). Fiedler seconded. Motion carried 7-0. The City Attorney and Clerk-Treasurer were dismissed. OPEN SESSION Fiedler moved to reconvene into open session. Melcher seconded; motion carried. Reso. #107-2007 - Resolution Regarding Reorganization/Retitling of Police Department Administration. Borgman moved for adoption. Werner seconded; motion carried. Reso. #108-2007 - Resolution Setting Salaries for Recently Promoted Captains, Lieutenants and Sergeants. Schaefer moved for adoption. Snead seconded; motion carried.
