CCM20060720sp COMMON COUNCIL - CITY OF MUSKEGO Approved: 08/08/2006 MINUTES OF SPECIAL MEETING HELD JULY 20, 2006 The meeting was called to order at 6:45 PM by Mayor Damaske. Present were Ald. Salentine, Borgman, Buckmaster, Madden, Melcher, Schroeder, and Snead, City Administrator Sheiffer. Those present recited the Pledge of Allegiance. The Mayor stated the meeting was noticed in accordance with the open meeting law. PUBLIC COMMENT Tom Ralston requested that the Council defer action on the hiring of special legal counsel for the recall. Information regarding the recall process is available through the State Elections Board. William Schneider referred to a newspaper article regarding a potential lawsuit against the Historical Society and does not want taxpayer dollars to be used for the expense that will be incurred. NEW BUSINESS Reso. #145-2006 - Approval of Waiver of Conflict of Interest. Salentine moved for adoption. Madden seconded. Salentine stated that City Attorney Molter indicated to her that it would be a conflict of interest for him to provide legal counsel regarding the recall. The attorney proposed to be hired would be for the City Clerk. She believes legal counsel should be in place if needed. That does not mean that any money will be spent. Melcher spoke with the Deputy Clerk from the City of Pewaukee who used Atty. Maistelman for its recall. Pewaukee hired special counsel specifically for the City Clerk. Approximately $5,000 was spent. Buckmaster noted that even if Atty. Molter were used, there would still be a cost factor. Discussion took place about why the issue did not go to the 7/25/2006 Finance Committee. Some Council members had questions for Atty. Molter. Buckmaster moved to refer the issue to the Finance Committee. Schroeder seconded. It was suggested that Atty. Molter be requested to come at 7:00 PM. Motion carried with Salentine and Borgman voting no. Reso. #146-2006 - Acceptance of Engagement Letter Submitted by Maistelman & Associates, LLC. Salentine moved for adoption. Madden seconded. Buckmaster moved to refer the issue to the Finance Committee. Schroeder seconded; motion carried. ADJOURNMENT Borgman moved to adjourn at 7:12 PM.
