CCM20060613 COMMON COUNCIL - CITY OF MUSKEGO Approved: 06/27/06 MINUTES OF MEETING HELD JUNE 13, 2006 The meeting was called to order at 7:30 PM by Mayor Damaske. Present were Ald. Salentine, Borgman, Buckmaster, Madden, Melcher, and Snead, City Attorney Molter, City Administrator Sheiffer, Plan Director Muenkel, and Clerk-Treasurer Moyer. Ald. Schroeder was absent. Those present recited the Pledge of Allegiance. The Clerk stated the meeting was noticed in accordance with the open meeting law on 6/9/2006. COMMUNICATIONS FROM THE MAYOR’S OFFICE Mayor Damaske reported that a meeting with Mr. Art Dyer has been scheduled for June 21. In addition, the Mayor has been asked to participate in a meeting regarding utilization of the Performing Arts Center at the high school. CONSENT AGENDA Salentine moved to approve the Consent Agenda items engross with the exception of Reso. #125-2006 and Reso. #126-2006. Borgman seconded; motion carried. The following items were approved: Common Council Minutes of 5/23/2006 Reso. #120-2006 - Approval of Revised Lease Agreement with Eddie Schaefer for Park Arthur (South Section). Reso. #121-2006 - Approval of General Facility Agreement between the City of Muskego and Muskego-Norway School District. Reso. #122-2006 - Approval of Certified Survey Map - Lang. Reso. #123-2006 - Approval of Certified Survey Map - Leonard. Reso. #124-2006 - Authorization to Purchase Accessible Voting Equipment. Reso. #127-2006 - Approval of Various License Applications for the City of Muskego for the Licensing Period July 1, 2006 to June 30, 2007. NEW BUSINESS Reso. #125-2006 - Approval of Third Quarter Fire Protection Agreement with Tess Corners Volunteer Fire Department. Salentine moved to amend to add, “The Tess Corners Volunteer Fire Department need to remain in compliance with the Department of Commerce standard requirements for Chapter Comm 30 and 32 to continue receiving the 2%.” Madden seconded; motion carried. Reso. #125-2006, as amended, adopted 6-0. Reso. #126-2006 - Approval of Third Quarter Fire Protection Agreement with Muskego Volunteer Fire Company. Common Council Minutes Page 2 June 13, 2006 REVIEW OF COMMITTEE REPORTS Minutes of the 5/9/2006 Finance Committee, 5/16/2006 Plan Commission, 5/9/2006 Public Works, 4/26/2006 Library Board and 4/27/2006 Muskego Senior Focus Ad-Hoc Committee were reviewed. OLD BUSINESS Ord. #1227 - An Ordinance to Amend the Zoning Map of the City of Muskego (Burke Properties RCE/OPD and A to RSE/OPD and A to A). On the floor, deferred 5/23/2006. Buckmaster moved to defer. Salentine seconded; motion carried. Ord. #1229 - An Ordinance to Amend the 2010 Comprehensive Plan of the City of Muskego. On the floor, deferred 5/23/2006. Ord. #1229-A - An Ordinance to Amend the 2010 Comprehensive Plan of the City of Muskego. Mr. Muenkel noted that this deals with Boundary Area #3. Salentine moved to amend Ord. #1229 to reflect Ord. #1229-A with the rest of Ord. #1229 to be deferred. Buckmaster seconded. Motion carried 6-0. Ord. #1229-B - An Ordinance to Amend the 2010 Comprehensive Plan of the City of Muskego. Mr. Muenkel stated that this deals with Boundary Area #4. Salentine moved to amend Ord. #1229 to reflect Ord. #1229-B. Madden seconded. Motion carried 6-0. Ord. #1230 - An Ordinance to Amend the Zoning Map of the City of Muskego (Lang - EA/OD to A). Second Reading. Buckmaster moved for adoption. Salentine seconded. Motion carried 6-0. Mr. Muenkel was dismissed. NEW BUSINESS (Continued) Reso. #128-2006 - Resolution Supporting Agreements Between the City of Muskego and the Wisconsin State Elections Board Regarding Use of the Statewide Voter Registration System (SVRS). Salentine moved for adoption. Madden seconded. The Clerk provided a brief explanation of the system. Motion carried 6-0. Reso. #129-2006 - A Resolution to Adopt a Procedure that Allows for Use of Public Comment During Common Council Meetings. Salentine moved for adoption. Borgman seconded. Melcher objected to speakers being limited to comment only on agenda items and that speakers must be City residents or taxpayers. The proposed procedure will be extremely restrictive for some boards or organizations. This is not the case in other municipalities. Salentine noted that if the issue was with an organized group, there could be one person designated to speak. Madden did not object to allowing comment by other people as long as the City’s residents received priority. Buckmaster recommended that if a nonresident wanted to speak, the individual would have to be sponsored by a City resident. It was suggested that this item be deferred for the Clerk and/or City Administrator to draft new language to allow a speaker to be sponsored by a City resident or taxpayer and to determine what will happen if the Public Comment portion is not completed within the 30-minute time frame. Salentine moved to defer. Madden seconded; motion carried. Common Council Minutes Page 3 June 13, 2006 Reso. #130-2006 - Resolution Regarding Muskego Historical Society (Settlement Center Grounds). Salentine moved for adoption. Buckmaster seconded. Buckmaster proposed that the Public Works Committee be the intermediate authority for the Settlement Center. He supports the creation of an Ad-Hoc Committee as suggested by the Mayor. Discussion took place regarding the City’s Public Works Department being able to do some of the required work. City Administrator Sheiffer clarified that a recommendation to do so would have to come from the Finance Committee to the Council and the Council would have to approve by a 3/4 vote. Melcher requested privilege of the floor to allow Mr. Roman to speak. Salentine objected. Salentine moved to amend to add 1. “That a 7-member Ad-Hoc Committee be created to consist of two aldermen (Melcher and Snead), two citizens, one Muskego Historical Society member, one Chamber of Commerce member and one member of an outside Historical Society.” Borgman seconded; motion carried. The Mayor stated the appointment of members to the Committee would be confirmed by the Council Buckmaster moved to amend to add 2. “That the Public Works Committee will be the point of authority for the immediate needs of the Settlement Center.” Melcher seconded; motion carried. Borgman moved to amend to add 3. “A document of a working relationship between the City of Muskego and the Muskego Historical Society will be created by the Ad-Hoc Committee.” Melcher seconded; motion carried. It was suggested that City Administrator Sheiffer meet with the Ad-Hoc Committee initially to get things started. Reso. #130-2006, as amended, adopted 6-0. Reso. #131-2006 - Authorization to Terminate Contract with Dust Free Cleaning Service, Inc. Salentine moved for adoption. Madden seconded. Motion carried 6- 0. LICENSES Salentine moved for approval of a temporary license for Cynthia Krauss for 7/3/2006, renewal of operators’ licenses for Marvin Strasser, Shizuko Gregoric, Jerome Krupa, Kimberly Behling, Patricia Molkentin, Rita Lufkin and regular operators’ licenses for Loretta Cuellar-Brandenberg, Mark Lloyd, Carissa Barrett, Thomas Wilke, Ryan Meddaugh, Nicole Voelkel, Michael Amann, Wendy Hahn, David Gajewski, Stephanie Simic as recommended by the 6/13/2006 Finance Committee. Madden seconded. Motion carried 6-0. Salentine moved for amendment to licensed premise for Club Durham, Inc. for July 8, 2006 and Temporary Class “B” License for Water Bugs for July 3, 2006. Madden seconded. Motion carried 6-0. VOUCHER APPROVAL Salentine moved for approval of payment of General Vouchers in the amount of $513,837.47. Madden seconded. Motion carried 6-0. Madden moved for approval of payment of Utility Vouchers in the amount of $48,977.50. Buckmaster seconded. Motion carried 6-0. Salentine moved for approval of payment of Tax Checks in the amount of $79.95. Madden seconded; motion carried. Common Council Minutes Page 4 June 13, 2006 CITY OFFICIALS’ REPORTS City Administrator Sheiffer updated the Council on several items. The RFP’s for the Fire Service/Rescue Study are out. Four firms with expertise in that area have been invited to submit proposals. In addition, an ad was placed in three publications. She noted that the 2007 budget process would be discussed at the June 22 Committee of the Whole meeting. ADJOURNMENT Buckmaster moved to adjourn at 9:00 PM. Salentine seconded; motion carried.
