COMMON COUNCIL - CITY OF MUSKEGO Approved
MINUTES OF MEETING HELD OCTOBER 11, 2005
The meeting was called to order at 7:30 PM by Mayor Damaske. Present were Ald.
Melcher, Borgman, Buckmaster, Madden, Patterson, Schroeder and Salentine, City
Attorney Molter, City Administrator Sheiffer, Plan Director Muenkel, Clerk-Treasurer
Moyer and Deputy Clerk Blenski. Those present recited the Pledge of Allegiance. The
Mayor stated the meeting was noticed in accordance with the open meeting law. He
noted that the Council would not convene into closed session.
APPROVAL OF MINUTES
Salentine moved for approval of the 9/27/2005 minutes. Borgman seconded; motion
carried.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Clerk-Treasurer Moyer read the Proclamation for United Nations Day, October 24,
2005.
ACCEPTANCE AND REVIEW OF COMMITTEE REPORTS
Salentine moved for acceptance of the 10/5/2005 and 10/11/2005 Finance Committee
minutes. Madden seconded; motion carried.
Minutes of the 9/26/2005 Conservation Commission, 10/4/2005 Plan Commission and
10/4/2005 Community Development Authority were received and placed on file.
OLD BUSINESS
Ord. #1199 - An Ordinance to Amend the Zoning Map of the City of Muskego
(Borchardt - RS-2, RSA and RSA/OIP to RS-2, RSA and RSA/OIP). Possible
Reconsideration. Borgman recused himself while this issue was discussed. Atty.
Molter clarified that if the Council wanted to reconsider this item, it had to be done at
this meeting. Buckmaster moved for reconsideration. Schroeder seconded; motion
carried with Borgman abstaining. Mr. Muenkel reviewed a new rezoning proposal
submitted by Mr. Borchardt. The new zoning lines comply with the concerns expressed
in the past. The 600’ distance from the Chamberlain Hills Subdivision to the RSA area
would be preserved. Atty. Molter further stated that the Council could require another
public hearing. However, the prior action can be reconsidered because the new
proposal is more restrictive than the one considered at the public hearing. Buckmaster
expressed concern about serving the public. The new proposal is less restrictive than
the current zoning. Buckmaster would like the issue deferred for two weeks with
notification to the affected residents. Patterson suggested having another public
hearing. Schroeder stated there was not enough time to publish notice of a public
hearing to be held at the next meeting. Madden moved to defer for two weeks to allow
Ald. Buckmaster, as the representative to the Plan Commission, to receive public input.
Salentine seconded. Mr. Muenkel will notify the same residents that received notice of
the previous public hearing. Motion carried with Borgman abstaining.
Mr. Muenkel was dismissed.

Reso. #175-2005 - Approval of Settlement and Release Agreement between the City of
Muskego and Laura Becker. On the floor, deferred 9/27/2005. Schroeder moved to
defer. Madden seconded; motion carried.
Ord. #1203 - An Ordinance to Amend the Zoning Map of the City of Muskego (Miller -
RS-2 to RS-3). Second Reading. Salentine moved for adoption. Borgman seconded.
Motion carried 7-0.
NEW BUSINESS
Reso. #184-2005 - Resolution to Set Public Hearing Date for 2006 Budget (11/7/2005
@ 7:00 PM). Salentine moved for adoption. Madden seconded. Motion carried 7-0.
Reso. #185-2005 - Approval of Agreement Between the City of Muskego and Humane
Animal Welfare Society (HAWS). Schroeder moved for adoption. Borgman seconded.
Motion carried 7-0.
Reso. #186-2005 - Resolution Approving a Three-Year Contract with Tyler
Technologies for Revaluation Services and Maintenance Services. Salentine moved for
adoption. Melcher seconded. Motion carried 7-0.
Reso. #187-2005 - Resolution to Retain Special Counsel. Buckmaster moved for
adoption. Madden seconded. Motion carried 7-0.
Reso. #188-2005 - Approval of Certified Survey Map - James and Linda Haut.
Salentine moved for adoption. Schroeder seconded. Motion carried 7-0.
Ord. #1204 - An Ordinance to Amend the Zoning Map of the City of Muskego (Brian
Schoenleber - RSE and R-2 to RS-2. First Reading.
Ord. #1205 - An Ordinance to Amend the Zoning Map of the City of Muskego (Bryon
Hrin - EA to RCE and A). First Reading.
LICENSES
Approval of Regular Operators
Melcher moved for approval of the following regular operators’ licenses. Schroeder
seconded. Motion carried 7-0.

VOUCHER APPROVAL
Melcher moved for approval of payment of General Vouchers in the amount of
$867,504.85. Borgman seconded. Motion carried 7-0. Schroeder moved for approval
of payment of Utility Vouchers in the amount of $110,379.38. Buckmaster seconded.

CITY OFFICIALS’ REPORTS
The Mayor acknowledged the presence of City Administrator Jennifer Sheiffer at the
Council table.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
Melcher stated that Mr. Cummings of Waukesha County praised the City and staff for
the amendment to the Tax Incremental District No. 8.
