CCM20050913 COMMON COUNCIL - CITY OF MUSKEGO Approved MINUTES OF MEETING HELD SEPTEMBER 13, 2005 The meeting was called to order at 8:32 PM by Mayor Damaske. Also present were Ald. Melcher, Borgman, Buckmaster, Madden, Patterson, Schroeder and Salentine, City Attorney Molter, Clerk-Treasurer Moyer and Deputy Clerk Blenski. Those present recited the Pledge of Allegiance. The Mayor stated the meeting was noticed in accordance with the open meeting law on 9/9/2005. APPROVAL OF MINUTES Salentine moved for approval of the 8/23/2005 minutes. Madden seconded; motion carried. Schroeder moved for approval of the 9/8/2005 minutes. Salentine seconded; motion carried. ACCEPTANCE AND REVIEW OF COMMITTEE REPORTS Salentine moved for acceptance of the 9/7/2005 and 9/13/2005 Finance Committee minutes. Melcher seconded; motion carried. Schroeder moved for acceptance of the 8/22/2005 and 9/13/2005 Public Utilities Committee minutes. Madden seconded; motion carried. Buckmaster moved for acceptance of the 8/22/2005 Public Works Committee minutes. Borgman seconded; motion carried. Minutes of the 7/29/2005 and 8/4/2005 Teen Advisory Board and 9/6/2005 Plan Commission were received and placed on file. OLD BUSINESS Ord. #1199 - An Ordinance to Amend the Zoning Map of the City of Muskego (Borchardt - RS-2, RSA and RSA/OIP to RS-2, RSA and RSA/OIP). On the floor, deferred 8/23/2005. Buckmaster moved to defer. Schroeder seconded; motion carried. Ord. #1200 - An Ordinance to Amend the Zoning Map and 2010 Comprehensive Plan of the City of Muskego (Edgewood Contractors - A to RSM). On the floor, deferred 8/23/2005. Schroeder moved to defer. Melcher seconded; motion carried. NEW BUSINESS Reso. #168-2005 - Final Resolution Authorizing Area Wide Water Capacity Assessment for Water Services Under Wisconsin Statute 66.0703 and Levying Water Capacity Special Assessments Against Benefited Property (WCA) (Fifteenth Amended WCA District). Schroeder moved for adoption. Madden seconded. Borgman asked why properties other than Lakewood Meadows and Kenwood Estates were included in the district. Schroeder responded that the district couldn’t be broken up; the area needs to be continuous. The Public Utilities Committee discussed this at the meeting that was just held and recommended removal of the Speich property depending on its location. It was determined that the property could not be removed because of its location, as removal would create an island within the district. Schroeder noted that being in the WCA district does not force residents to connect to service. Motion carried 7-0. Schroeder moved to defer. Melcher seconded. Motion carried 7-0. Reso. #170-2005 - Resolution to Establish Traffic Regulations - Parkland Drive. Salentine moved for adoption. Buckmaster seconded. Motion carried 7-0. Reso. #171-2005 - Approval of Joint Funding Agreement for Water Resources Investigations with the U.S. Department of the Interior, U.S. Geological Study. Melcher moved for adoption. Salentine seconded. Motion carried 7-0. Reso. #172-2005 - Award of Bid - ADA Accessibility to Old Town Hall. Salentine moved for adoption. Borgman seconded. Buckmaster asked why funds should be spent now when the building cannot be occupied. Mayor Damaske stated there was still work to be completed in order to obtain occupancy. Melcher stated the building must be handicap accessible according to the law. Buckmaster stated he did not know the status of the funds approved to date. Salentine stated the Parks & Recreation Department intends to use the building next month for its programs. In order to obtain occupancy, the ADA accessibility must be done. Buckmaster requested that a status report be provided to the Public Works Committee. Mayor Damaske will address for the future. Motion carried 6 in favor and Schroeder voting “no.” Reso. #173-2005 - Award of Bid - Idle Isle Park Shelter. Melcher moved for adoption. Salentine seconded. Melcher moved to defer to a special Council meeting to be held on 9/15/2005 at 6:45 PM to determine the participation of the Water Bugs. Salentine seconded; motion carried. Reso. #174-2005 - Approval of Final Plat, Subdivider’s Agreement and Letter of Credit for the Nursery Subdivision. Salentine moved for adoption. Borgman seconded. Motion carried 7-0. Buckmaster requested a copy of the subdivision covenants. Ord. #1201 - An Ordinance to Amend the Zoning Map of the City of Muskego (Loughney - A to RCE/COPD). First Reading. Ord. #1202 - An Ordinance to Amend Chapter 21 of the Municipal Code of the City of Muskego (Creation and Governance of Utility Districts). First Reading. Salentine moved to suspend the rules. Schroeder seconded. Motion carried 7-0. Second Reading. Salentine moved for adoption. Schroeder seconded. Schroeder noted that staff brought the proposal to Public Works Committee last year. The issue moved through the process. However, the majority of his constituents do not favor the creation of the utility districts and his vote will reflect that. Ordinance #1202 defeated with 6 voting “no” and Patterson casting a “yes” vote. LICENSES Approval of Regular Operators Melcher moved for approval of the following regular operators’ licenses. Salentine seconded; motion carried. Smith Francis Lufkin Melcher moved for approval of an Outside Dance Permit and amendment to licensed premise for Vera Pires d/b/a Spitfires Food & Spirits for 9/16/2005 and 9/17/2005. Salentine seconded; motion carried. Melcher moved for approval of a “Class B” Retailers’ License for the Sale of Fermented Malt Beverages and Intoxicating Liquor for Pioneer Enterprises, Inc. d/b/a Marx Pioneer Inn, Mark Sobczak, agent. Salentine seconded; motion carried. VOUCHER APPROVAL Melcher moved for approval of payment of General Vouchers in the amount of $695,298.58. Madden seconded. Motion carried 7-0. Schroeder moved for approval of payment of Utility Vouchers in the amount of $79,661.24. Buckmaster seconded. Motion carried 7-0. Salentine moved to convene into closed session pursuant to 19.85 (1)(c) Wis. Stats., Considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility, more specifically to consider proposal for the City Administrator candidate. Madden seconded. Motion carried 7-0. The Clerk, Deputy and City Attorney were dismissed. Salentine moved to reconvene into open session. Melcher seconded; motion carried.
