CCM20050712 COMMON COUNCIL - CITY OF MUSKEGO Approved MINUTES OF MEETING HELD JULY 12, 2005 The meeting was called to order at 7:57 PM by Mayor Damaske. Also present were Ald. Melcher, Borgman, Buckmaster, Madden, Patterson, Salentine, City Attorney Molter, and Deputy Clerk Blenski. Ald. Schroeder was excused. Those present recited the Pledge of Allegiance. The Mayor stated the meeting was noticed in accordance with the open meeting law. The Deputy Clerk read the Notice of Closed Session. Madden moved to convene into closed session pursuant to §19.85(1)(g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved; more specifically, pending legal claim of Telecommunicator. Borgman seconded. Motion carried 6-0. Police Chief Johnson and Atty. Swain were present for closed session. The Deputy Clerk and Atty. Molter were not present. The Council reconvened in open session. APPROVAL OF MINUTES Salentine moved for approval of the 6/28/2005 minutes. Buckmaster seconded. Motion carried. COMMUNICATIONS FROM THE MAYOR’S OFFICE Mayor Damaske gratefully acknowledged the donation received from King’s Wok in the amount of $1,000 for the Town Hall/Settlement Center project. ACCEPTANCE AND REVIEW OF COMMITTEE REPORTS Salentine moved for acceptance of the 7/6/2005 and 7/12/2005 Finance Committee minutes. Madden seconded; motion carried. Minutes of the 6/22/2005 Library Board were received and placed on file. NEW BUSINESS Ord. #1197 - An Ordinance to Amend the Zoning Map of the City of Muskego (Frey - A to B-4). First Reading. Ord. #1198 - An Ordinance to Amend the Zoning Map of the City of Muskego (Durham Drive - RS-2/OHS to RS-2). First Reading. OLD BUSINESS Ord. #1196 - An Ordinance to Amend the Zoning Map of the City of Muskego (Schill - A to B-2). Second Reading. Buckmaster moved for adoption. Salentine seconded. Salentine moved to amend to correct the name in the title to “Schill” and to add “Section 4: This ordinance is in full force and effect from and after passage and publication.” Madden seconded; motion carried. Buckmaster moved to defer to allow time for a Plan Commission recommendation. Salentine seconded. Motion carried 6-0. Common Council Minutes Page 2 July 12, 2005 NEW BUSINESS (Continued) Reso. #140-2005 - Approval of Agreement with CGI Communications. Salentine moved for adoption. Buckmaster seconded. Melcher had questions regarding liability insurance and if reimbursement is given if 25 banners are not sold. Mayor Damaske requested the project move forward; the City will deal with it if CGI doesn’t do the job. Patterson moved to include language that the placement of the banners will be determined by the Public Works Committee. Melcher seconded; motion carried. Melcher expressed concern that the City will not be dealing with local businesses for the project. The Mayor stated CGI would contract with local companies to maintain the banners. Melcher stated by adopting this resolution, the City is saying it recommends CGI Communications to other municipalities. Motion to adopt Reso. #140-2005, as amended, carried 4-3 with Melcher, Borgman and Patterson voting “no,” Madden, Salentine and Buckmaster voting “yes,” and the Mayor voting “yes” to break the tie. Reso. #141-2005 - Reapproval of Certified Survey Map - BC & J Development. Buckmaster moved for adoption. Salentine seconded. Motion carried 6-0. Reso. #142-2005 - Resolution to Retain Special Counsel to Represent the Assessor at the Board of Review. Salentine moved for adoption. Borgman seconded. Motion carried 6-0. Reso. #143-2005 - Acceptance of Right-of-Way Dedication (Krogmann’s First Addition Subdivision). Borgman moved for adoption. Buckmaster seconded. Motion carried 6- 0. Reso. #144-2005 - Resolution Authorizing the Chief of Police to Accept Sealed Bids for Six Police Vehicles. Salentine moved for adoption. Madden seconded. Motion carried 6-0. Reso. #145-2005 - Resolution of Support for Little Muskego Lake Protection and Rehabilitation District Grant Application. Salentine moved for adoption. Borgman seconded. Motion carried 6-0. Salentine seconded. Motion carried 6-0. VOUCHER APPROVAL Melcher moved for approval of payment of General Vouchers in the amount of $541,604.23. Salentine seconded. Motion carried 6-0. Melcher moved for approval of payment of Utility Vouchers in the amount of $402,595.18. Buckmaster seconded. Motion carried 6-0. Patterson moved to adjourn at 9:24 PM.
