CCM20050322 COMMON COUNCIL - CITY OF MUSKEGO Approved MINUTES OF MEETING HELD MARCH 22, 2005 The meeting was called to order at 8:30 PM by Mayor Slocomb. Also present were Ald. Salentine, Borgman, Buckmaster, Madden, Patterson and Schroeder, City Attorney Molter, Interim Plan Director Muenkel, Clerk-Treasurer Moyer and Deputy Clerk Blenski. Ald. Melcher was excused. Those present recited the Pledge of Allegiance. The Clerk stated the meeting was noticed in accordance with the open meeting law on 3/18/2005. The Clerk-Treasurer read the closed session notice regarding potential land acquisitions. The Mayor stated it the other closed session noted on the agenda was not needed. APPROVAL OF MINUTES Patterson moved for approval of the 3/08/2005 minutes. Madden seconded; motion carried. ACCEPTANCE AND REVIEW OF COMMITTEE REPORTS Salentine moved for acceptance of the 3/16/2005 and 3/22/2005 Finance Committee minutes. Madden seconded; motion carried. Salentine moved for acceptance of the 3/22/2005 Public Works Committee minutes. Buckmaster seconded; motion carried. Minutes of the 3/15/2005 Plan Commission, 2/23/2005 Library Board, 3/14/2005 Parks and Recreation Board and 2/24/2005 Teen Advisory Board were received and placed on file. OLD BUSINESS Ord. #1189 - An Ordinance to Amend Chapter 1, Section 1.05 (1)(a) of the Municipal Code of the City of Muskego (Board of Review). Second Reading. Buckmaster moved for adoption. Salentine seconded. Buckmaster stated citizens might be more comfortable if there are no municipal employees or public officials on the Board. He does not know what the intent of the original language was. What difference does it make if a member is a City of Muskego public official or employee or is a public official or employee from another municipality? Mayor Slocomb believes it is a stretch that employment by another municipality would bias an individual serving on the Board. Schroeder stated he would like no public official to serve. He does not see a problem with employees of another municipality serving as members of the Board of Review. Schroeder moved to amend to strike the words “within the City government of the City of Muskego.” Buckmaster seconded; motion carried. Ord. #1189, as amended, adopted 6-0. Ord. #1190 - An Ordinance to Amend the Zoning Map and the 2010 Comprehensive Plan of the City of Muskego (A to RS-2/OPD - Towne Realty/Woodland Creek Addition 1). Second Reading. Buckmaster moved for adoption. Madden seconded. Buckmaster moved to defer; Plan Commission has not made a recommendation yet. Salentine seconded; motion carried. Schroeder expressed concern about potential traffic issues. There was concern with the first phase of the development to the east (Woodland Creek) regarding only one access onto Racine Avenue. Now, the development to the west will create additional traffic. Issues need to be addressed before the development is completed. The Mayor stated traffic issues are reviewed by the Public Works Committee. Buckmaster stated by the time the issue goes to the Public Works Committee, the Plan Commission has given direction to the developer. Mayor Slocomb stated typically before plans are reviewed by the Plan Commission and Public Works Committee, discussion has taken place with City engineering staff regarding potential issues that will need to be addressed. Mr. Muenkel offered the details of a typical development timeline. Schroeder requested how many parcels would be allowed in the Woodland Creek and Woodland Creek Addition 1 developments if the property was zoned RS-1 prior to the next meeting. NEW BUSINESS Reso. #057-2005 - Approval of Certified Survey Map - BC & J Development. Buckmaster moved for adoption. Borgman seconded. Motion carried 6-0. Reso. #058-2005 - Approval of Continuation of Police Liaison Officer Program. Salentine moved for adoption. Madden seconded. Schroeder stated the program is very important and he supports it. He does not know if three officers are needed. Possibly two could be used with one officer at the high school and the two middle schools sharing another. If two officers were adequate for the program, the Police Dept. would have another available officer. Schroeder requested Chief Johnson provide his proposed 2006 budget request for officers. He also would like the School Board’s viewpoint on whether or not two officers would be sufficient to serve the three schools. Buckmaster requested that the Chief provide his best estimate regarding staffing needs for the next two to three years. Schroeder moved to defer. Buckmaster seconded; motion carried. Reso. #059-2005 - Approval of Certified Survey Map, Subdivider’s Agreement and Letter of Credit for Thomas Fitzpatrick. Buckmaster moved for adoption. Schroeder seconded. Motion carried 6-0. Reso. #060-2005 - Approval of Professional Services Agreement between the City of Muskego and Bonestroo Rosene Anderlik and Associates, Inc. Salentine moved for adoption. Madden seconded. Mayor Slocomb stated that the City was interviewing the firm to perform engineering services. Motion carried 6-0. Reso. #061-2005 - Approval of Irrevocable Standby Letter of Credit for Onyx Waste Services Midwest, Inc. Schroeder moved for adoption. Salentine seconded. The Mayor stated that Onyx asked if a Letter of Credit could be submitted as surety in lieu of a Performance Bond. The City has agreed and the Letter of Credit has to be approved. Motion carried 6-0. Reso. #062-2005 - Approval of Amendment to General Contract for Refuse Pickup and Transportation with Onyx Waste Services Midwest, Inc. Salentine moved for adoption. Schroeder seconded. With adoption of this resolution, the existing contract will be amended to allow submittal of a Letter of Credit referred to under the previous resolution. Motion carried 6-0. Ord. #1191 - An Ordinance to Amend the Zoning Map of the City of Muskego to Include the OWP Wellhead Protection Overlay District (Champions Village Subdivision). First Reading. Buckmaster requested a copy of the presentation done by Mr. Schultz at the public hearing. LICENSES Salentine moved for approval of an Operator’s License for Michael Hoffman, Wendy Lanigan, Dawn Vretenar, Jane Mundro, Julie Woloszyn and Colleen Lesser. Schroeder seconded; motion carried. Salentine moved for approval of a Temporary Class “B” Beer License for Bethlehem Lutheran Church for 4/16/2005 and a Temporary “Class B” Wine/Beer License for Friends of the Library for 5/7/2005. Schroeder seconded; motion carried 6-0. VOUCHER APPROVAL Salentine moved for approval of payment of General Vouchers in the amount of $554,559.87. Schroeder seconded. Motion carried 6-0. Schroeder moved for approval of payment of Utility Vouchers in the amount of $2,309,021.28. Buckmaster seconded. Motion carried 6-0. Salentine moved for approval of Tax Checks in the amount $3,031.59. Schroeder seconded. Motion carried 6-0. CITY OFFICIALS’ REPORTS The April calendar was reviewed. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Buckmaster thanked Plan Secretary Asti for the meticulous Plan Commission minutes for the meeting that he could not attend. Buckmaster moved to convene into closed session at 9:34 PM. Madden seconded. Motion carried 6-0. The City Attorney, Clerk-Treasurer and Deputy were dismissed. Buckmaster moved to reconvene into open session at 10:37 PM. Patterson seconded; motion carried. Salentine moved to adjourn at 10:38 PM. Madden seconded; motion carried.
