COMMON COUNCIL - CITY OF MUSKEGO Approved
MINUTES OF MEETING HELD FEBRUARY 8, 2005
The meeting was called to order at 7:32 PM by Mayor Slocomb. Also present were Ald.
Salentine, Borgman, Buckmaster, Madden, Melcher, Patterson and Schroeder, City
Attorney Molter, Clerk-Treasurer Moyer and Deputy Clerk Blenski. Those present
recited the Pledge of Allegiance. The Clerk stated the meeting was noticed in
accordance with the open meeting law on 2/4/2005 and as amended on 2/7/2005. The
Clerk read the notice of closed session.
APPROVAL OF MINUTES
Buckmaster moved for approval of the 1/25/2005 minutes. Patterson seconded; motion
carried.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Mayor Slocomb noted that the Polar Plunge was scheduled to take place this Sunday,
2/13 at the Aud Mar. It is a great charity event.
ACCEPTANCE AND REVIEW OF COMMITTEE REPORTS
Salentine moved for acceptance of the 2/3/2005 and 2/8/2005 Finance Committee
minutes. Madden seconded; motion carried. In response to a question by Buckmaster,
Mayor Slocomb stated the response from Virchow Krause has not been received to
date. It will provide the detail requested.
Minutes of the 2/1/2005 Plan Commission, 1/26/2005 Library Board, 1/20/2005 Police
and Fire Commission and 1/27/2005 Community Development Authority were received
and placed on file.
OLD BUSINESS
Reso. #208-2004 - Resolution to Amend the Business Credit Card Policy. On the floor,
deferred 1/25/2005. Schroeder moved to defer. Patterson seconded; motion carried.
Reso. #026-2005 - Amendment to Personnel Code for Management and Other
Nonrepresented Employees of the City of Muskego (Clothing Allowance). On the floor,
deferred 1/25/2005. The Mayor stated that whenever there is a clothing/shoe
reimbursement, the employee is expected to wear the items to work. Patterson asked if
there would be some uniformity to the clothing chosen. Mayor Slocomb stated there
would be an agreement with the employees to achieve consistency. That will be done
under the direction of the department heads that are involved. Salentine moved to
amend the language in the title, “Clothing Allowance” to read “Clothing and Shoe
Reimbursement” and to remove the words “Maintenance and Parks personnel” at the
end of the Now, Therefore, Be it Resolved paragraph and to add “the full time
maintenance employee and up to a $150 annually for the part time maintenance
employee effective January 1, 2005. A work clothing and shoe reimbursement of up to
$300 annually will be included for the four full time Park employees effective January 1,
2006.” Schroeder seconded; motion carried. Reso. #026-2005, as amended, carried 7-
0.
Ord. #1187 An Ordinance to Amend the Zoning Map of the City of Muskego (Kastello -
RS-2 to RS-3). Second Reading. Buckmaster moved for adoption. Madden seconded.
Borgman stated he did contact the constituent that spoke at the public hearing and the
individual stated he prefers the zoning remain unchanged. Motion carried 7-0.
Ord. #1188 An Ordinance to Amend the Zoning Map of the City of Muskego (Boxhorn
Reserve Subdivision - R-2, R-3 and RS-3 to RSE/COPD). Second Reading.
Buckmaster moved for adoption. Salentine seconded. Schroeder asked about the
conservation land that the City would acquire with this development. Why does the City
want to maintain. Why will the Homeowners’ Assn not maintain it? Mayor Slocomb
explained that this land is being dedicated to the City and will be available for public
use. Ultimately, a discussion will take place to determine if the land can go under the
DNR Stewardship program. Schroeder asked if the City was moving in the direction to
acquire the land from every conservation subdivision? The Mayor said no. This is the
first such instance. Schroeder said he would rather see the DNR own these
undevelopable wetlands and maintain them in the future. Atty. Molter clarified that the
dedication of the land is done through the final plat as well as the Subdivider’s
Agreement. Schroeder requested discussion regarding conservation subdivisions
continue at the Committee of the Whole level. Buckmaster stated that the Plan
Commission recommended that no wetlands be on private property. Motion carried 6 in
favor and Schroeder voting “no.”
NEW BUSINESS
Reso. #032-2005 - Recognition of 35 Years of Service - John R. Johnson - Muskego
Police Department. Salentine moved for adoption. Buckmaster seconded. Motion
carried 7-0. The resolution was presented to Chief Johnson who gratefully accepted it.
The Chief thanked the community, including elected officials and employees, for the
support he has received throughout his career.
Reso. #033-2005 - Resolution to Amend the By-Laws and Rules of Procedure -
Community Development Authority of the City of Muskego, Wisconsin. Schroeder
moved for adoption. Buckmaster seconded. Motion carried 7-0.
Reso. #034-2005 - Resolution Acknowledging the Future City Team from St. Leonard
School. Patterson moved for adoption. Madden seconded. Motion carried 7-0. The
student presenters for the team accepted the resolution and briefly explained the
project. The Council applauded the efforts of the Future City Team and wished them
continued success when they participate in the national competition to be held in
Washington, D.C.
Reso. #035-2005 - Approval of Certified Survey Map - Sommer Investments LLC, Town
of Waterford. Buckmaster moved for adoption. Salentine seconded. Motion carried 7-
0.
Reso. #036-2005 - Approval of Preliminary Plat - Valley View Estates Subdivision.
Buckmaster moved for adoption. Salentine seconded. Borgman stated there are
serious concerns by the people that would be affected if the road goes through. The
Mayor stated the Public Works Committee would review the issue. Motion carried 7-0.
Reso. #037-2005 - Approval of Lease Agreement with the Little Muskego Lake District
(Park Arthur). Salentine moved for adoption. Borgman seconded. Motion carried 7-0.
Reso. #038-2005 - Resolution to Approve Travel Policy for the City of Muskego.
Schroeder moved for adoption. Salentine seconded. Schroeder move to defer.
Madden seconded; motion carried.
Reso. #039-2005 - Resolution to Retain Special Counsel (Police & Fire Commission).
Salentine moved for adoption. Madden seconded. Motion carried 7-0.
LICENSES
Salentine moved for approval of an Operator’s License for Brian Chic, Kevin Sheridan,
Kelly Mettille, and Cathy Winkler, and a license for Rebecca Saur and Anthony
Bushberger subject to a 3, 6, 9 and 12-month review. Schroeder seconded; motion
carried.
VOUCHER APPROVAL
Salentine moved for approval of payment of General Vouchers in the amount of
$761,873.44. Schroeder seconded. Motion carried 7-0. Schroeder moved for approval
of payment of Utility Vouchers in the amount of $23,505.11. Madden seconded. Motion
carried 7-0. Salentine moved for approval of Tax Checks in the amount $4,354,107.49.
Schroeder seconded. Motion carried 7-0.
Buckmaster moved to convene into closed session pursuant to 19.85(1)(c) Wis. Stats.,
Considering employment, promotion, compensation or performance evaluation data of
any public employee over which the governmental body has jurisdiction or exercises
responsibility, more specifically the 2004 - 2005 Labor Agreements for all bargaining
units. Salentine seconded. Motion carried 7-0. The Clerk, Deputy and City Atty. were
dismissed.
Salentine moved to reconvene into open session. Madden seconded; motion carried.
Buckmaster moved to adjourn at 8:55 PM. Madden seconded; motion carried.
