COMMON COUNCIL - CITY OF MUSKEGO Approved as Corrected
MINUTES OF MEETING HELD NOVEMBER 23, 2004 12/14/2004
The meeting was called to order at 7:55 by Council President Salentine. Also present
were Ald. Borgman, Madden, Patterson and Schroeder, City Attorney Molter, Clerk-
Treasurer Moyer, Engineering/Building Inspection Director McMullen, Finance Director
Gunderson, and Deputy Clerk Blenski. Ald. Buckmaster and Melcher were absent
excused. Those present recited the Pledge of Allegiance. The Clerk stated the
meeting was noticed in accordance with the open meeting law on 11/19/2004. As
Mayor Slocomb was not present, Ald. Salentine stated she would chair the meeting as
Acting Mayor. She noted that she would retain her right to vote. The Clerk read the
notice of closed session.
APPROVAL OF MINUTES
Patterson moved for approval of the 11/9/2004 minutes. Borgman seconded; motion
carried.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Salentine wished everyone a safe and happy Thanksgiving on behalf of the City.
ACCEPTANCE AND REVIEW OF COMMITTEE REPORTS
Madden moved for acceptance of the 11/17/2004 and 11/23/2004 Finance Committee
minutes. Schroeder seconded; motion carried.
Borgman moved for acceptance of the 11/15/2004 Public Works Committee minutes.
Madden seconded; motion carried.
Schroeder moved for acceptance of the 11/15/2004 and 11/23/2004 Public Utilities
Committee minutes. Patterson seconded; motion carried.
Minutes of the 11/16/2004 Plan Commission, 10/28/2004 Police and Fire Commission,
10/21/2004 Teen Advisory Board and 11/18/2004 Community Development Authority
were received and placed on file.
NEW BUSINESS
Mr. Phil Cosson of Ehlers was also present for the following:
Reso. #193-2004 - Approval of 2005 Water Utility Budget and Rates. Patterson moved
for adoption. Madden seconded. Finance Director Gunderson stated the rates listed
are those established by the PSC in March of 2003. Motion carried 5-0.
Reso. #194-2004 - Approval of 2005 Sewer Utility Budget and Rates. Patterson moved
for adoption. Borgman seconded. Finance Director Gunderson stated that the rates for
2005 reflect a 33% increase. The rate for a single-family home will increase from $416
per year to $554.88. The increase is a result of an increase of over 100% in the City’s
capital charges to MMSD. Ms. Gunderson recommends the increase to cover the
MMSD capital and for debt coverage, which affects the Utility’s bond rating. In 1999,
the Utility received a rating of A-1 from Moody’s. With the increase in expenditures, the
Utility will experience a reduction in its debt coverage. Mr. Cosson distributed a Sewer
Utility Proforma. The goal is to bring the debt coverage back to what it was in 1999. In

addition to the rate increase, it is proposed that the Utility’s existing debt be
restructured. Salentine thanked Mr. Cosson for being present. Patterson asked if the
rates should be increased more than 33%. Mr. Cosson responded raising additional
revenue would certainly be beneficial to the Utility. However, he and Finance Director
Gunderson believe that the combination of the 33% rate increase along with
restructuring the existing debt will get the Utility back to where it was in 1999. Motion
carried 5-0.
Finance Director Gunderson and Mr. Cosson were dismissed.
Borgman moved to convene into closed session pursuant to 19.85(1)(e) Deliberating or
negotiating the purchase of public properties, the investing of public funds, or
conducting other specified public business, whenever competitive or bargaining reasons
require a closed session; more specifically negotiations regarding the Intermunicipal
Agreement with the City of New Berlin for the Tess Corners Creek North Drainage
Basin. Patterson seconded; motion carried. The Clerk and Deputy were not present for
closed session.
The Clerk and Deputy returned to the meeting. Borgman moved to reconvene into open
session. Patterson seconded; motion carried.
OLD BUSINESS
Reso. #189-2004 - Approval of Intermunicipal Agreement Between the City of Muskego
and the City of New Berlin for the Construction of the Tess Corners Creek North
Drainage Basin. On the floor, deferred 11/9/2004. Borgman moved to defer. Patterson
seconded; motion carried.
Reso. #190-2004 - Approval of Lease Agreement with Waukesha County for the Tess
Corners Municipal Parking Lot. On the floor, deferred 11/9/2004. Madden moved to
defer. Borgman seconded; motion carried.
NEW BUSINESS (Continued)
Reso. #195-2004 - Resolution Authorizing Special Quarterly Charges for Garbage and
Refuse Disposal and Recycling Service. Madden moved for adoption. Borgman
seconded. Motion carried 5-0.
Reso. #196-2004 - Authorize Execution of Dental Insurance Contracts for 2005.
Schroeder moved for adoption. Borgman seconded. Motion carried 5-0.
Reso. #197-2004 - Approval of Fire Protection Agreement with Tess Corners Volunteer
Fire Department for 2005. Schroeder moved for adoption. Patterson seconded.
Motion carried 5-0.
Reso. #198-2004 - Approval of Fire Protection Agreement with Muskego Volunteer Fire
Company for 2005. Schroeder moved for adoption. Borgman seconded. Motion
carried 5-0.

Reso. #200-2004 - Approve New Positions and Position Changes. Madden moved for

Reso. #201-2004 - Approval of Revocable Occupancy Permit - Sowinski - Lake Access
#13. Borgman moved for adoption. Schroeder seconded. Motion carried 5-0.
Reso. #202-2004 - Approval of Certified Survey Map, Developer’s Agreement and
Letter of Credit Amount - Pellmann. Borgman moved for adoption. Madden seconded.
Motion carried 5-0.
Ord. #1185 - An Ordinance to Amend the Zoning Map of the City of Muskego (Dumke -
B-4 to R-3). First Reading.
LICENSES
Madden moved for approval of a regular Operator’s license for Tami Somers subject to
a 3, 6, 9 and 12-month review. Schroeder seconded; motion carried.
Madden moved for approval of a regular Operator’s license for Angela Brown.
Schroeder seconded; motion carried.
VOUCHER APPROVAL
Madden moved for approval of payment of General Vouchers in the amount of
$1,253,193.89. Schroeder seconded. Motion carried 5-0. Schroeder moved for
approval of payment of Utility Vouchers in the amount of $113,871.41. Madden
seconded. Motion carried 5-0.
CITY OFFICIALS’ REPORT
The December calendar was reviewed. The Clerk announced that a public hearing was
scheduled for 12/14/2004 at 7:25 PM to consider amendments to Chapters 1, 2, 17, 18
and 41 of the City of Muskego Municipal Code.
