MINUTES OF MEETING HELD SEPTEMBER 28, 2004
Mayor Slocomb called the meeting to order at 7:31 pm. Also present were Ald. Borgman,
Buckmaster, Melcher, Patterson, Schroeder, Madden, and City Attorney Molter and Clerk-
Treasurer Moyer. Ald. Salentine was absent and excused. The Clerk-Treasurer stated the
meeting was noticed in accordance with the open meeting law on 9/24/2004.
APPROVAL OF MINUTES
Ald. Borgman moved for approval of the 9/14/2004 minutes. Ald. Melcher seconded. Motion
carried.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Kelly DeGrave was present to received a Certificate of Appreciation for her 3 years
as Adult-at-Large to the Teen Advisory Board.
ACCEPTANCE AND REVIEW OF COMMITTEE REPORTS
Ald. Schroeder moved for acceptance of the 9/22/2004 and 9/28/2004 Finance Committee
minutes. Ald. Madden seconded. Motion carried.
Ald. Buckmaster moved for acceptance of the 9/20/2004 Public Works Committee minutes. Ald.
Borgman seconded. Ald Buckmaster noted that at Committee of the Whole on September 23,
colored fixtures were approved. He was concerned that the motion in the Public Works minutes
approving non-colored fixtures, if approved as a part of the minutes, would be in conflict with the
Committee of the Whole recommendation. Ald. Buckmaster asked for individual consideration
of the motion made at the Public Works Committee Meeting regarding the colored light fixtures.
Ald. Borgman seconded the motion for individual consideration. Motion carried 5-1, with Ald.
Patterson voting no. Ald. Schroeder asked that the minutes note that Committee of the Whole
agreed to the colored traffic signals at Janesville and Tess Corners based on information
provided by the City Engineer, Sean McMullen. Ald. Patterson asked if the donated funds for
the colored lights should be used for other pressing needs. Ald. Buckmaster felt the donator
wanted the funds used for the decorative streetlights to compliment the existing lighting in the
Tess Corners area. A vote was taken on the original motion to accept the Public Works minutes
with the item for painting of the traffic light poles removed and acted on individually, motion
carried.
Minutes of the 9/21/2004 Plan Commission, 9/13/2004 Parks & Recreation Board were received
and placed on file.
NEW BUSINESS
Reso. #147-2004 - Resolution Honoring City of Muskego Eagle Scout Daniel Luglio. Ald.
Schroeder moved for approval. Ald. Melcher seconded. Motion carried 6-0. The Mayor
presented Daniel with a signed copy of Resolution No. #147-2004.
Reso. #148-2004 – Final Resolution Authorizing Area Wide Water Capacity Assessment for
Water Services Under Wisconsin Statute 66.0703 and Levying Water Capacity Special
Assessments Against Benefited Property (WCA) (Sixteenth Amended WCA District). Ald.
Buckmaster moved for adoption. Ald. Madden seconded. Motion carried 6-0.
Reso. #149-2004 – Approval of Final Plat, Subdivider’s Agreement and Letter of Credit for Big
Muskego Estates II. Ald. Buckmaster moved for adoption. Ald. Madden seconded. Motion
carried 6-0.

Reso. #150-2004 – Approval of Final Plat – Baumgart Gardens Estates – Town of Waterford.
Ald. Buckmaster moved for adoption. Ald. Madden seconded. Motion carried 6-0.
Reso. #151-2004 – Approval of Condominium Plat – Fountain Park (f/k/a Building 10 of
Overlook Bay Apartments). Ald. Buckmaster moved for adoption. Ald. Madden seconded.
Motion carried 6-0.
Reso. #152-2004 – Authorize Execution of the Labor Agreement Between the Muskego Police
Association and the City of Muskego January 1, 2004 – December 31, 2005. Ald. Schroeder
moved for adoption. Ald. Buckmaster seconded. Ald. Buckmaster moved to amend the motion
to add at the end of the Resolution, “subject to acceptance by the Muskego Police Association
of the above open enrollment change mandated by WPS.” Ald. Madden seconded, motion
carried to amend the motion. Ald. Buckmaster noted that Article 5 – Wages, should state “The
additional .5% increase of 1-1-05 is in settlement of the holiday pay issue for all regular 5/2
scheduled police department sworn personnel.” Ald. Schroeder moved to amend Article 5 –
Wages, to add the words “police department sworn” after the word scheduled. Seconded by Ald.
Buckmaster Motion carried. Vote on Resolution #152-2004, as twice amended. Motion carried
6-0. The Police Union will be voting on the two amendments.
Reso. #153-2004 – Approval of 2004 Salary Increase for Non-represented Employees of the
City of Muskego. Ald. Madden moved for adoption with the language filled in as follows: under
the first Whereas, the salary schedule increase of two percent effective January 1, 2004, and
one percent July 1, 2004, and the same language included under the Now, Therefore, Be It
Resolved at the end of the resolution. Seconded by Ald. Borgman. Discussion followed
concerning the approval of the non-represented salary increases before the union contracts
have been approved. It was noted that salary increases for non-represented employees were
not approved for January 1, 2004. But, the City did start charging the employees for a larger
share of health insurance premiums on January 1, 2004. The union contracts have not been
settled and that has delayed the approval of non-represented employee salaries. Ald.
Schroeder suggested the Mayor discuss this matter with department heads and then look at
setting a policy. A vote was taken on Resolution #153-2004, motion carried 5-1, with Ald.
Patterson voting no.
Ordinance #1180 – An Ordinance to Amend Chapter 35, Section 35.05 (7), of the Municipal
Code of the City of Muskego (Property Maintenance Code – Property Maintenance Standards)
First Reading
LICENSES
Ald. Schroeder moved for approval of Operator’s Licenses for Lisa Garner, Rita Sullivan,
Sandra Rakowski, Michael Rahm and Nicole Wilbur. Ald. Buckmaster seconded. Motion
carried.
Ald. Schroeder moved for approval of a Temporary “Class B” Liquor License for St. Leonard
Congregation -- 11/13/2004. Ald. Buckmaster seconded. Motion carried.
VOUCHER APPROVAL
Ald. Schroeder moved for approval of payment of General Vouchers in the amount of
$652,453.30. Ald. Madden seconded. Motion carried 6-0.
Ald. Schroeder moved for approval of payment of Utility Vouchers in the amount of
$101,211.38. Ald. Patterson seconded. Motion carried 6-0.

COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
Review of October Calendar. Public Works Committee moved to October 18 at 5:00 p.m. and
Public Utilities Committee moved to October 18 at 6:30 p.m.
Ald. Buckmaster moved to cancel the December 28, 2004 Common Council Meeting due to its
close proximity to Christmas Day/New Year’s Day. Ald. Madden seconded. Motion carried 6-0.
