CCM20040824 COMMON COUNCIL - CITY OF MUSKEGO Approved MINUTES OF MEETING HELD AUGUST 24, 2004 Mayor Slocomb called the meeting to order at 8:08 pm. Also present were Ald. Salentine, Borgman, Buckmaster, Madden, Melcher, Patterson and Schroeder, City Attorney Molter, Clerk-Treasurer Moyer and Deputy Clerk Blenski. Those in attendance recited the Pledge of Allegiance. The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting law on 8/20/2004. The Clerk- Treasurer read the closed session notice. APPROVAL OF MINUTES Salentine moved for approval of the 8/10/2004 minutes. Madden seconded; motion carried. COMMUNICATIONS FROM THE MAYOR’S OFFICE Mayor Slocomb noted that the Community Festival would be held this weekend. He also expressed sympathy to the family of Jerome Gottfried, former Mayor, who recently passed away. Mr. Gottfried was instrumental in Muskego’s incorporation as a City in 1964. ACCEPTANCE AND REVIEW OF COMMITTEE REPORTS Salentine moved for acceptance of the 8/18/2004 and 8/24/2004 Finance Committee minutes. Madden seconded; motion carried. Buckmaster moved for acceptance of the 8/16/2004 Public Works Committee minutes. Borgman seconded; motion carried. Minutes of the 8/17/2004 Plan Commission and 8/9/2004 Parks and Recreation Board were received and placed on file. NEW BUSINESS Reso. #134-2004 - Recognition of 25 Years of Service - Scott Kloskowski - Sewer and Water Utilities. Salentine moved for adoption. Patterson seconded. Motion carried 7-0. Mayor Slocomb presented the resolution to Scott. UNFINISHED BUSINESS Reso. #129-2003 - Resolution to Terminate Conditional Use Grant Illuminated Outdoor Recreation Facility Muskego Moose Lodge Property. On the floor, deferred 11/25/2003. Mayor Slocomb stated the issue was deferred to allow time for the Moose Lodge to come forward with plans for a new development. The organization is proceeding in that direction and the Mayor believes the conditional use should not be terminated at this time. Motion to adopt defeated 7-0. Reso. #127-2004 - Authorizing Street Name Change (Durham Drive). On the floor, deferred 8/10/2004. Schroeder moved to amend to identify that Section A (on the map attached to the resolution) would be renamed Durham Place and that Section B would be renamed Durham Court. Buckmaster seconded; motion carried. Reso. #127-2004, as amended, adopted 7-0. Common Council Minutes Page 2 August 24, 2004 Reso. #128-2004 - Resolution to Establish Traffic Regulations. On the floor, deferred 7/27/2004. Buckmaster moved to amend to add “Durham Place” to the resolution in conjunction with the action taken under Reso. #127-2004. Salentine seconded; motion carried. Reso. #128-2004, as amended adopted 7-0. Ord. #1178 - An Ordinance to Amend Chapter 37, Section 37.08(1), of the Municipal Code of the City of Muskego (Maintenance of Trees on Private Property). Second Reading. Salentine moved for adoption. Borgman seconded. Motion carried 7-0. NEW BUSINESS (Continued) Reso. #135-2004 - Disallowance of Claim - Schulz. Salentine moved for adoption. Madden seconded. Motion carried 7-0. Reso. #136-2004 - Resolution of Eligibility for Exemption from the County Library Tax Levy for 2005. Schroeder moved for adoption. Borgman seconded. Motion carried 7- 0. Reso. #137-2004 - Resolution to Establish Traffic Regulations (Richdorf Drive). Salentine moved for adoption. Buckmaster seconded. Salentine moved to amend “No Trailer Parking” sign to read “No Parking with Trailer.” Buckmaster seconded; motion carried. Melcher presented request from constituents to establish the no parking regulation on the east side of Richdorf Drive as well as the west side and moved to amend the resolution accordingly. Buckmaster seconded; motion carried. Reso. #137- 2004, as twice amended, adopted 7-0. Reso. #138-2004 - Award of Bid - Idle Isle Bridge Replacement Project. Schroeder moved for adoption. Borgman seconded. Mayor Slocomb stated the project would work around the lowering of Little Muskego Lake. It was noted the drawdown would probably be delayed because of the bridge project. Motion carried 7-0. Reso. #139-2004 - Adoption of 2020 MMSD Facility Plan Boundary Amendment. Madden moved for adoption. Salentine seconded. Schroeder wanted it understood that by amending the plan boundary and expanding the district, the City would be charged by MMSD for all areas in the service area, whether properties are served by sewer or not. The charge is determined by the equalized value of the properties in the district. This will probably not occur until 2007 or 2008. Motion carried 6 in favor and Melcher voting “no.” Reso. #140-2004 - Authorize Expenditure for Janesville Road Culvert. Salentine moved for adoption. Madden seconded. Salentine moved to amend the resolution to remove “____ feet” in the second WHEREAS, to change the amount of $51,037.00 to $60,746.04, to add “or letter” after the word “permit” in the second BE IT FURTHER RESOLVED and to add “BE IT FURTHER RESOLVED That the project is subject to agreement of the property owners.” Madden seconded; motion carried. Schroeder moved to defer to finalize questions as stated at the Finance Committee meeting. Melcher seconded. Motion to defer carried 5 in favor and Madden and Salentine voting “no.” Common Council Minutes Page 3 August 24, 2004 Ord. #1179 - An Ordinance to Amend the Zoning Map of the City of Muskego (Inpro Corporation - I-1 to I-1/OPD). First Reading. LICENSES Salentine moved for approval of an Operator’s license for Kristin Lau, Victoria Scheidt, Scott Meddaugh, Sharon Schoenleber, Christine Brown, Michael Rytkonen (Temporary), Scott Lago (Temporary), Sherry Hoyt (Temporary), Jennifer Cortes (subject to 3-mo. review) and Kerry Shepherd (subject to 3, 6, 9 and 12-mo. review). Schroeder seconded, motion carried. Salentine moved for approval of a Temporary Class “B” Retailer’s License for Muskego Volunteer Fire Co. Ladies Auxiliary for 9/18/2004. Schroeder seconded; motion carried. Salentine moved for approval of an amendment to the premise and an outside dance permit for Vera Pires (Spitfires Food & Spirits) as follows: 9/17/2004 and 9/18/2004 - music until 11:30 and the outside parking lots licensed until midnight, 9/19/2004 - music until 10:00 and the outside parking lots until 11:00 PM. Schroeder seconded; motion carried. VOUCHER APPROVAL Salentine moved for approval of payment of General Vouchers in the amount of $475,859.08. Schroeder seconded. Motion carried 7-0. Schroeder moved for approval of payment of Utility Vouchers in the amount of $900,665.30. Buckmaster seconded. Motion carried 7-0. CITY OFFICIALS’ REPORT The September calendar was reviewed. Borgman moved to convene into closed session pursuant to 19.85(1)(c) Wis. Stats., Considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility, more specifically the 2004 - 2005 Labor Agreements for all bargaining units. Buckmaster seconded. Motion carried 7-0. The Clerk, Deputy and City Attorney were dismissed at 8:56 pm. Salentine moved to reconvene into open session at 9:22 pm. Madden seconded. Motion carried 7-0.
