COMMON COUNCIL - CITY OF MUSKEGO Approved
MINUTES OF MEETING HELD JUNE 22, 2004
Mayor Slocomb called the meeting to order at 8:14 PM. Also present were Ald.
Salentine, Borgman, Buckmaster, Madden, Melcher, Patterson, and Schroeder, City
Attorney Molter, Clerk-Treasurer Moyer and Deputy Clerk Blenski. Those present
recited the Pledge of Allegiance. The Mayor stated the meeting was noticed in
accordance with the open meeting law. The Mayor noted that the Council would not
convene into closed session regarding labor agreements.
APPROVAL OF MINUTES
Salentine moved for approval of the 6/8/2004 minutes. Borgman seconded; motion
carried.
ACCEPTANCE AND REVIEW OF COMMITTEE REPORTS
Salentine moved for acceptance of the 6/22/2004 Finance Committee minutes.
Schroeder seconded; motion carried.
Minutes of the 6/15/2004 Plan Commission were received. Buckmaster gave an update
on Bushy’s. The Plan Commission will conduct an annual review regarding traffic
impacts. Schroeder asked if there was some means for the Police Department to follow
this during the year. Tracking back is difficult. The Mayor was requested to touch base
with Chief Johnson to determine if there was an easy way for the Department to
accomplish.
Minutes of 5/26/2004 Library Board, 5/20/2004 Teen Advisory Board and 6/14/2004
Parks and Recreation Board were received and placed on file.
UNFINISHED BUSINESS
Ord. #1172 - An Ordinance to Amend the Zoning Map of the City of Muskego
(Sonnentag - EA to A). Second Reading. Madden moved for adoption. Salentine
seconded. Motion carried 7-0.
NEW BUSINESS
Reso. #108-2004 - Disallowance of Claim - Robert J. Vlaardingerbroek and Laura
Blaardingerbroek-Woodliff. Schroeder moved for adoption. Madden seconded. Motion
carried 7-0.
Reso. #109-2004 - Approval of Various License Applications for the City of Muskego.
Salentine moved for adoption. Schroeder seconded. Motion carried 7-0.
Reso. #110-2004 - Approval of Certified Survey Map - Hennessey. Buckmaster moved
for adoption. Salentine seconded. Motion carried 7-0.
Reso. #111-2004 - Approval of Certified Survey Map - Krawczyk. Buckmaster moved
for adoption. Borgman seconded. Motion carried 7-0.
Reso. #112-2004 - Approval of a Final Plat - Golden Meadows at Lake Tichigan
Addition No. 3, Town of Waterford. Buckmaster moved for adoption. Salentine
seconded. Motion carried 7-0.

Reso. #113-2004 - Resolution to Establish Fees (Planning and Zoning). Salentine
moved for adoption. Madden seconded. Motion carried 7-0.
Reso. #114-2004- Resolution to Authorize Naming the Public Land Located Along
Moorland Road South (Moorland Park). Salentine moved for adoption. Melcher
seconded. Motion carried 7-0.
Reso. #115-2004 - Approval of General Facility Agreement Between the City of
Muskego and the Muskego-Norway School District. Salentine moved for adoption.
Madden seconded. Motion carried 7-0.
Reso. #116-2004 - Designating Halloween Trick or Treat Hours. Patterson moved for
adoption. Borgman seconded. The Mayor asked if the Council would consider
amending the resolution so the hours would always be October 31 from 6:00 PM to 8:00
PM. The Council would not have to review in the future unless there was an exception.
Salentine moved to amend to delete the “Sunday” and “2004.” Schroeder seconded;
motion carried. Reso. #116-2004, as amended, adopted 7-0.
Reso. #117-2004 - Resolution Approving Submitting the Attached Charter Ordinance
#21 to a Referendum at the November 2, 2004 General Election Pursuant to Wisconsin
Statute §66.0101(7) and §9.20(4). Salentine moved for adoption. Buckmaster
seconded. Patterson asked why some of the Council members supported this. Mayor
Slocomb noted the reasons were stated at the last Committee of the Whole meeting.
Patterson moved to defer to discuss Reso. #118-2004. The motion died as there was
no second. Schroeder clarified that if the Charter Ord. is submitted directly to a
referendum it would be binding. He discussed the process whereby the Council could
submit the question on November 2 as an advisory referendum and then adopt the
Charter Ord. Can this process be considered as the timing could result in potential
candidates not knowing if the term will be three or four years? Atty. Molter stated that
could be problematic because you will have people running for office and not knowing
what the term is. Schroeder stated he was comfortable sending this to a binding
referendum. Melcher asked how the question would be explained to the citizens. The
Mayor stated the City newsletter could be used to inform the citizens of the referendum
but you have to be careful about expending City resources and providing information
about the issue that could be viewed as endorsing one side or another. Buckmaster
asked if an alderman could provide the pros and cons. The Mayor stated yes. Motion
carried 6-1 with Patterson voting “no.”
Reso. #118-2004 - Resolution Approving Submitting the Attached Charter Ordinance
#22 to a Referendum at the November 2, 2004 General Election Pursuant to Wisconsin
Statute §66.0101(7) and §9.20(4). Schroeder moved for adoption. Buckmaster
seconded. Schroeder stated he is not comfortable with this. It can be brought back at a
later date after the outcome of Charter Ord. #21 is known. The goals are to stagger the
terms of the aldermen so four out of the seven are not up for re-election. In addition, he
would like to see election of the Mayor be combined with different aldermanic districts.
His concern is that if one charter ordinance passes and not the other, the goals will not
be achieved. Buckmaster expressed some of the same concerns. He wants to see the
aldermanic terms be staggered. Melcher stated he supports the Charter Ord. because
it allows a greater length of time for a learning phase and would also stagger the
aldermanic terms. The proposed terms are comparable with what surrounding

municipalities have. Salentine stated we need to take both to the people. Atty. Molter
stated charter ordinances provide the basis for the City’s government; they are not
meant to be changed easily. If a charter ordinance passes, no change can occur for
two years. Buckmaster stated whether the decisions are made by binding or advisory
referendum, the impact would probably be the same for him. Salentine stated move
forward with both; the citizens will know how to vote. Schroeder stated that this is being
proposed for various reasons but not for any political gain. Patterson stated he believes
the existing terms work. The election process makes local government function.
Schroeder and Buckmaster both noted that they are not afraid of an election and the
term changes were not proposed for that reason. Schroeder called for the question.
There were no objections. Motion carried 6-1 with Patterson voting “no.”
Ord. #1173 - An Ordinance to Amend Chapter 26, Section 26.02(8), of the Municipal
Code of the City of Muskego (Parks and Recreation Regulations - Water Areas). First
Reading.
LICENSES
Salentine moved for approval of a Temporary Operator’s License for Cynthia Krauss for
7/3/2004. Schroeder seconded; motion carried.
Salentine moved for approval of an Operator’s license for Joleen Meyer-Pomahac, Mark
Breis, Kim Silber, Jennifer Kovacovich. Schroeder seconded, motion carried.
Salentine moved for approval of Operator’s license for J. Hein subject to satisfactory
completion of test. Schroeder seconded. Patterson stated his disapproval. Motion
carried 5 in favor and Buckmaster and Patterson voting “no.”
Salentine moved for approval of a Temporary Class “B” License to Sell Fermented Malt
Beverages and Temporary “Class B” License to Sell Wine for the Muskego Lions Club
for 9/18/2004. Schroeder seconded; motion carried.
Salentine moved for approval of licensing the outside parking lot of Mug-Z’s Pub & Grill,
W194 S7060 Hillendale Drive, until midnight on July 3, 2004. Schroeder seconded;
motion carried.
VOUCHER APPROVAL
Salentine moved for approval of payment of General Vouchers in the amount of
$420,925.33. Schroeder seconded. Motion carried 7-0. Schroeder moved for approval
of payment of Utility Vouchers in the amount of $113,158.35. Buckmaster seconded.
Motion carried 7-0.
CITY OFFICIALS’ REPORTS
The Clerk noted the following public hearings were scheduled for 7/13/2004: 7:20 PM
to consider petition of Towne Realty to rezone property on Racine Avenue from A -
Agriculture District to RS-2/OPD Suburban Residence with Planned Development
Overlay District for the development of Hickory Creek Estates Subdivision and 7:25 PM
to consider petition of Nancy Meinerz to rezone property on Loomis Drive from RSE
Suburban Residence District and A Agricultural District to B-4 Highway Business District
for the purpose of operating a commercial warehouse and storage facility.
