COMMON COUNCIL - CITY OF MUSKEGO Approved
MINUTES OF MEETING HELD FEBRUARY 11, 2003
The meeting was called to order at 7:53 pm by Mayor Slocomb. Also present were Ald.
Petfalski, Damaske, Le Doux, Madden, Patterson, Salentine, and Schroeder, City
Attorney Molter, Clerk-Treasurer Marenda, and Deputy Clerk Blenski. The Clerk stated
the meeting was noticed in accordance with the open meeting law on 2/7/2003 and
2/10/2003, as amended.
APPROVAL OF MINUTES
Salentine moved for approval of 1/28/2003 minutes. Le Doux seconded; motion carried.
The Clerk-Treasurer read the notice of closed session.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Regarding the power plant, the Mayor stated El Paso indicates it is continuing through
the process. Comments regarding the Environmental Impact Statement should be
submitted so they can be compiled and then forwarded to the PSC. Ald. Petfalski
requested a copy of the submitted comments. He stated that the attorneys were
reviewing the specific language for an agreement regarding the high school athletic
fields.
COMMITTEE REPORTS
Petfalski moved for acceptance of the 2/5/2003 and 2/11/2003 Finance Committee
minutes. Patterson seconded; motion carried.
Salentine moved for acceptance of the 1/27/2003 Public Works Committee minutes.
Schroeder seconded; motion carried.
Minutes of the 2/4/2003 Plan Commission, 1/22/2003 Library Board, and 1/27/2003
Athletic Field Exploration Commission were received and placed on file. The 2/11/2003
Jt. Public Works/Public Utilities meeting was canceled.
Petfalski moved to convene into closed session pursuant to §19.85(1)(e) Deliberating or
negotiating the purchasing of public properties, the investing of public funds, or
conducting other specified public business, whenever competitive or bargaining reasons
require a closed session; more specifically purchase of Ethel Martin property for
expansion of Park Arthur. Salentine seconded. Motion carried 7-0.
Mr. McMullen was present for closed session. The Clerk and Deputy were not present.
Le Doux moved to reconvene into open session. Petfalski seconded. Motion carried 7-
0.
OLD BUSINESS
Reso. #80-2002 – Offer to Purchase – Martin. On the floor, deferred 1/28/2003.
Petfalski moved to defer. Le Doux seconded; motion carried.
Reso. #89-2002 - Appointment of Citizen Member to Board of Review. On the floor,
deferred 6/11/2002. Mayor noted he was appointing Dave Gosse to the Board to fill
2002 vacancy. Motion carried 7-0.

Ord. #1129 - An Ordinance to Amend Chapter 12, Section 12.03, of the Municipal Code
of the City of Muskego (Peddlers, Canvassers and Transient Merchants). Second
Reading. Salentine moved for adoption. Patterson seconded. Motion carried 7-0.
Ord. #1130 - An Ordinance to Amend Chapter 17, Section 4.01, of the Municipal Code
of the City of Muskego (Establishment of Zoning Districts). Second Reading. Salentine
moved for adoption. Le Doux seconded. Motion carried 7-0.
NEW BUSINESS
Reso. #028-2003 - Offer to Purchase - Ihde/Russet Court. Le Doux moved for
adoption. Salentine seconded. Motion carried 7-0.
Reso. #029-2003 - Approval of Legal Lot Status and Certified Survey Map - Collins. Le
Doux moved for adoption. Damaske seconded. Motion carried 7-0.
Reso. #030-2003 - Approval of Certified Survey Map - Norway Business Park LLC,
Town of Norway. Le Doux moved for adoption. Salentine seconded. Motion carried 7-
0.
Reso. #031-2003 - A Resolution to Dissolve Tax Incremental District Number 5.
Petfalski moved for adoption. Salentine seconded. Motion carried 7-0.
Reso. #032-2003 - Authorize Distribution of Tax Incremental Districts #3, #4, #5, #6 and
#7 Funds. Petfalski moved for adoption. Damaske seconded. Petfalski noted that the
distribution represented about 50% of the value. Motion carried 7-0.
Reso. #033-2003 - Appointment to Board of Review (Charlotte Stewart). Patterson
moved for adoption. Le Doux seconded. Motion carried 7-0.
Reso. #034-2003 - Establish Traffic Regulations (Load Rating Signs). Schroeder
moved for adoption. Salentine seconded. Motion carried 7-0.
The following Ordinances had first reading:
Ord. #1131 - An Ordinance to Amend the Zoning Map of the City of Muskego (The
Settlement on Woods Road Subdivision - A to RS-2/OPD).
Ord. #1132 - An Ordinance to Amend Chapter 41 of the Municipal Code of the City of
Muskego to Add Section 41.06 (8) (Detailed Components of Comprehensive Plan -
Tess Corners Design Guide).
Ord. #1133 - An Ordinance to Amend the Zoning Map of the City of Muskego (HC-1
Historic Crossroads District).
LICENSES
Petfalski moved for approval of an Operator’s License for Crystal Murphy and Katrina
Gehrke. Salentine seconded; motion carried.

VOUCHER APPROVAL
Petfalski moved for approval of payment of General Vouchers in the amount of
$626,716.88. Le Doux seconded. Motion carried 7-0. Madden moved for approval of
payment of Utility Vouchers in the amount of $412,591.08. Le Doux seconded. Motion
carried 7-0. Petfalski moved for approval of Tax Checks in the amount of
$3,596,336.96. Le Doux seconded. Motion carried 7-0.
CITY OFFICIALS’ REPORT
The Clerk-Treasurer stated an amendment to the WCA district was necessary for The
Settlement on Woods Road development. It is anticipated the property owner will sign a
Waiver of Notice and a public hearing will not be required. The final assessment
resolution could be adopted at the 2/25/2003 Council. A Special Board of
Commissioners BML/Bass Bay District meeting will be held prior to Council on
2/25/2003.
