COMMON COUNCIL - CITY OF MUSKEGO Approved
MINUTES OF MEETING HELD SEPTEMBER 10, 2002
The meeting was called to order at 7:32 pm by Mayor Slocomb. Also present were Ald.
Petfalski, Damaske, Le Doux, Madden, Patterson, Salentine and Sanders, City Attorney
Molter, and Deputy Clerk Blenski. Those present recited the Pledge of Allegiance. The
Deputy stated the meeting was noticed in accordance with the open meeting law.
APPROVAL OF MINUTES
Salentine moved for approval of minutes of the 8/27/2002 meeting as corrected.
Sanders seconded; motion carried.
Mayor Slocomb stated it would not be necessary for the Council to convene into closed
session. Because of outstanding labor issues, the notice would remain on future
agendas.
RECOGNITION OF HEROIC INDIVIDUALS BY CITY AND STATE
REPRESENTATIVES
Mayor Slocomb stated two events took place in the community this summer that
resulted in heroic actions by several individuals. Their notable acts of service will be
recognized this evening. Police Chief Johnson was present and acknowledged his
support for this recognition. He stated the extraordinary efforts of these people saved
lives without regard for their own personal safety. These local acts of heroism give our
community the strength that it has.
Senator Mary Lazich was present to also express her gratitude on behalf of the State
Legislature.
Mayor Slocomb noted that the actions of Allen Stoll and James Koski on the morning of
June 24, 2002 helped save lives by alerting residents of an apartment building fire. The
individuals were not present; the Mayor stated that Certificates of Recognition would be
forwarded to Mr. Stoll and Mr. Koski.
The other event took place on August 14. The Mayor acknowledged the efforts of
Anthony Miller, Jason Grams, Anthony Alioto, Mark Eurick, Richard Knudsen II, and
Jason Dolphin. These six individuals saved the life of Cathryn Niemczynski and her two
small children. Mayor Slocomb individually expressed the gratitude and appreciation of
the community to those involved. Police Chief Johnson presented the Certificates of
Recognition on behalf of the City. Senator Lazich also made a presentation on behalf of
the State of Wisconsin. Mr. and Mrs. Niemczynski thanked the individuals involved in
the rescue. The Council took a brief recess.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Mayor Slocomb stated the City received a copy of a resolution from the Town of Vernon
asking the City not to approve a power plant here. The Mayor clarified that the siting
and approval is in the hands of the PSC. The Mayor also stated that there might be
some changes regarding the consolidated dispatch issue. He will keep the aldermen
informed via e-mail.

Petfalski moved for acceptance of 9/4/2002 and 9/10/2002 Finance Committee minutes.

Salentine moved for acceptance of 8/26/2002 Public Works Committee minutes.

Minutes of the 8/28/2002 Library Board, 8/15/2002 Teen Advisory Board and 9/3/2002
Plan Commission were received and placed on file.
OLD BUSINESS
Reso. #80-2002 – Offer to Purchase – Martin. On the floor, deferred 8/27/2002. The
Mayor stated the City is in the process of obtaining additional appraisals. Salentine
moved to defer. Damaske seconded; motion carried.
Ord. #1116 - An Ordinance to Amend Chapter 1, Section 1.09 (1) of the Municipal Code
of the City of Muskego (Location of Polling Place - District 7). Second Reading.
Petfalski moved for adoption. Madden seconded. Motion carried 7-0.
NEW BUSINESS
Reso. #178-2002 - Approval of Certified Survey Map - Condroski, Town of Norway. Le
Doux moved for adoption. Sanders seconded. Motion carried 7-0.
Reso. #179-2002 - Disallowance of Claim - Blando. Salentine moved for adoption.
Damaske seconded. The Mayor stated that the City’s insurance carrier has requested
the claim be denied. Motion carried 7-0.
Reso. #180-2002 - Resolution to Authorize the Illumination of the Outdoor Recreational
Facilities at the Muskego High School Athletic Fields. Petfalski moved for adoption.
Damaske seconded. The Mayor stated any illumination of the athletic fields outside of
varsity football home games must be approved by the Council. The school submitted a
request for the fields to illuminated for a special event to be held on 10/7. He has not
received any negative comments about the existing lighting that is allowed. Discussion
took place regarding the 10:30 pm time limit for the football home games with concern
that it may not be long enough. Petfalski stated Friday’s game did not end until 10:30
pm. Mayor Slocomb stated if the high school finds that the 10:30 time needs to be
extended, it can petition to have it changed and another public hearing would have to be
held. Petfalski also expressed concern about the time frame for the special event and
moved to amend the resolution to extend the 9:00 pm time limit to 10:00 pm. Sanders
seconded. Le Doux asked why the time should be extended if that is what was
requested. The Mayor also stated that the required notification had been given to
property owners regarding the special event to take place from 7:00 pm to 9:00 pm.
Petfalski withdrew his motion. Sanders agreed. Damaske suggested that the high
school administration be contacted regarding the 10:30 pm time restriction and
information provided that the school can petition to have it changed if needed. Motion
carried 7-0.
Reso. #181-2002 - Resolution to Amend Agreement Between the City of Muskego and
Ruekert & Mielke for Engineering Services. Petfalski moved for adoption. Salentine

seconded. Petfalski moved to defer because the Finance Committee deferred the
issue. Salentine seconded; motion carried.
Reso. #182-2002 - Resolution to Authorize Issuance of Temporary Occupancy Permits
for Muskego High School. Damaske moved for adoption. Sanders seconded. Petfalski
moved to amend to add the word “or designee” following “Director” and to add “with the
fees to be billed at the time and materials hourly rates as agreed to by the
Muskego/Norway School District” at the end of the paragraph. Le Doux seconded;
motion carried. Reso. #182-2002, as amended, adopted 7-0.
Ord. #1117 - An Ordinance to Amend Chapter 13 of the Municipal Code of the City of
Muskego (Vicious and Dangerous Animals). First Reading. The Mayor stated an
amendment may be forthcoming at the time of second reading because the language is
still being reviewed.
LICENSES
Petfalski moved for approval of an Operator’s License for Elizabeth Schaefer. Le Doux
seconded; motion carried. Petfalski moved for approval of Temporary Operator’s
License for Sandra Schmidt for the 9/21/2002 Muskego Vol. Fire Co. Ladies Auxiliary
event. Sanders seconded; motion carried.
VOUCHER APPROVAL
Petfalski moved for approval of payment of General Vouchers in the amount of
$565,496.95. Sanders seconded. Motion carried 7-0. Sanders moved for approval of
payment of Utility Vouchers in the amount of $53,533.85. Petfalski seconded. Motion
carried 7-0. There were no tax checks.
CITY OFFICIALS’ REPORTS
The Deputy reported that a Campaign Registration Statement was filed by Friends of
the Muskego Community Center, a political group supporting the referendum for the
Community Recreation Center.
COMMUNICATIONS AND MISCELLANOUS BUSINESS AS AUTHORIZED BY LAW
Temporary Occupancy Permit - Kohl’s Department Store
Mayor Slocomb stated a request for temporary occupancy was received and must be
approved by the Common Council. Salentine moved to authorize issuance of
temporary occupancy permit by Engineering/Building Inspection Director or his
designee for Kohl’s Department Store. Petfalski seconded. City Attorney Molter
suggested conditions of issuance be included. Sanders moved to amend to authorize
the issuance of a temporary occupancy permit to Kohl’s Department Store for a period
not to exceed six months for an exact period to be determined and terms and conditions
to be determined from time to time by the Engineering/Building Inspection Director of
the City or his designee. Damaske seconded; motion carried. Original motion, as
amended, carried unanimously.
Petfalski stated the Muskego Volunteer Fire Company would host a 9/11 memorial
service at Veterans Park at 6:45 PM. Damaske recognized John Spitzner for his
generous donation of 50 yellow ribbons commemorating 9/11 which have been placed
on the flags on Janesville Road.
