CM070902 COMMON COUNCIL - CITY OF MUSKEGO Approved MINUTES OF MEETING HELD JULY 9, 2002 The meeting was called to order at 8:10 PM by Mayor Slocomb. Also present were Ald. Damaske, Le Doux, Madden, Patterson, Salentine, and Sanders, City Attorney Trindl, Plan Director Turk, and Clerk-Treasurer Marenda. Ald. Petfalski was absent. Those present recited the Pledge of Allegiance. The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting law on July 5th. APPROVAL OF MINUTES Salentine moved for approval of minutes of the 6/25/2002 meeting. Sanders seconded; motion carried. The Mayor stated the Council would not need to convene into closed session. COMMUNICATIONS FROM THE MAYOR’S OFFICE Mayor Slocomb stated there was nothing new to report regarding the power plant issue. Mayor read a Proclamation proclaiming the week of July 14-20, 2002 as National Aquatic Week. COMMITTEE REPORTS Salentine moved for acceptance of 7/9/2002 Finance Committee minutes. Sanders seconded; motion carried. Le Doux moved for acceptance of 6/24/2002 Public Works Committee minutes. Patterson seconded; motion carried. Minutes of the 6/26/2002 Library Board, 6/20/2002 Teen Advisory Board, and 7/2/2002 Plan Commission were received and placed on file. OLD BUSINESS Reso. #80-2002 – Offer to Purchase – Martin. On the floor, deferred 6/25/2002. Sanders moved to defer. Patterson seconded; motion carried. Reso. #130-2002 – Appointments to Community Development Authority. On the floor, deferred 6/25/2002. Patterson moved to defer. Damaske seconded; motion carried. Reso. #132-2002 - Appointment of Citizen Member to Board of Appeals. Salentine moved to defer. Le Doux seconded; motion carried. Ord. #1108 - An Ordinance to Amend Chapter 3, Sections 3.05(4) and (5), of the Municipal Code of the City of Muskego. Second Reading. The ordinance eliminates the Capital Budget Committee and provides for review of the capital budget requests by the Committee of the Whole for recommendation to the Council. Patterson felt it eliminates presenting the capital budget before a group of citizens which gives some citizen input into the budget process. Le Doux noted the public always has an opportunity to provide input at committee meetings. The Clerk-Treasurer presented a proposed amendment to amend Chapter “2” in title to Chapter “3”, and to add to Section 1: “(e) Such other information as may from time to time be required by the Council or by the state law.” It was noted (e) is currently in the municipal code. Salentine moved to amend as presented. Sanders seconded, motion carried. Ord. #1108 As Amended adopted 5-1 with Patterson voting “no”. Common Council Minutes Page 2 July 9, 2002 NEW BUSINESS Reso. #138-2002 – Offer to Purchase Maciolek Limited Partnership (Road Reservation- Moorland). Salentine moved for adoption. Le Doux seconded; motion carried 6-0. Reso. #139-2002 – Designating Trick or Treat Hours. (Thursday, October 31, 2002 – 6:00 PM to 8:00 PM) Patterson moved for adoption. Le Doux seconded; motion carried 6-0. Reso. #140-2002 – Appointment of Citizen Members to Board of Appeals (H.Schweitzer; R.Kashian). Le Doux moved for adoption. Salentine seconded; motion carried 6-0. Reso. #141-2002 - Reso. #142-2002 – Reso. #143-2002 – Approval of Certified Survey Maps (Maciolek Limited Partnership and MRED). Salentine moved to adopt. Le Doux seconded. Salentine moved to defer. Le Doux seconded; motion carried. Reso. #144-2002 – Approval of Park Ridge Condominium Plat. Salentine moved for adoption. Le Doux seconded; motion carried 6-0. Ord. #1109 – An Ordinance to Amend the Zoning Map and 2010 Comprehensive Plan of the City of Muskego (Maciolek Limited Partnership and MRED Commercial Development Corporation – RS-2 and RS-3 to B-3/OPD and RSA/OPD. First Reading. Ord. #1110 – An Ordinance to Amend the Zoning Map of the City of Muskego (Freedom Square Condominium Area to Include the OWP Wellhead Protection Overlay District). First Reading. Ord. #1111 – An Ordinance to Amend the Zoning Map and 2010 Comprehensive Plan of the City of Muskego (Freedom Square Stormwater Pond Expansion – RS-2, RSA and B-4/OPD to RS-2/OIP and B-4/OPD. First Reading. Sanders questioned why the words “First Reading” no longer appeared on the agenda with the listing of ordinances. Mayor explained it might preclude suspending the rules to allow for second reading and action at the meeting. Further advice will be obtained from the City Attorney to see if “First Reading” can be listed on the agenda with language added to indicate the rules might be suspended, second reading held and action taken. LICENSES Salentine moved for approval of a temporary Operator’s License for Robert Bankenbusch – 8/23-8/25/02. Sanders seconded; motion carried. Salentine moved for approval of Temporary Class “B”/”Class B” Licenses for Muskego Volunteer Fire Co. Ladies Auxiliary – 8/2/02; Muskego Community Festival – 8/23-25/02; and St. Pauls Lutheran Church – 8/4/02. Damaske seconded; motion carried. VOUCHER APPROVAL Salentine moved for approval of payment of General Vouchers in the amount of $889,560.45. Le Doux seconded. Motion carried 6-0. Sanders moved for approval of Common Council Minutes Page 3 July 9, 2002 payment of Utility Vouchers in the amount of $24,554.67. Le Doux seconded. Motion carried 6-0. CITY OFFICIALS’ REPORTS The Clerk announced a public hearing will be held on 7/23/02 at 7:15 pm to consider petition of Cedar Mill Homes to rezone from RSE to RSE/COPD for the development of Chamberlain Hills subdivision.
