COMMON COUNCIL - CITY OF MUSKEGO Approved
MINUTES OF MEETING HELD JUNE 11, 2002
The meeting was called to order at 7:44 PM by Mayor Slocomb. Also present were Ald.
Damaske, Le Doux, Madden, Patterson, Petfalski, Salentine, and Sanders, City
Attorney Molter and Clerk-Treasurer Marenda. Those present recited the Pledge of
Allegiance. The Mayor stated the meeting was noticed in accordance with the open
meeting law.
APPROVAL OF MINUTES
Salentine moved for approval of minutes of the 5/28/2002 meeting. Sanders seconded;
motion carried.
The Clerk-Treasurer read the notice of closed session.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Mayor Slocomb stated there was nothing new to report regarding the power plant issue.
Various articles regarding El Paso have appeared in the newspapers recently. Mayor
announced petitions for Direct Legislation were submitted today to the Clerk-Treasurer,
who now has 15 days in which to determine their sufficiency and correct form.
COMMITTEE REPORTS
Petfalski moved for acceptance of 6/5/2002 and 6/11/2002 Finance Committee minutes.
Salentine seconded; motion carried.
Patterson moved for acceptance of 6/5/2002 Public Services Committee minutes.
Damaske seconded; motion carried.
Minutes of the 5/16/2002 Teen Advisory Board meeting were received and placed on
file.
OLD BUSINESS
Reso. #80-2002 – Offer to Purchase – Martin. On the floor, deferred 5/28/2002.
Salentine moved to defer. Le Doux seconded; motion carried.
Reso. #88-2002 - Appointment of Citizen Members to Board of Appeals. On the floor,
deferred 5/28/2002. Le Doux moved to amend to appoint current alternate members
Barbara Blumenfield and Horst Schmidt as regular members with terms to expire May 1,
2005; and Harvey Schweitzer as first alternate with term to expire May 1, 2004.
Petfalski seconded; motion carried. Reso. #88-2002 as amended adopted 7-0.
Reso. #89-2002 - Appointment of Citizen Member to Board of Review. On the floor,
deferred 5/28/2002. Mayor stated he would not be bringing forward an appointment for
a couple months. Sanders moved to defer until that time. Damaske seconded; motion
carried.
Reso. #90-2002 - Appointment of Citizen Members to Library Board. On the floor,
deferred 5/28/2002. Salentine moved to amend to name Barbara Yahr and Tadd Uttke
with terms to expire May 1, 2005. Patterson seconded; motion carried. Reso. #90-
2002 As Amended adopted 7-0.
Reso. #103-2002 - Appointment of Citizen Member to Plan Commission. On the floor,
deferred 5/28/2002. Le Doux moved to amend to name Michael Michalski with term to

expire May 1, 2005. Sanders seconded; motion carried. Reso. #103-2002 as amended
adopted 7-0.
NEW BUSINESS
Reso. #123-2002 – Resolution Combining Wards for Election Purposes. Le Doux
moved for adoption. Petfalski seconded. Motion carried 7-0.
Reso. #124-2002 – Appointment to Future Parkland Standing Committee (Ald.
Madden). Salentine moved for adoption. Sanders seconded. Motion carried 7-0.
Reso. #125-2002 – Resolution To Establish Fees for Department of Public Works (Deep
Ditches). Patterson moved for adoption. Le Doux seconded. Salentine moved to
amend to establish the fees at $3.60 per foot for a 4” single line, and $4.50 per foot for a
4” dual line. Patterson seconded; motion carried. Reso. #125-2002 as amended
adopted 7-0.
Reso. #126-2002 – Award of Bid – 2002 Road Program. Le Doux moved for adoption.
Sanders seconded. Motion carried 7-0.
Reso. #127-2002 – Approval of Various License Applications for the City of Muskego for
the Licensing Period July 1, 2002 to June 30, 2003. Salentine moved for adoption.
Damaske seconded. Motion carried 7-0.
Reso. #128-2002 – Establish Traffic Regulations. Le Doux moved for adoption.
Damaske seconded. Motion carried 7-0.
Reso. #129-2002 – Resolution to Amend the By-Laws and Rules of Procedure –
Community Development Authority of the City of Muskego, Wisconsin. Salentine
moved for adoption. Le Doux seconded. Motion carried 7-0.
Reso. #130-2002 – Appointments to Community Development Authority. Petfalski
moved for adoption. Le Doux seconded. Mayor stated he hoped to bring names
forward at next meeting. Petfalski moved to defer. Le Doux seconded; motion carried.
Reso. #131-2002 – Resolution Declaring Intent Regarding Referendum Election-
Community Recreation Center. Petfalski moved for adoption. Patterson seconded.
Petfalski moved to amend to delete the words “its intent” after the word “declare”.
Patterson seconded. Atty. Molter stated it was a policy decision, but he liked the words
“declare its intent” in the resolution because it is the intent of the current Council, and
from a legal perspective it could be changed. Petfalski stated he wanted to make it
clear that it is the Council’s intent to take this matter to referendum regardless of the
cost. Motion carried. Reso. #131-2002 as amended adopted 7-0.
Ord. #1105 – An Ordinance to Amend Chapter 3 of the Municipal Code of the City of
Muskego (Common Council Planning and Approval of Public Works Projects). First
reading. Mayor asked if any member of the Council wishes additional information prior
to second reading. Patterson asked if this ordinance requires that once we start the
planning process we can’t stop it until the entire process is done. Mayor responded
“no”.

Ord. #1106 – An Ordinance to Amend Chapter 3 of the Municipal Code of the City of
Muskego (Limit on Construction of Public Works Projects Whose Estimated Costs
Exceed $15 Million). First reading. Mayor asked if any member of the Council wishes
additional information prior to second reading. Damaske asked where the $15 million
came into play. Mayor said he will provide that information. Patterson said he has
received a number of requests to have a member of the citizens group address the
Council, and asked that Belinda Ricco be allowed to speak. Mayor recommended the
request be denied as this matter is not on the floor, but asked Atty. Molter for his
opinion. Molter said since the ordinance is on the agenda it could be allowed, and the
procedure the Council has followed in the past is if any alderman objects, then the
request is denied. Patterson moved to allow Belinda Ricco to address the Council.
Damaske seconded. With a roll call vote of 6 yes and 1 no (Sanders), permission was
denied.
Ord. #1107 – An Ordinance to Amend Chapter 1, Section 1.05 (3) of the Municipal
Code of the City of Muskego (Board of Zoning Appeals). First reading.
LICENSES
Petfalski moved for approval of Operators Licenses for Steve Fischer. Damaske
seconded; motion carried.
Petfalski moved for approval of a Salvage and Recycling permit for James Kohne.
Sanders seconded; motion carried.
VOUCHER APPROVAL
Petfalski moved for approval of payment of General Vouchers in the amount of
$725,983.72. Le Doux seconded. Motion carried 7-0. Sanders moved for approval of
payment of Utility Vouchers in the amount of $28,337.72. Le Doux seconded. Motion
carried 7-0. Petfalski moved for approval of payment of Tax Checks in the amount of
$1,475.00. Sanders seconded. Motion carried 7-0.
CLOSED SESSION
Petfalski moved to convene into closed session pursuant to Wis.Stats.19.85(1)(c)
Considering employment, promotion, compensation, or performance evaluation data of
any public employee over which the governmental body has jurisdiction or exercises
responsibility, more specifically labor negotiations with represented employees. Action
may be taken in closed session. The Common Council will then reconvene into open
session to continue with agenda items.
OPEN SESSION: Petfalski moved to reconvene in open session. Le Doux seconded;
motion carried.
ADJOURNMENT
Le Doux moved to adjourn at 8:44 PM. Damaske seconded; motion carried.
