COMMON COUNCIL - CITY OF MUSKEGO
MINUTES OF MEETING HELD FEBRUARY 12, 2002

The meeting was called to order at 7:54 PM by Mayor De Angelis. Also present were
Ald. Slocomb, Le Doux, Patterson, Salentine, Sanders, and Wichgers, City Attorney
Molter, Clerk-Treasurer Marenda, Plan Director Turk, and Deputy Clerk Blenski. Ald.
Petfalski was absent. Finance Director Gunderson arrived during the meeting. Those
present recited the Pledge of Allegiance. The Clerk-Treasurer stated the meeting was
noticed in accordance with the open meeting law on 2/8/02.
Slocomb moved for approval of minutes of 1/22/02. Le Doux seconded; motion carried.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
The Mayor stated there was nothing new regarding the power plant. We are still waiting
for them to file remainder of materials. Permit applications were filed in December; we
did not hear from DNR or El Paso. He also thanked everyone who participated in the
Polar Plunge.
ACCEPTANCE OF COMMITTEE REPORTS
Slocomb moved for acceptance of the 2/6/02 and 2/12/02 Finance Committee minutes.
Salentine seconded; motion carried.
Patterson moved for acceptance of the 2/4/02 Public Services Committee minutes.
Wichgers seconded; motion carried.
Salentine moved for acceptance of the 1/28/02 Public Works Committee minutes. Le
Doux seconded; motion carried
Minutes of the 2/5/2002 Plan Commission, 1/17/2002 Teen Advisory Board and
1/23/2002 Library Board were received and placed on file.
Reso. #32-2002 - Approval of Certified Survey Map - Bartz. Le Doux moved for
adoption. Wichgers seconded. Motion carried 6-0.
Ord. #1084 - An Ordinance to Amend Chapter 17, Sections 2.02 and 6.09, of the
Municipal Code of the City of Muskego (Zoning Code Definitions and Signs), on the
floor, deferred 1/22/2002. Mr. Turk presented an update on the amendments written by
Plan staff to allow size sign bonuses based on the distance from centerline and
adjustments to reader board signs based on the distance from centerline and the posted
speed limit. The tables on pages 19 and 20 of the ordinance represent the proposed
changes. The Plan Commission reviewed the ordinance and the proposed
amendments and recommended approval subject to striking changes proposed on
pages 19 and 20. Le Doux supports retaining the proposed language that was removed
by the Plan Commission. Slocomb stated that signs must be readable from the
roadway while taking into account safety and speed; he also supports keeping the
language in. Salentine agreed and moved to amend to incorporate the strikethrough
and underlined changes, with the exception that the strikethrough items on pages 19
and 20 would be retained, and to remove Section 5 because an additional public
hearing is required as a separate section of the zoning ordinance is involved. Le Doux
seconded; motion carried. Ord. #1084, as amended, adopted 6-0.

Ord. #1091 - An Ordinance to Amend Chapter 1, Section 1.09(1) of the Municipal Code
of the City of Muskego (Location of Polling Places - District 7). Second Reading.
Slocomb moved for adoption. Le Doux seconded. Motion carried 6-0.
Ord. #1092 - An Ordinance to Amend the Zoning Map of the City of Muskego (Martin
Estates - RCE to RCE/COPD). Second Reading. Slocomb moved for adoption.
Salentine seconded. Slocomb moved to defer as Ald. Petfalski could not be present
and wanted to speak on this issue. Sanders seconded; motion carried. Mr. Turk was
dismissed.
Reso. #30-2002 - Waukesha County Cooperation Council Fair Share Solution. Le Doux
moved for adoption. Wichgers seconded. The Mayor stated the language came from
the municipalities of Waukesha County in response to the Governor’s proposal
regarding shared revenue. County Executive Finley already presented it to the
Governor on behalf of the county. Motion to adopt carried 6-0.
Reso. #31-2002 - Approval of Certified Survey Map - Cyskiewicz, Town of Waterford.
Le Doux moved for adoption. Salentine seconded. Motion carried 6-0.
Reso. #33-2002 - Reapproval of Certified Survey Map - Kashian, Town of Vernon. Le
Doux moved for adoption. Slocomb seconded. Motion carried 6-0.
Reso. #34-2002 - Approval of Final Plat, Subdivider’s Agreement, Retention Pond
Maintenance Agreement, Open Space Management Plan Agreement, Deed of
Conservation Easement and Letter of Credit for Martin Estates. Slocomb moved for
adoption. Salentine seconded. Slocomb moved to defer. Sanders seconded; motion
carried.
Reso. #35-2002 - Preliminary Resolution Declaring Intent to Levy Area-Wide Reserve
Capacity Assessment for Debt Service for Sewer Service Under §66.0703, Wisconsin
Statutes (Amended Sewer Service Area). Sanders moved for adoption. Salentine
seconded. Motion carried 6-0.
Reso. #36-2002 - Reapproval of Certified Survey Map, Amendment No. 1 to
Developer’s Agreement and Letter of Credit - Dreamland Development. Salentine
moved for adoption. Le Doux seconded. Motion carried 6-0.
Reso. #37-2002 - Resolution to Establish Fees (Conservation Subdivisions). Le Doux
moved for adoption. Salentine seconded. Motion carried 6-0.
Reso. #38-2002 - Resolution Declaring Certain Delinquent Personal Property Taxes to
be Uncollectible. Salentine moved for adoption. Sanders seconded. Motion carried 6-
0.
Reso. #39-2002 - Resolution to Approve New and Revised Positions (Muskego Police
Department). Salentine moved for adoption. Slocomb seconded. The Mayor noted the
changes did not involve hiring any new employees. Motion carried 6-0.

Reso. #40-2002 - Amended Relocation Order of the City of Muskego, Waukesha
County, Wisconsin (Storm Sewer Watercourse Control Improvement Project - Kotnik
Property). Le Doux moved for adoption. Sanders seconded. The Mayor stated a
revised map was necessary. Motion carried 6-0.
Reso. #41-2002 - Appointment of Citizen Members to Conservation Commission. Item
removed from agenda.
Ord. #1093 - An Ordinance to Amend Chapter 18 of the Municipal Code of the City of
Muskego (Jurisdiction and Compliance/Recordation). First Reading.
Ord. #1094 - An Ordinance to Amend the 2010 Comprehensive Plan. First Reading.
LICENSES
Slocomb moved to approve Operators’ Licenses for Thomas Jacomet and Andrew
Boren. Salentine seconded; motion carried.
VOUCHER APPROVAL
Slocomb moved for approval of payment of General Vouchers in the amount of
$1,062,507. Sanders seconded. Motion carried 6-0. Sanders moved for approval of
payment of Utility Vouchers in the amount of $222,625.99. Salentine seconded. Motion
carried 6-0. Slocomb moved for approval of Tax Checks in the amount of
$3,387,438.07. Sanders seconded. Motion carried 6-0.
CITY OFFICIALS’ REPORTS
The Clerk-Treasurer announced that a public hearing was scheduled for 2/26/2002 at
7:25 PM to consider the implementation of a moratorium on land uses prohibited in the
Well Head Protection Overlay Zoning District.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
The Mayor and Finance Director Gunderson presented some budget reduction
alternatives for the City to consider in light of the Governor’s proposed reduction of
shared revenue. The consensus of the Council at this time was to set aside several
budgeted items, which represents approximately $528,000. The proposed reductions
include: Proposed new positions ($144,000), Freezing Hiring of Floater ($40,000),
Freezing Hiring of DPW Retiree ($52,000), with position to be reviewed later, Road
Improvement Reduction ($150,000), Urban and Rural Drainage Projects ($77,000), Plan
Reductions ($11,000), Building Reductions ($3,000), Consultants and Training-Mayor
($10,000), Library Print Materials Reduction ($33,000) and Library Office Supplies
($8,000). The Mayor recommended filling the Engineering I position, as it will mostly be
funded by sources other than those in the operating budget. Slocomb and Salentine
agreed. Sanders stated perhaps the level of City services and projects needs to be
scaled back. As the City does not know at this point the final reduction in state revenue,
it was determined that if additional money needed to be cut from the 2002 operating
budget, some of the other alternatives would have to be reviewed including restructuring
debt payments to the sewer utility.
It was also noted that the Committee of the Whole would meet on 2/14/2002.
