CM092501 COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 25, 2001 Approved: October 9, 2001 The meeting was called to order at 8:10 PM by Mayor De Angelis. Also present were Ald. Slocomb, Le Doux, Patterson, Salentine, Sanders, and Wichgers, City Attorney Molter, Plan Director Turk, Clerk-Treasurer Marenda and Deputy Clerk Blenski. Attorney Feeley was also present to represent the City regarding the Quietwood Creek issue. Ald. Petfalski was absent. Those present recited the Pledge of Allegiance. The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting law on 9/21/01. Slocomb moved for approval of the 9/11/01 minutes. Le Doux seconded; motion carried. COMMUNICATIONS FROM THE MAYOR’S OFFICE Regarding the power plant update, Mayor De Angelis stated the City has not received any correspondence to date from El Paso. Negotiations are proceeding with the various bargaining units. Ald. Patterson and Slocomb are members of the negotiating team. The proposed completion date for Woods Road is 10/7/2001. Reso. #184-2001 - Resolution as to Substantial Change to the Quietwood Creek Planned Development District. Le Doux moved for adoption. Salentine seconded. Slocomb supported denial based on petitioner’s withdrawal request. Since the Council has not reviewed the supporting documentation (9/4/2001 Staff Supplement) represented in the Resolution, he suggested that some of that language be stricken. Salentine and Patterson expressed that leaving the detail in the Resolution sent a stronger message. The Council took a brief recess so the information could be reviewed. The Council reconvened at 8:48 PM and Mr. Turk was dismissed to obtain traffic impact information. It was determined that the meeting would continue with the other agenda items during his absence. COMMITTEE REPORTS Slocomb moved for acceptance of the 9/19/01 and 9/25/01 Finance Committee minutes. Sanders seconded; motion carried. Sanders moved for acceptance of the 9/12/2001 and 9/17/2001 Public Utilities Committee minutes. Le Doux seconded; motion carried. Minutes of the 9/18/2001 Plan Commission and 9/10/2001 Parks and Recreation Board were received and placed on file. Slocomb requested the Parks Board clarify its minutes to reflect that the funding source to reimburse the Park Dedication account for the outlot in The Settlement on Woods Road has not been determined. Ord. #1077 - An Ordinance to Establish Aldermanic District Boundaries in the City of Muskego. On the floor, deferred 9/11/2001. Salentine moved to amend the map, Common Council Minutes Page 2 September 25, 2001 Exhibit “A” to correct ward reference “7-15” to “7-16.” Slocomb seconded; motion carried. Wichgers stated the County Board adopted the map with no amendments made for the City of Muskego. Ord. #1077, as amended, adopted 6-0. Reso. #184-2001 - Resolution as to Substantial Change to the Quietwood Creek Planned Development District, on the floor. Plan Director Turk stated the traffic information requested was not available. Slocomb moved to amend the Resolution to strike “approve/approve with conditions” in the NOW, THEREFORE, BE IT RESOLVED and to strike “additional services including refuse, recycling, biohazardous waste removal and” in Item No. 4 and to strike Item No. 5 completely. Patterson seconded. Discussion continued about leaving Item No. 5 in with some Council members noting that the information is supported by staff research. Salentine called for the question; there were no objections. Motion to amend defeated 4-3 with Sanders, Slocomb and Le Doux voting “yes,” Salentine, Wichgers and Patterson voting “no” and the Mayor voting “no” to break the tie. Salentine moved to amend to strike “approve/approve with conditions” and to add Item No. 6 “Pursuant to request to withdraw the petition submitted in writing by JoAnne Gorenc through correspondence dated September 21, 2001.” Wichgers seconded. He noted that the facts contained in the Resolution were supported by the Plan Commission and staff, which is sufficient for him. Motion to amend carried 5-1 with Slocomb voting “no.” Reso. #184-2001, as amended, adopted 6-0. Wichgers stated the Council action to deny will set a precedent and send a message. Attorney Feeley and Mr. Turk were dismissed. Reso. #178-2001 - Relocation Order of the City of Muskego, Waukesha County, Wisconsin (Bay Lane Intersection Project - Maurice Property). Salentine moved for adoption. Sanders seconded. Motion carried 6-0. Reso. #179-2001 - Authorizing the Hiring of an Appraiser and Relocation Expert to Carry Out Relocation Order Known as Resolution #178-2001. Sanders moved for adoption. Wichgers seconded. Motion carried 6-0. Reso. #180-2001 - Approval of Certified Survey Map - Counter. Slocomb moved for adoption. Le Doux seconded. Motion carried 6-0. Reso. #181-2001 - Second Amended Relocation Order of the City of Muskego, Waukesha County, Wisconsin (Martin Drive). Le Doux moved for adoption. Salentine seconded. Motion carried 6-0. Reso. #182-2001 - Reapproval of Certified Survey Map, Amendment No. 1 to Developer’s Agreement and Letter of Credit - Dreamland Development. Sanders moved for adoption. Slocomb seconded. Motion carried 6-0. Reso. #183-2001 - Intergovernmental Agreement Per 66.0301 as it Relates to the Preparation of Storm Water Management Plan in the Tess Corners Creek North Drainage Basin Between the City of Muskego and the City of New Berlin. Patterson moved for adoption. Le Doux seconded. Motion carried 6-0. Common Council Minutes Page 3 September 25, 2001 Ord. #1082 - An Ordinance to Amend Chapter 17 of the Municipal Code of the City of Muskego Pertaining to Accessory Structures. First Reading. Sanders requested summary of existing structure specifications and what is being proposed. He also requested the proposed amendments referred to by Slocomb at the public hearing be provided prior to second reading. LICENSES Slocomb moved for approval of Temporary Operator’s license for Angela Koenings for 10/27/2001. Salentine seconded; motion carried. Slocomb moved for approval of Class “B” License to Sell Fermented Malt Beverages for the St. Leonard’s Class of 1981 Reunion for 9/27/2001. Sanders seconded; motion carried. VOUCHER APPROVAL Slocomb moved for approval of payment of General Vouchers in the amount of $432,036.48. Sanders seconded. Motion carried 6-0. Sanders moved for approval of payment of Utility Vouchers in the amount of $125,316.70. Le Doux seconded. Motion carried 6-0. CITY OFFICIALS’ REPORTS The Clerk-Treasurer stated a public hearing was scheduled for 10/23/2001 at 7:25 PM to consider an amendment to Chapter 17 regarding signs and zoning code definitions. A draft of the October calendar was reviewed. It was determined that a Committee of the Whole meeting would be scheduled for 10/4/2001 in the Muskego Room. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Nominations are still needed for the Teen Advisory Board. The Clerk-Treasurer has contacted the School Board and will also contact the high school guidance office. Slocomb moved to adjourn at 9:33 PM. Sanders seconded; motion carried.
