COMMON COUNCIL - CITY OF MUSKEGO
MINUTES OF MEETING HELD AUGUST 28, 2001

The meeting was called to order at 7:42 PM by Mayor De Angelis. Also present were
Ald. Slocomb, Le Doux, Patterson, Petfalski, Salentine, Sanders, and Wichgers, Plan
Director Turk, City Attorney Molter, Clerk-Treasurer Marenda and Deputy Clerk Blenski.
Those present recited the Pledge of Allegiance. The Clerk-Treasurer stated the
meeting was noticed in accordance with the open meeting law on 8/24/01.
Slocomb moved for approval of the 8/14/01 minutes. Petfalski seconded; motion
carried.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
As an update on the power plant issue, the Mayor stated that the Aldermen should have
received a copy of the letter sent by RMT, consultants for Midwest Power, to the EPA to
respond to inquiries. El Paso has not selected a date for the open house. The Mayor is
finalizing the committee appointments for the Community Center/Theatre projects.
Contracts with architects have not been signed. He will provide documentation by the
end of the week regarding proposals in the budget bill which could affect Muskego, one
of which relates to dams. Mayor De Angelis thanked all of those involved for another
successful community festival.
Ord. #1076 - An Ordinance to Amend the Zoning Map and Comprehensive Plan of the
City of Muskego, A to RS-3/OPD - The Reserve at Champions Village. Second
Reading. Slocomb moved for adoption. Sanders seconded. Motion carried 7-0.
Reso. #163-2001 - Approval of Final Plat, Subdivider’s Agreement and Letter of Credit
for The Reserve at Champions Village. Slocomb moved for adoption. Petfalski
seconded. Motion carried 7-0.
Reso. #170-2001 - Determination of Substantial Change to the Planned Development
District for Quietwood Creek. Le Doux moved for adoption. Wichgers seconded. Mr.
Turk stated that a legal opinion has been received that a 9-15 bed community based
residential facility (CBRF) proposed to be located in the Quietwood Creek Subdivision is
not consistent with the exclusive single-family use as provided by the developer’s
agreement. The Plan Commission adopted Resolution #P.C. 129-2001 determining
that the proposal represents a substantial change to the Quietwood Creek Planned
Development District. The Plan Commission is expected to take action on the Building,
Site and Operation (BSO) Plan and Conditional Use Grant on 9/4 or 9/18. Adoption of
this resolution means the Council also finds that the proposal constitutes a substantial
change and a public hearing will be held on 9/25/01. At the same meeting, the Council
could approve the substantial change. However, the Plan Commission must have
approved the BSO and Conditional Use. Motion to adopt carried 7-0.

Mr. Turk was dismissed at 8:12 PM.
COMMITTEE REPORTS
Sanders moved for acceptance of the 8/22/01 and 8/28/01 Finance Committee minutes.
Salentine seconded; motion carried.
Sanders moved for acceptance of the 8/20/2001 and 8/24/2001 Public Utilities
Committee minutes. Petfalski seconded. Petfalski requested minor corrections to
minutes of 8/24: he left the meeting at 11:00 AM; motion to adjourn seconded by
Sanders. Motion to accept minutes as corrected carried.
Minutes of the 8/21/2001 Plan Commission and 8/13/2001 and 8/16/2001 Parks and
Recreation Board were received and placed on file.
Ord. #1077 - An Ordinance to Establish Aldermanic District Boundaries in the City of
Muskego. Second Reading. Petfalski moved for adoption. Le Doux seconded.
Petfalski moved to defer to allow for publication of ordinance as a Class 2 notice as
required by statutes. Wichgers seconded; motion carried.
Reso. #162-2001 - Recognition of 25 Years of Service - Jeffery Kloskowski - Public
Works Department. Salentine moved for adoption. Petfalski seconded. Motion carried
7-0.
Reso. #164-2001 - Disallowance of Claim - Wilson. Salentine moved for adoption.
Slocomb seconded. Motion carried 7-0.
Reso. #165-2001 - Resolution of Eligibility for Exemption from County Library Levy for
2002. Petfalski moved for adoption. Wichgers seconded. Motion carried 7-0.
Reso. #166-2001 - Reapproval of Certified Suvey Map, Developer’s Agreement and
Letter of Credit for Dreamland. Le Doux moved for adoption. Salentine seconded. The
Mayor stated developer anticipates finalizing everything in the next two weeks. Kohls
planned to be open by Aug. of 2002. Motion carried 7-0.
Reso. #167-2001 - Approval of Certified Survey Map - Miller, Town of Vernon. Le Doux
moved for adoption. Sanders seconded. Motion carried 7-0.
Reso. #168-2001 - Approval of Certified Survey Map - Olson, Town of Vernon. Le Doux
moved for adoption. Sanders seconded. Motion carried 7-0.
Reso. #169-2001 - Approval of Certified Survey Map - Niezgoda. Le Doux moved for
adoption. Salentine seconded. Motion carried 7-0.
Reso. #171-2001 - Amended and Revised Final Resolution Authorizing Installation of
Sewer Improvements and Levying Special Assessments Against Benefited Property
(North Cape Road-Ryan Road to Boxhorn, Project MSS-1-99, Assessment District
“SR”). Sanders moved for adoption. Slocomb seconded. Motion carried 7-0.

3/OIP and B-1 to B-1/OIP - Pioneer Drive). First Reading.
Ord. #1079 - An Ordinance to Amend Chapter 17, Section 6.02 and 9.03, and to Create
Section 9.12 of the Municipal Code of the City of Muskego (Planned Development
Districts and Conservation Planned Development Districts). First Reading.
Ord. #1080 - An Ordinance to Amend Chapter 17, Sections 2.02 and 6.11, of the
Municipal Code of the City of Muskego (Building, Site and Operational Plans). First
Reading.
Ord. #1081 - An Ordinance to Repeal and Recreate Chapter 18 of the Municipal Code
of the City of Muskego (Land Division Ordinance). First Reading.
LICENSES
Slocomb moved for approval of Operators’ licenses for Nicholas Aron, Jessica Zaren,
Susan Kummer and Dennis Busse. Sanders seconded; motion carried.
VOUCHER APPROVAL
Slocomb moved for approval of payment of General Vouchers in the amount of
$467,209.71. Sanders seconded. Motion carried 7-0. Sanders moved for approval of
payment of Utility Vouchers in the amount of $651,219.05. Petfalski seconded. Motion
carried 7-0.
CITY OFFICIALS’ REPORT
The Clerk-Treasurer noted the Big Muskego Lake/Bass Bay Protection & Rehabilitation
District Annual Meeting was scheduled for 8/29/01 at 7:00 PM.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
Teen Advisory Board nominations are still needed. The Mayor stated that the City
closed on the Boehm-Maciolek property for the Community Center. Appraisal just
received for the Carity parcel. Salentine stated that the drawdown for Little Muskego
Lake was scheduled for the third Monday in October (10/15). It is anticipated that the
third Monday will be used as the drawdown date annually.
