CM081401 COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF MEETING HELD AUGUST 14, 2001 Approved: August 28, 2001 The meeting was called to order at 7:41 PM by Mayor De Angelis. Also present were Ald. Slocomb, Patterson, Petfalski, Sanders, and Wichgers, Plan Director Turk, City Attorney Trindl, Clerk-Treasurer Marenda and Deputy Clerk Blenski. Ald. Le Doux and Salentine were absent. Those present recited the Pledge of Allegiance. The Clerk- Treasurer stated the meeting was noticed in accordance with the open meeting law on 8/10/01 and then read the notice of closed session. Slocomb moved for approval of the 7/24/01 minutes. Sanders seconded; motion carried. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor noted that e-mail correspondence has been received from El Paso Power regarding a proposed open house. Material has been submitted by citizens to designate Tans Drive and Crowbar as rustic roads; Plan Director Turk has for review. Teen Advisory Board nominations are still needed. The Mayor is finalizing the planning committees to work on the Community Center and Theatre projects. He also invited everyone to attend the Community Festival to be held on 8/24 through 8/26. COMMITTEE REPORTS Sanders moved for acceptance of the 8/8/01 and 8/14/01 Finance Committee minutes. Petfalski seconded; motion carried. Patterson moved for acceptance of the 8/6/2001 Public Services Committee minutes. Wichgers seconded; motion carried. Minutes of the 8/7/2001 Plan Commission and 7/25/2001 Library Board were received and placed on file. NEW BUSINESS Reso. #146-2001 - Release of Park and Open Space Land Reservation, Outlot 1, Rosewood Estates. Slocomb moved for adoption. Patterson seconded. Motion carried 5-0. Reso. #147-2001 - Approval of Preliminary Plat - Rosewood Estates Addition No. 1. Slocomb moved for adoption. Petfalski seconded. Motion carried 5-0. Reso. #144-2001 - Recommendation to Waukesha County Relating to County Highway “L”/Janesville Road Reconstruction. Wichgers moved for adoption. Patterson seconded. Mr. Turk was present to respond to any inquiries. Motion to adopt carried 5- 0. Patterson moved for adoption. Wichgers seconded. Motion carried 5-0. Reso. #150-2001 - Denial of Legal Lot Status - Knickelbine. Petfalski moved for adoption. Wichgers seconded. Mr. Turk stated that the property owner withdrew his petition. Follow-up letters are being sent to those property owners that can still petition for legal lot status. Motion carried 5-0. Mr. Turk was dismissed at 8:09 PM. Reso. #148-2001 - Relocation Order of the City of Muskego, Waukesha County, Wisconsin (Storm Sewer Watercourse Control Improvement Project-Pelzman-Kotnik Property). Slocomb moved to amend references to “Lot 1 and Lot 2” to “Outlot 1 and Outlot 2” on the face of the map. Sanders seconded; motion carried. Motion to adopt Reso. #158-2001, as amended, carried 5-0. Reso. #159-2001 - Acceptance of Access Easement - Candlewood Creek. Slocomb moved for adoption. Sanders seconded. Slocomb moved to amend Easement to reflect the sum of One Dollar. Wichgers seconded; motion carried. Reso. #159-2001, as amended, adopted 5-0. Reso. #160-2001 - Approval of Agreement Between the City of Muskego and Partners in Design Architects, Inc. for Community Center Feasibility Study. Sanders moved for adoption. Petfalski seconded. Motion carried 5-0. Reso. #161-2001 - Approval of Agreement Between the City of Muskego and Engberg Anderson Design for Theatre/Meeting Room/Banquet Hall Feasibility and Conceptual Design. Slocomb moved for adoption. Sanders seconded. Motion carried 5-0. Ord. #1076 - An Ordinance to Amend the Zoning Map and 2010 Comprehensive Plan of the City of Muskego, A to RS-3/OPD - The Reserve at Champions Village. First Reading. Ord. #1077 - An Ordinance to Establish Aldermanic District Boundaries in the City of Muskego. First Reading. LICENSES Slocomb moved for approval of Operators’ licenses for Sheri Frazier (Temporary), Brian Lesniewski, Terry Matthias, Amy Tipton, Kenneth Frenz, and Adrienne Hansen. Sanders seconded; motion carried. Slocomb moved for Temporary Class “B”/“Class B” Retailer’s License for the Muskego Corvette Club for 8/25/2001. Petfalski seconded; motion carried. VOUCHER APPROVAL Slocomb moved for approval of payment of General Vouchers in the amount of $1,392,152.57. Sanders seconded. Motion carried 5-0. Slocomb moved for approval of payment of Tax Checks in the amount of $3,129,556.35. Sanders seconded. Motion carried 5-0. Sanders moved for approval of payment of Utility Vouchers in the amount of $322,935.04. Petfalski seconded. Motion carried 4 in favor and Sanders voting “no.” Common Council Minutes Page 4 August 14, 2001 CITY OFFICIALS’ REPORT The Clerk announced that public hearings would be held on 8/28/01 at 7:20 PM to consider petition to rezone property on Pioneer Drive from B-3 to B-3/OIP and from B-1 to B-1/OIP and at 7:25 PM to consider amendments to Chapter 17 and Chapter 18 to add conservation language. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW The consensus of the Council was that it was not necessary for SEWRPC staff to attend a future meeting regarding the Freeway Construction Study. Wichgers moved to convene into closed session pursuant to §19.85(1)(e) Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session; more specifically joint land acquisition with the DNR of the Hendrickson property for conservation purposes. Slocomb seconded. Motion carried 5- 0. Wichgers moved to reconvene into open session. Petfalski seconded. Motion carried 5-0. Slocomb moved to adjourn at 9:00 PM. Wichgers seconded; motion carried.
