CM061101special COMMON COUNCIL – CITY OF MUSKEGO MINUTES OF SPECIAL MEETING HELD JUNE 11, 2001 Approved: June 12, 2001 The meeting was called to order at 6:20 PM by Mayor De Angelis. Also present were Ald. Slocomb, Petfalski, Le Doux, Salentine, and Wichgers. Ald. Patterson and Sanders were absent. The Mayor stated the meeting was noticed in accordance with the open meeting law. Mayor noted the four candidates who had filed their application to fill the unexpired term of Municipal Judge due to the resignation of Peter Lentz were present: Patrick T. Berigan, Gerald S. Boisits, Raymond E. Schrank, II and Joseph E. Schubert. He advised they would be interviewed in alphabetical order with questions from the Aldermen and with an opportunity to provide some closing comments. Mayor requested if each candidate would leave the room during the interview of the other candidate, although they were not required to do so. The Mayor reminded the Aldermen that if they had any issues or relationships, such as personal attorney, lawsuits, etc. with any of the candidates they should disclose them at this time. He said that after the interviews the aldermen would vote by paper ballot for the candidate of their choice. If there is not a clear majority after the first ballot, those receiving the least amount of votes, or no vote, would be eliminated, and balloting would continue until a candidate received a majority vote. Aldermen proceeded with the interviews, with each candidate leaving the room during the others’ interview. Upon completion of the interviews, a vote was taken by paper ballot by the five aldermen present. A tie vote resulted with Mr. Boisits and Mr. Berigan receiving two (2) votes each, with the other candidates eliminated. A second ballot resulted in a vote of three (3) for Mr. Boisits and two (2) for Mr. Berigan. Mr. Gerald Boisits received the majority vote to fill the unexpired term of Judge Peter Lentz. The Mayor thanked the candidates for applying and appearing for their interview, and stated he looked forward to the next election for Judge. Mr. Boisits was advised that he would take the Oath of Office at the Common Council meeting on Tuesday, June 12, 2001. Ald. Slocomb moved to adjourn at 9:00 PM. Ald.
