CM052201 COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF MEETING HELD MAY 22, 2001 Approved: June 12, 2001 The meeting was called to order at 7:44 PM by Mayor De Angelis. Also present were Ald. Slocomb, Le Doux, Patterson, Petfalski, Salentine, Sanders, and Wichgers, City Attorney Molter, Lakes Project Coordinator Zagar, and Deputy Clerk Blenski. The Deputy Clerk stated the meeting was noticed in accordance with the open meeting law on 5/18/2001 and 5/21/2001. Le Doux moved for approval of the 5/8/01 and 5/10/01 minutes. Salentine seconded; motion carried. The Deputy Clerk read the closed session notices. COMMUNICATIONS FROM THE MAYOR’S OFFICE Mayor De Angelis stated there was nothing new to report regarding the power plant issue. The City Hall Open House is scheduled for Saturday, June 2, 2001. The outdoor siren warning system has been installed and should be in operation by the end of the week. The Mayor also reminded everyone that Monday was Memorial Day. PERSONAL APPEARANCES State Senator Mary Lazich and State Representative Scott Gunderson were present to address concerns of City officials regarding issues at the state level that could impact the municipality. Ord. #1070 - An Ordinance to Amend Chapter 1 to Repeal Section 1.05(6)(g), and to Amend Chapter 10 to Repeal Section 10.05 and to Amend Section 10.06(5), and to Amend Chapter 18 to Repeal Section 18.60(3) and to Create Chapter 37 of the Municipal Code of the City of Muskego (Trees). First Reading. Mr. Zagar was present to review the proposed ordinance with the Council. Slocomb stated he supported the permit referred to in Section 37.07 but objected to the accompanying fee. Discussion also took place regarding entering private property and obtaining permission. Slocomb recommended that the words, “disobeys, omits, neglects, refuses to comply with, or who resists the enforcement of” referred to in Section 37.12 be stricken. Mr. Zagar will prepare proposed changes for second reading. He was dismissed. Wichgers moved to convene into closed session pursuant to §19.85(1)(e) Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session; more specifically Carity land purchase for community center site. Petfalski seconded. Motion carried 7-0. Atty. Feeley, who is representing the City on this issue, was present for closed session. The Deputy and Atty. Molter were not present. Following closed session Atty. Feeley was dismissed. Slocomb seconded. Motion carried 7-0. Atty. Molter was present for closed session. Petfalski moved to reconvene into open session with the Deputy present. Le Doux seconded. Motion carried 7-0. Reso. #107-2001 - Amendment to Offer to Purchase - Pioneer Drive Property. Le Doux moved for adoption. Salentine seconded. Motion carried 7-0. Ord. #1069 - An Ordinance to Create Chapter 38 of the Municipal Code of the City of Muskego (Non-Metallic Mining Reclamation). Second Reading. Slocomb moved for adoption. Salentine seconded. Petfalski moved to amend to add that the ordinance would be in effect as of 6/1/2001 and to replace “the date of the adoption of this Ordinance“ with “August 1, 2001” referred to in Section 38.03 (3)(b) Existing Mines. Sanders seconded; motion carried. Ord. #1069, as amended, adopted 7-0. Atty. Molter was dismissed. COMMITTEE REPORTS Slocomb moved for acceptance of the 5/16/2001 and 5/22/2001 Finance Committee minutes. Sanders seconded; motion carried. Patterson moved for acceptance of the 5/7/2001 Public Services Committee minutes. Le Doux seconded; motion carried. Minutes of the 5/15/2001 Plan Commission and 5/14/2001 Parks and Recreation Board were received and placed on file. Reso. #45-2001 - Approval of Cash Deposit Agreement - Verizon Wireless, on the floor, deferred 5/8/2001. Slocomb moved to defer. Salentine seconded; motion carried. Reso. #89-2001 - Appointment of Citizen Member to Future Parkland Development Standing Committee (B. Konkel), on the floor, deferred 5/8/2001. Motion carried 7-0. Reso. #95-2001 - Resolution to Adopt the 2001 - 2005 Park and Open Space Plan, on the floor, deferred 5/8/01. The revisions to the Plan have not been completed. Slocomb moved to defer. Le Doux seconded; motion carried. Ord. #1066 - An Ordinance to Amend the Zoning Map and 2010 Comprehensive Plan of the City of Muskego (Tess Corners Volunteer Fire Department - RSE and A to RSE/A/OIP), on the floor, deferred 5/8/2001. Ord. #1068 - An Ordinance to Amend Chapter 1, Section 1.09(1) of the Municipal Code of the City of Muskego (Location of Polling Places). Second Reading. Sanders moved for adoption. Salentine seconded. Motion carried 7-0. Reso. #102-2001 - Resolution to Establish Fees (Nonmetallic Mining Reclamation). Slocomb moved for adoption. Petfalski seconded. Motion carried 7-0. Reso. #103-2001 - Establishing Traffic Regulations. Patterson moved for adoption. Wichgers seconded. Motion carried 7-0. Reso. #104-2001 - Disallowance of Claim - Petershack. Reso. #108-2001 - Reapproval of Developer’s Agreement and Letter of Credit for Sarah Estates. Salentine moved for adoption. Slocomb seconded. Motion carried 7-0. Reso. #109-2001 - Amendment to Deposit and Forfeiture Schedule. Petfalski moved for adoption. Sanders seconded. Motion carried 7-0. Reso. #110-2001 - Resolution in Support of Assembly Bill 399. Petfalski moved for adoption. Patterson seconded. Motion carried 7-0. Reso. #111-2001 - Offer to Purchase - Carity - Community Center. This item was removed. Ord. #1071 - An Ordinance to Amend the Zoning Map of the City of Muskego (W180 S7677 Pioneer Drive - B-3 to B-3/OIP). First Reading. LICENSES Slocomb moved to approve Operators’ Licenses for John Belot, Andrea Scheffler, Donna Tipton, Amy Haefner and Gretchen Seeker. Sanders seconded; motion carried. Slocomb moved to approve Salvage and Recycling Permit for Kohne Salvage. Sanders seconded; motion carried. Petfalski seconded; motion carried. VOUCHER APPROVAL Slocomb moved for approval of payment of General Vouchers in the amount of $883,671.92. Wichgers seconded. Motion carried 7-0. Slocomb moved for approval of tax checks in the amount of $26.89. Le Doux seconded. Motion carried 7-0. Sanders moved for approval of payment of Utility Vouchers in the amount of $267,190.66. Petfalski seconded. Motion carried 7-0. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW The City Hall Landscape Plan was reviewed. Signage will be completed as a separate project. It is anticipated that bids will be open prior to the Council’s next meeting. Discussion took place regarding the selection process to replace the municipal judge who is resigning as of 6/15/2001. Petfalski stated one option was to have another judge fill in temporarily until the Spring 2002 election. The consensus of the Council was to request applications to fill the position. Ald. Slocomb will gather interview questions. He and the Mayor will meet with Judge Lentz. The deadline for application submittal will be Friday, 6/8/2001. A special Council meeting was tentatively scheduled for 6/12/2001 at 6:00 PM. Sanders moved to adjourn at 11:53 PM. Petfalski seconded; motion carried. Minutes taken and transcribed by J. Blenski.
