CM050801 COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF MEETING HELD MAY 8, 2001 Approved: May 22, 2001 The meeting was called to order at 7:47 PM by Mayor De Angelis. Also present were Ald. Slocomb, Le Doux, Patterson, Petfalski, Salentine, Sanders, and Wichgers, City Attorney Molter, Engineering/Building Inspection Director McMullen, Lakes Project Coordinator Zagar, Clerk-Treasurer Marenda, and Deputy Clerk Blenski. The Clerk stated the meeting was noticed in accordance with the open meeting law on 5/4/2001. Salentine moved for approval of the 4/24/01 minutes. Sanders seconded; motion carried. The Clerk-Treasurer read the notice of closed session. COMMUNICATIONS FROM THE MAYOR’S OFFICE Mayor De Angelis read Proclamations for Peace Officers’ Memorial Day and Police Week (5/13 - 5/19) and American Legion Poppy Days (5/18 and 5/19). The Mayor gave an update regarding the power plant issue. Midwest Power has listed Muskego as an alternate site on the application to locate in New Berlin. No application has been made to Muskego; no informational public hearings have been requested to be scheduled here. An application may be submitted soon by El Paso Power to locate at the Payne & Dolan site. The Mayor also presented a draft of the notice for the City Hall Open House to be held 6/2 from 10:00 AM to 1:00 PM. PERSONAL APPEARANCES State Representative Mark Gundrum was present to respond to concerns of City officials regarding issues at the state level that could impact the municipality. Reso. #99-2001 - Approval of Letter of Credit - Telecorp Communications, Inc. Salentine moved for adoption. Sanders seconded. Salentine moved to amend to include “in consultation with the Mayor” at the end of the paragraph. Sanders seconded; motion carried. This will allow the specific language to be determined by Mayor and City Attorney. Motion to adopt Reso. #99-2001, as amended, carried 7-0. Reso. #95-2001 - Resolution to Adopt the 2001 - 2005 Park and Open Space Plan. Petfalski moved for adoption. Salentine seconded. Mr. Zagar presented the highlights of the plan. He stated the previous plan was prepared by SEWRPC in 1993. The Parks & Recreation Board and Plan Commission have reviewed the proposed Plan and have recommended adoption. The Plan provides eligibility to receive grant funds. Discussion took place about certain issues, such as the need for hockey facilities and equestrian trails. The Council requested the following revisions: remove ice rink at Veterans Memorial Park, change references to bike/pedestrian paths to recreational trails, encourage equestrian use on recreational trail system. The Mayor also noted the Common Council Minutes Page 2 May 8, 2001 school district requested that the City consider a pedestrian path along Bay Lane from Janesville to Woods. Slocomb moved to defer. Petfalski seconded; motion carried. The Council did not need to convene into closed session. Reso. #92-2001 - Offer to Purchase - Somogji. Salentine moved for adoption. Le Doux seconded. Petfalski moved to amend the Offer as follows: insert May 16 acceptance date; insert May 31 closing date; line 293, insert see attached Addendum Item No. 4; add Addendum Item No. 4 regarding occupancy by Somogji until 7/1 with insurance required. Salentine seconded; motion carried. Reso. #92-2001, as amended, adopted 7-0. Reso. #93-2001 - Rejection of Bids - Veterans Memorial Park Pavilion. Le Doux moved for adoption. Slocomb seconded. Mr. McMullen stated that the specifications can be modified to reduce the total cost of the project. It will then be rebid. He will meet with all parties involved to clarify the project specifications. Motion carried 7-0. Mr. McMullen was dismissed. Reso. #96-2001 - Accepting Muskego Sun as the Official Newspaper of the City of Muskego. Salentine moved for adoption. Patterson seconded. The Mayor stated this item came from the Finance Committee without a recommendation. City officials have been very dissatisfied with the reporting accuracy of the paper. Slocomb expressed concern that the inaccuracy will eventually be reflected in publication of the City’s legal notices. Atty. Molter noted that state statutes define the criteria for a publication to be eligible to submit a bid as a municipality’s official newspaper. It appears the Sun is the only publication eligible to bid. Motion carried 7-0. Ord. #1069 - An Ordinance to Create Chapter 38 of the Municipal Code of the City of Muskego (Non-Metallic Mining Reclamation). First Reading. Atty. Molter stated that there will be a revised version at the time of second reading which will include changes recommended by the DNR. Atty. Molter was dismissed. COMMITTEE REPORTS Slocomb moved for acceptance of the 5/2/2001 and 5/8/2001 Finance Committee minutes. Salentine seconded; motion carried. Salentine moved for acceptance of the 4/23/2001 Public Works Committee minutes. Petfalski seconded; motion carried. Sanders moved for acceptance of the 4/23/2001 Public Utilities Committee minutes. Le Doux seconded; motion carried. Minutes of the 5/1/2001 Plan Commission and 4/25/2001 Library Board were received and placed on file. OLD BUSINESS Common Council Minutes Page 3 May 8, 2001 Reso. #45-2001 - Approval of Cash Deposit Agreement - Verizon Wireless, on the floor, deferred 4/24/2001. Slocomb moved to defer. Le Doux seconded; motion carried. Reso. #89-2001 - Appointment of Citizen Member to Future Parkland Development Standing Committee on the floor, deferred 4/24/2001. Salentine moved to defer. Slocomb seconded; motion carried. Ord. #1066 - An Ordinance to Amend the Zoning Map and 2010 Comprehensive Plan of the City of Muskego (Tess Corners Volunteer Fire Department - RSE and A to RSE/A/OIP), on the floor, deferred 4/24/2001. Le Doux moved to defer. Patterson seconded; motion carried. Sanders acknowledged information provided by the Assessor. He requested the other documentation that was previously requested at the public hearing. Reso. #94-2001 - Appointment of Citizen Member to the Board of Appeals (D. Schepp). Wichgers moved for adoption. Le Doux seconded. Motion carried 7-0. Reso. #97-2001 - Disallowance of Claim - Tricia Neary. Slocomb moved for adoption. Wichgers seconded. Motion carried 7-0. Reso. #98-2001 - Acceptance of Improvements - Sanitary Sewer/Force Main - Salentine/Loughney. Sanders moved for adoption. Salentine seconded. Motion carried 7-0. Reso. #100-2001 - Acceptance of Proposal for Customer Service Training. Salentine moved for adoption. Le Doux seconded. Discussion took place with Patterson expressing concern about the long-term effectiveness of the training. He stated reinforcement was necessary or it may be lost over a period of time. Wichgers also expressed concern about the cost of the program and if the company chosen can provide the type of training specific to the needs of the City. Petfalski stated he supports. He believes the reinforcement may come automatically as a result of the training making employees’ jobs easier. The Clerk-Treasurer also noted her support. She stated it is up to department heads to initiate reinforcement with staff. Petfalski called for the question. There were no objections. Motion carried 6 in favor and Patterson voting against. Ord. #1068 - An Ordinance to Amend Chapter 1, Section 1.09(1) of the Municipal Code of the City of Muskego (Location of Polling Places). First Reading. There were no licenses to approve. VOUCHER APPROVAL Slocomb moved for approval of payment of General Vouchers in the amount of $583,862.60. Sanders seconded. Motion carried 7-0. Slocomb moved for approval of Common Council Minutes Page 4 May 8, 2001 tax checks in the amount of $1,442,555.54. Sanders seconded. Motion carried 7-0. Sanders moved for approval of payment of Utility Vouchers in the amount of $255,227.82. Le Doux seconded. Motion carried 7-0. CITY OFFICIALS’ REPORTS The Clerk-Treasurer noted the following public hearings would be held on 5/22: 7:20 PM to consider amendment to Chapter 18 relating to street tree requirements; 7:25 PM to consider petition to rezone property located on Pioneer Drive (Tax Key No. 2195.960) from B-3 to B-3/OIP. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW The Clerk-Treasurer noted that the Special Council and Committee of the Whole meetings were scheduled for 5/10/01.
