COMMON COUNCIL - CITY OF MUSKEGO
MINUTES OF MEETING HELD DECEMBER 12, 2000

The meeting was called to order at 7:54 p.m. by Mayor De Angelis. Also present were
Ald. Slocomb, Chiaverotti, Le Doux, Patterson, Sanders and Wichgers,
Engineering/Building Inspection Director McMullen, Plan Director Turk, City Attorney
Molter, Clerk-Treasurer Marenda, and Deputy Clerk Blenski. Ald. Salentine was
excused. The Clerk-Treasurer stated the meeting was noticed in accordance with the
open meeting law on 12/8/2000.
Slocomb moved for approval of minutes of 11/28/00. Sanders seconded; motion
carried.
The Clerk-Treasurer read the notice of closed session.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
The Mayor commended the Parks and Recreation Department for providing the
community with a festive tree lighting ceremony this year. He noted that winter parking
restrictions are in effect.
Reso. 253-2000 - Honoring City of Muskego Eagle Scout Steven Rabe. Le Doux
moved for adoption. Chiaverotti seconded. Motion carried 6-0. The Mayor presented
the resolution to Steven and applauded his efforts. Steven related information about
what was accomplished through his Eagle Scout project.
It was determined that continued review of the 2010 Comprehensive Plan would take
place at the Committee of the Whole level; Mr. Turk was dismissed.
Sanders moved to convene into closed session pursuant to §19.85(1)(e) Deliberating
or negotiating the purchasing of public properties, the investing of public funds, or
conducting other specified public business, whenever competitive or bargaining
reasons require a closed session; more specifically land purchase for community
center site. Le Doux seconded. Motion carried 6-0. Atty. Feeley, who is representing
the City on this issue, was present for closed session. The Clerk, Deputy and Atty.
Molter were not present.
Slocomb moved to reconvene into open session. Patterson seconded. Motion carried
6-0. Atty. Feeley was dismissed.
Reso. #261-2000 - Approval of Construction Agreement and Letter of Credit for
Improvements on Woods Road - Candlewood Creek. Sanders moved for adoption.
Slocomb seconded. Motion carried 6-0.
Ord. #1050 - An Ordinance to Amend the Zoning Map of the City of Muskego (RCE to
RCE/OIP - Denoon Park Expansion). First Reading.

Ord. #1051 - An Ordinance to Amend Chapter 9, Sections 9.14(2), 9.14(3)(a) and
9.14(3)(c) of the Municipal Code of the City of Muskego (Open Fires Restricted). First
Reading.
Ord. #1052 - An Ordinance to Amend the Zoning Map of the City of Muskego (B-3, RS-
1 and RSE to B-3/OPD). First Reading.
No additional information was requested regarding the ordinances. Atty. Molter was
dismissed at 9:01 p.m.
COMMITTEE REPORTS
Slocomb moved for acceptance of the 12/6/2000 and 12/12/2000 Finance Committee
minutes. He noted that the 12/6 minutes were corrected regarding the Prepaid Legal
Services Program to reflect that employees can sign up on a month-to-month basis.
Sanders seconded; motion carried.
Chiaverotti moved for acceptance of the 11/27/2000 Public Works Committee minutes.
Patterson seconded; motion carried.
Patterson moved for acceptance of the 12/4/2000 Public Services Committee minutes.
Le Doux seconded; motion carried.
Minutes of the 12/05/2000 Plan Commission were received and placed on file.
Reso. #134-2000 - Establish Traffic Regulations, on the floor, deferred 11/28/2000.
Chiaverotti moved to defer. Wichgers seconded; motion carried.
Reso. #206-2000 - Approval of Cable Television Franchise Agreement with Digital
Access of Wisconsin, Inc., on the floor, deferred 11/28/2000. Patterson moved to
defer. Le Doux seconded; motion carried.
Ord. #1042 - An Ordinance to Adopt the 2010 Comprehensive Plan for the City of
Muskego, on the floor, deferred 11/28/2000. Slocomb moved to defer. Patterson
seconded; motion carried.
Ord. #1044 - An Ordinance to Repeal and Recreate Chapter 31 of the Municipal Code
of the City of Muskego (Cable Television Franchise), on the floor, deferred 11/28/00.
Patterson moved to defer. Le Doux seconded; motion carried.
Reso. #245-2000 - Approval of Fire Protection Agreement with Muskego Volunteer Fire
Company for 2001 (Possible Reconsideration). The Mayor stated that the fire company
is requesting an amendment to the 2001 Agreement so that the first quarter payment
would include the yearly stipend for their members. If the fire company makes the
payments to its membership without receiving the money from the City, cash reserves
would be depleted. Sanders stated he supports this time but would like the issue
handled differently in the future. Patterson stated the fire company is trying to pay its
people. The problem will be the same every year if the City makes equal installment
payments. The fire company is comprised of volunteers. He supports the amendment;
it will not impact the City. Chiaverotti moved to reconsider Reso. #245-2000.
Patterson seconded. Motion carried 6-0. Slocomb stated this issue was never brought

up at budget time. This does impact the City because there is a cost. Patterson
suggested first quarterly payment of 2001 reflect yearly stipend subject to the City
paying the stipend amount over the first two quarters of 2002. Patterson moved to
defer to 1/9/01 meeting so fire company could provide input. Chiaverotti seconded;
motion carried.
Reso. #254-2000 - Approval of Health Insurance Contract for 2001. Sanders moved for
adoption. Slocomb seconded. Motion carried 6-0.
Reso. #255-2000 - Approval of Dental Insurance Contract for 2001. Sanders moved for
adoption. Le Doux seconded. Motion carried 6-0.
Reso. #256-2000 - Approval of Cleaning Service Contract for 2001. Slocomb moved
for adoption to approve Jani King Cleaning Service. Patterson seconded. Motion
carried 6-0.
Reso. #257-2000 - Approval of Cooperative Agreement between the City of Muskego
and Waukesha County Department of Aging. Slocomb moved for adoption. Sanders
seconded. Motion carried 6-0.
Reso. #258-2000 - Resolution Declaring Certain Delinquent Personal Property Taxes
to be Uncollectibe. Slocomb moved for adoption. Sanders seconded. Motion carried
6-0.
Reso. #259-2000 - Authorize Distribution of Tax Incremental Districts #4 and #6 Funds.
Sanders moved for adoption. Le Doux seconded. Motion carried 6-0.
Reso. #260-2000 - Nomination of Election Officials by Mayor of the City of Muskego.
Sanders moved for adoption. Slocomb seconded. Motion carried 6-0.
Reso. #262-2000 - Approval of Certified Survey Map - Scholbe. Chiaverotti moved for
adoption. Slocomb seconded. Motion carried 6-0.
Reso. #263-2000 - Offer to Purchase (Community Center). Removed from agenda.
LICENSES
Slocomb moved to approve an Operator’s Licenses for Timothy Heschke, Natalie
Rawski, and Elizabeth Leonard. Sanders seconded; motion carried.
Slocomb moved to approve change of agent for Favre & Associates LLC (Broke Spoke)
to Peter D’amico. Sanders seconded. Motion carried 6-0.
VOUCHER APPROVAL
Slocomb moved for approval of payment of General Vouchers in the amount of
$1,822,831.59. Sanders seconded. Motion carried 6-0. Slocomb moved for approval
of Tax Checks in the amount of $485. Sanders seconded. Motion carried 6-0.

Sanders moved for approval of payment of Utility Vouchers in the amount of
$114,307.50. Le Doux seconded. Motion carried 6-0.
CITY OFFICIALS’ REPORT
The Clerk-Treasurer announced that the following public hearings were scheduled for
1/9/2001: 7:20 p.m. rezoning petition of Doug Friedrich for property in the NW 1/4 of
Section 24 from RS-2/OLS to RS-2 and 7:25 p.m. rezoning petition of Laurel Kaebisch
for property in the SE 1/4 of the NW 1/4 of Section 29 from EA/OOS to A.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
A draft of the January calendar was reviewed. The Mayor noted that the Conservation
Plan Open House was scheduled for Wednesday, 12/13 from 5:30 to 8:30 p.m.
Slocomb moved to adjourn at 9:50 p.m. Chiaverotti seconded; motion carried.
