COMMON COUNCIL - CITY OF MUSKEGO
MINUTES OF MEETING HELD NOVEMBER 28, 2000

The meeting was called to order at 8:25 p.m. by Mayor De Angelis. Also present were
Ald. Slocomb, Chiaverotti, Le Doux, Patterson, Salentine, Sanders and Wichgers,
Engineering/Building Inspection Director McMullen, Plan Director Turk, City Attorney
Molter, Clerk-Treasurer Marenda, and Deputy Clerk Blenski. The Clerk-Treasurer
stated the meeting was noticed in accordance with the open meeting law on
11/22/2000.
Sanders moved for approval of minutes of 11/14/00. Salentine seconded; motion
carried.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
The Mayor stated that the City of New Berlin is putting a task force together to
determine water source needs in conjunction with the proposed power plant. Muskego
will have a member sit on the task force. A joint Public Works Committee meeting will
be held with the City of New Berlin. The Mayor reported he would attend a hearing at
MMSD regarding proposed 2020 policy statement. The Land Conservation Committee
will hold open houses on 12/13 and 1/24. The Christmas Tree Lighting will take place
from 3:30 to 5:30 p.m. at the Muskego Public Library on 12/3.
Mr. McMullen reviewed Council table options and other details regarding the renovation
of the Muskego Room with the aldermen.
Reso. #202-2000 - Resolution as to Offer to Purchase – Sewer Utility Easements –
Superior Emerald Park, on the floor, deferred 11/14/2000. Atty. Molter stated he was in
the process of revising the documents to include some minor technical changes. Mr.
McMullen presented a possible time frame for the project. Motion to adopt carried 7-0.
Reso. #237-2000 - Approval of Amendment to Agreement Creating the Linnie Lac
Sanitary Sewer District By and Between the City of Muskego and the City of New
Berlin. The amendment would allow sewer service to two New Berlin properties.
Sanders moved for adoption. Salentine seconded. Motion carried 7-0. Mr. McMullen
was dismissed at 9:06 p.m.
Ord. #1048 - An Ordinance to Repeal Ordinance #1034 as to the Implementation of
Certain Aspects of Wisconsin Administrative Code COMM 83. Second Reading.
Slocomb moved for adoption. Sanders seconded. Motion carried 7-0.
Ord. #1049 - An Ordinance to Amend Chapter 21, Section 21.05 (2)(b) of the Municipal
Code of the City of Muskego. Second Reading. Sanders moved for adoption. Le Doux
seconded. Motion carried 7-0.
Reso. #243-2000 - Resolution of Necessity (Park Acquisition). Salentine moved for
adoption. Slocomb seconded. Motion carried 7-0.

Reso. #244-2000 - Authorizing the Hiring of an Appraiser and Relocation Expert to
Carry Out Resolution of Necessity Known as Resolution #243-2000 (Park Acquisition).
Sanders moved for adoption. Le Doux seconded. Motion carried 7-0.
The City Attorney was dismissed at 9:17 p.m.
Ord. #1042 - An Ordinance to Adopt the 2010 Comprehensive Plan for the City of
Muskego, on the floor, deferred 11/14/2000. Council members continued their review
of the plan with Plan Director Turk beginning with Utilities on 6-9. Discussion took
place regarding consideration to waive deferred interest on utility assessments for land
held in agricultural use. Mr. Turk will provide cost estimates at next meeting.
Patterson moved to defer. Le Doux seconded; motion carried.
Under discussion of the December calendar, it was determined that a Committee of the
Whole meeting would be scheduled for 12/7 to continue review of the 2010 Comp Plan.
Other meeting changes were made because the 12/26 Council meeting will not be held.
Reso. #247-2000 - Approval of a Preliminary Plat - The Reserve at Champions Village.
Chiaverotti moved for adoption. Salentine seconded. Motion carried 7-0. Mr. Turk
was dismissed.
COMMITTEE REPORTS
Slocomb moved for acceptance of the 11/28/2000 Finance Committee minutes.
Sanders seconded; motion carried.
Sanders moved for acceptance of the 11/16/2000 Public Utilities Committee minutes.
Chiaverotti seconded; motion carried.
Minutes of the 11/13/2000 Parks & Recreation Board and 11/21/2000 Plan Commission
were received and placed on file.
Reso. #134-2000 - Establish Traffic Regulations, on the floor, deferred 11/14/2000.
Chiaverotti moved to defer. Sanders seconded; motion carried.
Reso. #206-2000 - Approval of Cable Television Franchise Agreement with Digital
Access of Wisconsin, Inc., on the floor, deferred 11/14/2000. Patterson moved to
defer. Le Doux seconded; motion carried.
Ord. #1044 - An Ordinance to Repeal and Recreate Chapter 31 of the Municipal Code
of the City of Muskego (Cable Television Franchise), on the floor, deferred 11/14/00.
Slocomb moved to defer. Salentine seconded; motion carried.
Ord. #1047 - An Ordinance to Amend Chapter 1, Sections 1.09 (2) and 1.09 (4) of the
Municipal Code of the City of Muskego (Elections). Second Reading. Le Doux moved
for adoption. Chiaverotti seconded. Motion carried 7-0.
Reso. #238-2000 - Approval of 2001 Water Utility Budget. Sanders moved for
adoption. Le Doux seconded. Motion carried 7-0.

adoption. Le Doux seconded. Motion carried 7-0.
Reso. #240-2000 - Designating Public Depositories and Authorizing Withdrawal of City
of Muskego Monies. Sanders moved for adoption. Salentine seconded. Motion
carried 7-0.
Reso. #241-2000 - Resolution Authorizing the Mayor to Approve Vouchers. Slocomb
moved for adoption. Le Doux seconded. Motion carried 7-0.
Reso. #242-2000 - Approval of Carriers for City’s Insurance for 2001. Sanders moved
for adoption. Salentine seconded. Mayor reported there will be a change in carrier
from Wausau to Kempes. Motion carried 7-0.
Reso. #245-2000 - Approval of Fire Protection Agreement with Muskego Volunteer Fire
Company for 2001. Salentine moved for adoption. Le Doux seconded. Motion carried
7-0.
Reso. #246-2000 - Approval of Fire Protection Agreement with Tess Corners Fire
Department for 2001. Slocomb moved for adoption. Patterson seconded. Motion
carried 7-0.
Reso. #248-2000 - Resolution Adopting a Joint Powers Agreement for the 911
Emergency System with Waukesha County. Salentine moved for adoption. Le Doux
seconded. Motion carried 7-0.
Reso. #249-2000 - Resolution Establishing Salaries. Salentine moved for adoption.

Reso. #250-2000 - Approve New and Revised Positions. Salentine moved for

(Revolving Loan Fund) Loan. Sanders moved for adoption. Salentine seconded.
Motion carried 7-0.
Reso. #252-2000 - Appointment of Citizen Member to Plan Commission (Harry Brodel).
Salentine moved for adoption. Sanders seconded. Motion carried 7-0.
LICENSES
Slocomb moved to approve an Operator’s Licenses for Kathleen Farber. Sanders
seconded; motion carried.
VOUCHER APPROVAL
Slocomb moved for approval of payment of General Vouchers in the amount of
$2,477,251.63. Salentine seconded. Motion carried 7-0. Sanders moved for approval

of payment of Utility Vouchers in the amount of $274,907.67. Le Doux seconded.
Motion carried 7-0.
Slocomb moved to convene into closed session pursuant to §19.85(1)(e) Deliberating
or negotiating the purchasing of public properties, the investing of public funds, or
conducting other specified public business, whenever competitive or bargaining
reasons require a closed session; more specifically land purchase for community
center site. Salentine seconded. Motion carried 7-0. The Clerk-Treasurer and Deputy
were dismissed.
Patterson moved to reconvene into open session. Slocomb seconded. Motion carried
7-0. Sanders moved to adjourn at 11:07 p.m. Slocomb seconded; motion carried.
