CM111400 COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF MEETING HELD NOVEMBER 14, 2000 Approved November 28, 2000 The meeting was called to order at 7:34 p.m. by Mayor De Angelis. Also present were Ald. Slocomb, Chiaverotti, Le Doux, Patterson, Salentine, Sanders and Wichgers, Engineering/Building Inspection Director McMullen, Plan Director Turk, City Attorney Trindl, and Deputy Clerk Blenski. The Deputy Clerk stated the meeting was noticed in accordance with the open meeting law on 11/10/2000. Chiaverotti moved for approval of minutes of 10/24/00 and 10/27/00. Sanders seconded; motion carried. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor stated a group is being formed to review facilities for the proposed Community Center. Ald. Chiaverotti, Ald. Salentine and Parks & Recreation Director Anderson will be working with people from Mr. Warsha’s group on this effort. Facilities in other communities are being looked at. Reso. #222-2000 - Honoring Muskego AFS-USA Student Birte Kyrkjeteig. Salentine moved for adoption. Patterson seconded. Motion carried 7-0. The Resolution was presented to Birte. COMMITTEE REPORTS Salentine moved for acceptance of the 11/8/2000 and 11/14/2000 Finance Committee minutes. Sanders seconded; motion carried. Le Doux moved for acceptance of the 11/6/2000 Public Services Committee minutes. Patterson seconded; motion carried. Salentine moved for acceptance of the 10/23/2000 Public Works Committee minutes. Chiaverotti seconded; motion carried. Minutes of the 10/25/2000 Library Board and 11/7/2000 Plan Commission were received and placed on file. Reso. #226-2000 - Approval of Certified Survey Map - Loebel. Chiaverotti moved for adoption. Sanders seconded. Motion carried 7-0. Reso. #134-2000 - Establish Traffic Regulations, on the floor, deferred 10/24/2000. Chiaverotti moved to defer. Sanders seconded; motion carried. Reso. #202-2000 - Resolution as to Offer to Purchase – Sewer Utility Easements – Superior Emerald Park, on the floor, deferred 10/24/2000. Mr. McMullen stated that a revised Offer is being prepared. Reso. #206-2000 - Approval of Cable Television Franchise Agreement with Digital Access of Wisconsin, Inc., on the floor, deferred 10/24/2000. Patterson moved to defer. Common Council Minutes Page 2 November 14, 2000 Ord. #934 - An Ordinance to Amend Chapter 14, to Add Section 1.5(2)(n), of the Municipal Code of the City of Muskego Floodplain Zoning Ordinance: Official Map (Plum Creek), on the floor, deferred 9/12/2000. Mr. McMullen stated map would not be ready until January. Sanders moved to defer to January 9, 2001 meeting. Slocomb seconded; motion carried. Ord. #1032 - An Ordinance to Amend Chapter 14, to Add Section 1.5(2)(o) of the Municipal Code of the City of Muskego Floodplain Zoning Ordinance: Official Map (Jewel Creek), on the floor, deferred 10/24/2000. Mr. McMullen presented revised map and stated DNR approval has been received. Slocomb moved to amend section reference to 1.52(2)(n) instead of 1.52(2)(o) and to correct map date to November 14, 2000. Le Doux seconded; motion carried. Ord. #1032, as amended, adopted 7-0. Mr. McMullen was dismissed. Ord. #1037 - An Ordinance to Amend the Zoning Map of the City of Muskego (Tess Corners Volunteer Fire Department - RSE to RSE/OIP), on the floor, deferred 10/24/2000. Mr. Turk stated this issue has been finalized. Ord. #1037 adopted 7-0. Reso. #223-2000 - Appropriating the Necessary Funds for the Operation of the Government and Administration of the City of Muskego for the Year 2001. Slocomb moved for adoption. Salentine seconded. Finance Director Gunderson noted the budget resolution has been corrected to reflect inclusion of the Capital Budget items as discussed at the public hearing. The 2000 tax rate is $5.96 per $1,000. Motion carried 7-0. Reso. #224-2000 - Approval of 2001 Capital Budget ($2,278,334). Slocomb moved for adoption. Le Doux seconded. Motion carried 7-0. Ord. #1046 - An Ordinance to Establish Salaries for Elected Officials (Aldermen Districts 2, 4, 6 and 7). Second Reading. Le Doux moved for adoption. Slocomb seconded. Salentine moved to increase the additional money paid annually to the Council President from $400 to $600 in addition to establishing a 2001 biweekly salary of $286.62 and a 2002 biweekly salary of $293.79 for the 2001-2003 term. Finance Director Gunderson stated that the increased biweekly rate for Council President for the term would be $23.08. Le Doux seconded; motion carried with 6 in favor and Patterson voting “no.” Ord. #1046, as amended, adopted 6 in favor and Patterson voting “no.” The Finance Director was dismissed. Ord. #1042 – An Ordinance to Adopt the 2010 Comprehensive Plan for the City of Muskego, on the floor, deferred 10/24/00. Council members continued review of the Plan with Mr. Turk beginning with Page 6-2 Economic Development. Slocomb stated that the language as written in Issue 2 on Page 6-3 was contradictory and needed to be changed. Mr. Turk stated clarification could be accomplished. The issue of rezoning properties in the vicinity of Moorland Road and College Avenue (the first Implementation Strategy on Page 6-6) was discussed at great length. Wichgers stated that his constituency did not want the Moorland Road area rezoned to a Business Park District. They have requested that the 2010 Comp Plan reflect a residential use in that Common Council Minutes Page 3 November 14, 2000 area and do not believe the zoning should be changed until after 2010. Slocomb stated this Council couldn’t determine the actions of future Councils. It was noted that the words, “based upon acceptable Building Site and Operation Plans” should be added to that section as they appear in other rezoning recommendations contained in the Plan; Mr. Turk stated that also reflects the actions of the Plan Commission when rezoning petitions are reviewed. Regarding Issue 1 on Page 6-8, Wichgers noted that his constituents also have concerns about expediting the southern extension of Moorland Road. Salentine stated that the expedition is necessary so the City will obtain jurisdiction of the road. If under the County’s control, truck traffic would be allowed. The Council completed the review of the Plan just prior to Utilities on Page 6- 9. Slocomb moved to defer. Le Doux seconded; motion carried. Mr. Turk was dismissed. Ord. #1044 - An Ordinance to Repeal and Recreate Chapter 31 of the Municipal Code of the City of Muskego (Cable Television Franchise), on the floor, deferred 10/24/00. Patterson moved to defer. Motion carried 7-0. Reso. #233-2000 - Authorizing the Hiring of an Appraiser and Relocation Expert to Carry Out Amended Relocation Order Known as Resolution #232-2000. Sanders moved for adoption. Slocomb seconded. Motion carried 7-0. The Mayor stated an appraiser and relocation expert might not be needed for the project. Reso. #234-2000 - Authorizing Cancellation of Certain Uncollectible Accounts Receivable (Rescue). Salentine moved for adoption. Patterson seconded. Motion carried 7-0. Motion carried 7-0. Reso. #236-2000 - Determination of Substantial Change to Original Planned Unit Development for Champions Village of Country Club Villages. Salentine moved for adoption. Chiaverotti seconded. The Mayor stated the public hearing was scheduled for 11/28/2000. Slocomb asked why a public hearing was required since the proposed change would reduce the density of the development. The Mayor responded our ordinance required it. Motion carried 7-0. Ord. #1047 - An Ordinance to Amend Chapter 1, Sections 1.09 (2) and 1.09 (4) of the Municipal Code of the City of Muskego (Elections). First Reading. Ord. #1048 - An Ordinance to Repeal Ordinance #1034 as to the Implementation of Certain Aspects of Wisconsin Administrative Code COMM 83. First Reading. Ord. #1049 - An Ordinance to Amend Chapter 21, Section 21.05 (2)(b) of the Municipal Code of the City of Muskego. First Reading. LICENSES Slocomb moved to approve an Operator’s Licenses for Sarah Deschane, Robert Chvosta, Michelle Peterson, and Kristina Swenson. Sanders seconded; motion carried. VOUCHER APPROVAL Slocomb moved for approval of payment of General Vouchers in the amount of $807,366.23. Salentine seconded. Motion carried 7-0. Sanders moved for approval of payment of Utility Vouchers in the amount of $281,616.42. Le Doux seconded. Motion carried 7-0.
