MINUTES OF MEETING HELD OCTOBER 10, 2000

The meeting was called to order at 7:31 p.m. by Mayor De Angelis. Also present were Ald.
Slocomb, Chiaverotti, Patterson, Salentine, and Wichgers, Engineering and Building
Inspection Director McMullen, City Attorney Molter, Clerk-Treasurer Marenda, and Deputy
Clerk Blenski. Ald. Sanders arrived after the closed session. The Clerk-Treasurer stated the
meeting was noticed in accordance with the open meeting law on 10/6/00.
Slocomb moved for approval of minutes of 9/26/00. Chiaverotti seconded; motion carried.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
The Mayor gave an update on repairs being done by WEPCO because of the outage that
occurred on Sunday. He also stated that he had met with members of the Muskego-Norway
School Board to discuss issues affecting both entities.
Patterson moved to convene into closed session pursuant to §19.85(1)(e) Deliberating or
negotiating the purchasing of public properties, the investing of public funds, or conducting
other specified public business, whenever competitive or bargaining reasons require a closed
session; more specifically contract with Digital Access of Wisconsin, Inc. Slocomb seconded;
motion carried 5-0. McMullen, Marenda, and Blenski were not present for closed session.
Slocomb moved to reconvene into open session. Salentine seconded. Motion carried 5-0.
Sanders arrived.
PERSONAL APPEARANCES
Mr. Robert Chernow, Chairman of the Regional Telecommunication Commission, was present
to discuss the proposed cable ordinance and agreement with Digital Access of Wisconsin. Mr.
Brian Nemoir (Digital Access) was scheduled to appear but was not in attendance. Mr.
Chernow stated that each municipality can use the ordinance and agreement as drafted, or
they can make amendments to include specifics for their community. Slocomb expressed
concern about the service area and stated he had not received a response from Mr. Nemoir
regarding several questions he asked. Mr. Chernow assured Slocomb he would receive
answers. He stated that Digital’s intent is to provide coverage to the municipality. One of the
benefits of the agreement is that Digital will provide connections between various facilities
throughout the City, including privately-owned schools and the fire department buildings, as
well as the municipal buildings. As there was no further discussion, Mr. Chernow was
dismissed at 8:46 p.m.
COMMITTEE REPORTS
Chiaverotti moved for acceptance of the 9/25/2000 and 10/2/2000 Public Works Committee
minutes. Patterson seconded; motion carried.
Patterson moved for acceptance of the 10/2/2000 Public Services Committee minutes.
Wichgers seconded. Sanders moved for individual consideration of paragraph on page 3
regarding “Horse Crossing” signs and requested the issue be further reviewed by the
Committee. Slocomb seconded; motion carried. Motion to accept minutes without said
paragraph carried.
Sanders moved for acceptance of the 10/4/2000 and 10/10/2000 Finance Committee minutes.
Salentine seconded; motion carried.

Minutes of the 9/27/2000 Library Board and 10/3/2000 Plan Commission were received and
placed on file.
OLD BUSINESS
Reso. #134-2000 - Establish Traffic Regulations, on the floor, deferred 9/26/2000. Chiaverotti
moved to defer. Sanders seconded; motion carried.
Ord. #1032 - An Ordinance to Amend Chapter 14, to Add Section 1.5(2)(o) of the Municipal
Code of the City of Muskego Floodplain Zoning Ordinance: Official Map (Jewel Creek), on the
floor, deferred 9/12/2000. Mr. McMullen stated the survey work is being done and the map
should be ready for the next Council meeting. Salentine moved to defer. Chiaverotti
seconded; motion carried.
Ord. #1037 - An Ordinance to Amend the Zoning Map of the City of Muskego (Tess Corners
Volunteer Fire Department - RSE to RSE/OIP), on the floor, deferred 9/26/00. Salentine
moved to defer. Patterson seconded; motion carried.
Ord. #1042 – An Ordinance to Adopt the 2010 Comprehensive Plan for the City of Muskego,
on the floor, deferred 9/26/00. Slocomb moved to defer. Patterson seconded; motion carried.
Ord. #1043 - An Ordinance to Amend Chapter 18, Section 18.23 of the Municipal Code of the
City of Muskego (Existing Substandard Lots). Second Reading. Chiaverotti moved for
adoption. Salentine seconded. Motion carried 6-0.
NEW BUSINESS
Reso. #198-2000 - Appointment to Library Board (Diane Dominski). Salentine moved for
adoption. Sanders seconded. Motion carried 6-0.
Reso. #199-2000 - Approval of Certified Survey Map - Krause. Chiaverotti moved for
adoption. Salentine seconded. Motion carried 6-0.
Reso. #200-2000 - Establish Traffic Regulations (Crowbar Rd). Patterson moved for adoption.
Sanders seconded. Mr. McMullen stated the no parking signage would be temporary. When
the road is repaved next year, parallel parking spaces would be added. Motion carried 6-0.
Reso. #201-2000 - Authorizing the Hiring of an Appraiser and Relocation Expert to Carry Out
Relocation Order Known as Resolution #197-2000 (Martin Drive). Slocomb moved for
adoption. Salentine seconded. Chiaverotti stated she is still uncertain about the proposed
realignment with Martin Drive (formerly Lakes Parkway). Atty. Molter encouraged the
acquisition process to continue as it will be very lengthy. Motion carried 6-0.
Reso. #202-2000 - Resolution as to Offer to Purchase - Sewer Utility Easements - Superior
Emerald Park. Slocomb moved for adoption. Sanders seconded. Slocomb moved to defer as
Superior was still reviewing the documents. Salentine seconded; motion carried.
Reso. #203-2000 - Resolution to Set Public Hearing Date for 2001 Budget (7:00 p.m. on
11/13/2000 at the Muskego Public Library). Salentine moved for adoption. Chiaverotti
seconded. Motion carried 6-0.
Reso. #204-2000 - Resolution to Repeal Review Fee (Review Fees - Plan Commission - Legal
Lot Status). Sanders moved for adoption. Salentine seconded. Motion carried 6-0.

Reso. #206-2000 - Approval of Cable Television Franchise Agreement with Digital Access of
Wisconsin, Inc. Slocomb moved for adoption. Sanders seconded. Patterson moved to defer.
Slocomb seconded; motion carried.
Ord. #1044 - An Ordinance to Repeal and Recreate Chapter 31 of the Municipal Code of the
City of Muskego (Cable Television Franchise). First Reading.
Ord. #1045 - An Ordinance to Amend Chapter 30, Sections 30.09, 30.091, 30.10 and 30.11 of
the Municipal Code of the City of Muskego (Municipal Building Code). First Reading. Mr.
McMullen stated several sections of the chapter needed clarification. Slocomb moved to
suspend the rules for second reading. Salentine seconded; motion carried. Second Reading.
Salentine moved for adoption. Slocomb seconded. Ord. #1045, adopted 6-0.
Reso. #205-2000 - Approval of Revised Settlement Agreement Between Parkland Venture
LLC and the City of Muskego. Patterson moved for adoption. Sanders seconded. Mr.
McMullen stated the details of the agreement were worked out between the attorneys for the
City and Parkland Ventures. Motion carried 6-0. Mr. McMullen was dismissed.
LICENSES
Slocomb moved to approve an Operator’s Licenses for Rodney Parker and Ronald Verhaalen.
Sanders seconded; motion carried.
Slocomb moved for approval of “Class B” Retailers’ License for VP Entertainment Corp. d/b/a
Pioneer Inn. Salentine seconded. Motion carried 6-0.
VOUCHER APPROVAL
Slocomb moved for approval of payment of General Vouchers in the amount of $342,026.75.
Sanders seconded. Motion carried 6-0. Sanders moved for approval of payment of Utility
Vouchers in the amount of $15,520.77. Slocomb seconded. Motion carried 6-0.
CITY OFFICIALS’ REPORTS
The Clerk-Treasurer announced that a public hearing was scheduled for 10/24/2000 at 7:25
p.m. to consider an amendment to Chapter 31 of the Municipal Code (Cable Television
Ordinance).
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
It was determined that Ald. Patterson and Slocomb would serve on the Lakes Fee Study
Committee with any other alderperson welcome to attend to obtain information. The initial
meeting scheduled for 10/11/2000 would be rescheduled. The Mayor stated that negotiations
with the Police Association would begin in the near future.
Slocomb moved to adjourn at 9:52 p.m. Patterson seconded; motion carried.
