CM062700 COMMON COUNCIL - CITY OF MUSKEGO (Approved 7/11/00) MINUTES OF MEETING HELD JUNE 27, 2000 The meeting was called to order at 8:39 p.m. by Mayor De Angelis. Also present were Ald. Slocomb, Chiaverotti, Le Doux, Patterson, Salentine, Sanders and Wichgers, City Attorney Molter, Clerk-Treasurer Marenda, Plan Director Turk, and Deputy Clerk Blenski. The Clerk- Treasurer stated the meeting was noticed in accordance with the open meeting law. Wichgers moved for approval of minutes of 6/13/00 with correction to be made that Salentine was not in attendance. Salentine seconded; motion carried. The Clerk-Treasurer read the notice of closed session. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor stated that the appointments to the Conservation Plan Committee have not been finalized. He appointed Ald. Le Doux to act as the Council Liaison to the Community Festival Committee in place of Ald. Chiaverotti because she has a conflict which will prevent her from serving on the Committee. The Mayor stated that the Residential Convenience Center at Superior Emerald Park is now open to accept residential waste, recyclables, and yard waste from 8:00 a.m. to 4:00 p.m. on Fridays and 8:00 to noon on Saturdays. Proof of residency is required. The Council members were invited to view the new Muskego Volunteer Fire Co. rescue boat and equipment at 5:30 p.m. on July 5 at Station No. 1. Ord. #1031 - An Ordinance to Amend the Zoning Map of the City of Muskego RS-3/OPD to B-3 (State Financial Bank). Second Reading. Salentine moved for adoption. Wichgers seconded. Salentine stated she would like the lot to remain residential and asked for support to deny the petition. This is not a good fit for the area. The existing lot already zoned for business can be used. Williams’ Supper Club and State Financial Bank will lose an ingress/egress with the upgrade of Janesville Road moving additional traffic to Kristen Drive. Chiaverotti stated that traffic will be an issue either way. Slocomb stated that the lot is in close proximity to the existing residential lots. Mr. Turk stated that the residential lot could be used for detention or retention purposes if the proposed office building were placed on the business lot. He also noted that he has discussed various options with the petitioner. Wichgers expressed support for Salentine’s position. Patterson noted there could be problems in the future if the property were rezoned. Mr. Turk agreed stating that the Plan Commission reviews the immediate proposal. With a zoning change, the future impact could be broader. Chiaverotti clarified that the proposal for an office building could go forward without the zoning change. City Attorney Molter stated that the petitions submitted at the 6/13/2000 public hearing did not meet all technical requirements. The petitions were not corrected and resubmitted; therefore, a simple majority vote of the Council is all that is required. Motion to adopt defeated 7-0 for reasons previously stated. COMMITTEE REPORTS Sanders moved for acceptance of the 6/21/2000 and 6/27/2000 Finance Committee minutes. Slocomb seconded. Salentine moved for individual consideration of Clothing Purchase for Building Department to send the issue back to Committee for further review, Slocomb seconded; motion carried. Motion to accept minutes without said paragraph carried. Sanders moved for acceptance of the 6/19/2000 and 6/26/2000 Public Utilities Committee minutes. Le Doux seconded; motion carried. Salentine moved for acceptance of the 6/25/2000 Public Works Committee minutes. Chiaverotti seconded; motion carried. Common Council Minutes Page 2 June 27, 2000 The minutes of the 6/20/2000 Plan Commission, 5/24/2000 Library Board and 6/12/2000 Parks & Recreation Board were received and placed on file. Ord. #934 - An Ordinance to Amend Chapter 14, to Add Section 1.5 (2)(n) of the Municipal Code of the City of Muskego Floodplain Ordinance: Official Map (Plum Creek), on the floor, deferred 6/24/97. Slocomb moved to defer to obtain correct map. Patterson seconded; motion carried. Ord. #1006 - An Ordinance to Amend the Zoning Map of the City of Muskego (College Avenue/Milwaukee SMSA Ltd. Partnership - I-1 to I-1/OIP), on the floor, deferred 6/13/2000. Slocomb moved to defer. Chiaverotti seconded; motion carried. Ord. #1030 - An Ordinance to Amend Chapter 4, Sections 4.03(4), 4.04(5) and 4.04(9) of the Municipal Code of the City of Muskego (Police and Fire Commission). Second Reading. Slocomb moved for adoption. Sanders seconded. Chiaverotti moved to amend to remove the words, “he has been” in the second line of paragraph (5) under Section 2 so as not to be gender specific. Sanders seconded; motion carried. Ord. #1030, as amended, adopted 7-0. Ord. #1032 - An Ordinance to Amend Chapter 14 to Add Section 1.5(2)(o) of the Municipal Code of the City of Muskego Floodplain Zoning Ordinance: Official Map (Jewel Creek). Second Reading. Salentine moved for adoption. Le Doux seconded. Wichgers stated one specific property was being reviewed. Patterson moved to defer to allow further discussion with staff and engineers. Wichgers seconded; motion carried. Reso. #138-2000 - Authorizing the Hiring of an Appraiser and Relocation Expert to Carry Out Relocation Order Known as Resolution #99-2000 (Water Improvement/Hillendale). Sanders moved for adoption. Le Doux seconded. The Mayor stated only one proposal was received to date for $1,800. The City would like to obtain several others. The City Attorney noted that this was a special kind of appraisal and is more costly. It was noted that Waste Management was paying the cost. Motion carried 7-0. Reso. #139-2000 - Resolution of City Appointment to Joint Review Board (Finance Director Gunderson). Chiaverotti moved for adoption. Le Doux seconded. Motion carried 7-0. Reso. #140-2000 - Declaration of Public Roads (Janesville Court and Oak Grove Drive). Chiaverotti moved for adoption. Slocomb seconded. Motion carried 7-0. Reso. #141-2000 - Resolution to Establish Fees (Geographic Information System - GIS). Salentine moved for adoption. Sanders seconded. Motion carried 7-0. Reso. #142-2000 - Reapproval of Certified Survey Map - Meinen. Chiaverotti moved for adoption. Slocomb seconded. Motion carried 7-0. Reso. #143-2000 - Amended and Revised Final Resolution Authorizing Installation of Sewer Improvements and Levying Special Assessments Against Benefited Properties (Woods Road - Pellmann). Sanders moved for adoption. Le Doux seconded. Motion carried 7-0. Reso. #144-2000 - Reapproval of Certified Survey Map - Schweitzer. Chiaverotti moved for adoption. Slocomb seconded. Ord. #1033 - An Ordinance to Amend the Zoning Map of the City of Muskego (RS-3 and RS-2 to RS-3/OPD - Quietwood Creek Subdivision). First Reading. Ord. #1034 - An Ordinance as to the Implementation of Certain Aspects of Wisconsin Administrative Code COMM 83. First Reading. Slocomb moved to suspend rules for second reading. Salentine seconded. Motion carried 7-0. Second Reading. Slocomb moved for adoption. Le Doux seconded. Motion carried 7-0. LICENSES Slocomb moved for approval of Salvage & Recycling Permit for John Glockner. Mr. Turk reported that there have been no complaints and the site is cleaner every year. Salentine seconded; motion carried. Mr. Turk and the City Attorney were dismissed at 9:43 p.m. Slocomb moved for approval of Operators’ Licenses for Debra Laster, Deborah Radmanovic, Lisa Hahn, Heather Petrie, Christine Radloff, Roseanna Perkins, David Lake, Shannon Papp, Debra Maas, and Jerome Krupa with a 3, 6, 9, and 12-month review. Le Doux seconded; motion carried. Slocomb moved for approval of Temporary Operators’ Licenses for Julie Bindas and Robert Bankenbusch. Salentine seconded; motion carried. Slocomb moved for approval of 2000 - 2001 “Class A” Retailers’ License for the Sale of Fermented Malt Beverages and Intoxicating Liquors for Erickson’s Roadrunner d/b/a Mike’s Express. Le Doux seconded. Motion carried 7-0. Slocomb moved for approval of Temporary Class “B” Licenses to Little Muskego Lake Association for 7/3/2000, with rain date of 7/4/2000, and All Muskego High School Class Reunion Committee for 9/2/2000 with conditions as outlined by the Finance Committee on 6/27/00. Salentine seconded. Motion carried 7-0. Slocomb moved for approval of Temporary Class “B”/“Class B” Retailer’s License to Muskego Community Festival Committee for 8/25/2000, 8/26/2000, and 8/27/2000. Salentine seconded. Motion carried 7-0. VOUCHER APPROVAL Slocomb moved for approval of payment of General Vouchers in the amount of $657,261.88. Sanders seconded. Motion carried 7-0. Slocomb moved for approval of Tax Checks in the amount of $672.04. Sanders seconded. Motion carried 7-0. Sanders moved for approval of payment of Utility Vouchers in the amount of $815,123.47. Le Doux seconded. Motion carried 7-0. CITY OFFICIALS’ REPORT The Clerk-Treasurer reported the following public hearings were scheduled: 7/11/2000 - Sixth Amended WCA District at 7:15 p.m.; Amendment to the Sewer Utility Code at 7:20 p.m.; 8/8/2000 Wireless Facilities at 7:20 p.m. The draft of the July calendar was also distributed. Common Council Minutes Page 4 June 27, 2000 COMMUNICATIONS AND MISCELLANEOUS BUSINESS It was determined that the discussion regarding Trick or Treat would be placed on the July Public Services agenda. Wichgers noted he continues to have a conflict as the Council representative to the Library Board and Mayor’s Task Force when both meetings are scheduled for the same day.
