COMMON COUNCIL - CITY OF MUSKEGO (Approved as corrected)
MINUTES OF MEETING HELD JUNE 13, 2000 6/27/2000
The meeting was called to order at 8:45 p.m. by Ald. Slocomb. Also present were Ald.
Chiaverotti, Le Doux, Patterson, Salentine, Sanders and Wichgers, City Attorney Molter, Clerk-
Treasurer Marenda, Plan Director Turk, and Deputy Clerk Blenski. Ald. Salentine was not
present. The Clerk-Treasurer stated the meeting was noticed in accordance with the open
meeting law.
Sanders moved for approval of minutes of 5/23/00 and 6/1/00. Chiaverotti seconded; motion
carried.
Slocomb noted that he would be the presiding officer in the absence of the Mayor but would be
acting in the capacity of Council President retaining his right to vote. It was noted that the
Council would not need to convene into closed session as noticed.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Slocomb stated appointments to the Conservation Plan Committee have not been finalized.
Reso. #130-2000 - Approval of Preliminary Plat - Candlewood Creek Subdivision. Chiaverotti
moved for adoption. Le Doux seconded. Mr. Turk stated 51 residential lots are proposed.
The parcel is currently zoned RS-2 and said lots conform to the zoning requirements. No
public hearing is required. The Plan Commission has recommended approval. Motion carried
6-0.
Reso. #133-2000 - Approval of Certified Survey Map - Peters. Chiaverotti moved for adoption.
Sanders seconded. Mr. Turk stated the approval is contingent upon the resolution of any
technical changes as required following review of the City Engineers. Motion carried 6-0.
COMMITTEE REPORTS
Sanders moved for acceptance of the 6/7/2000 and 6/13/2000 Finance Committee minutes.
Le Doux seconded; motion carried.
Patterson moved for acceptance of the 6/5/2000 Public Services Committee minutes. Le Doux
seconded; motion carried.
The 6/6/2000 Plan Commission minutes were received and placed on file.
Ord. #1006 - An Ordinance to Amend the Zoning Map of the City of Muskego (College
Avenue/Milwaukee SMSA Ltd. Partnership - I-1 to I-1/OIP), on the floor, deferred 5/23/2000.
Mr. Turk noted that there was nothing new to report. Chiaverotti moved to defer. Le Doux
seconded; motion carried.
Ord. #1029 - An Ordinance to Amend the Zoning Map of the City of Muskego (LandVest
Development Group, Inc. A/OHS to B-2). Second Reading. Le Doux moved for adoption.
Chiaverotti seconded. Sanders moved to defer until July 25 Council to obtain final
recommendation of the Comprehensive Plan Committee. Patterson seconded; motion carried.
Reso. #125-2000 - Preliminary Resolution Declaring Intent to Levy Area-Wide Water Capacity
Assessment for Debt Service for Water Service Under §66.60, Wisconsin Statutes (Sixth
Amended WCA District). Sanders moved for adoption. Le Doux seconded; motion carried
unanimously.

Reso. #126-2000 - Approval of Agreement and Escrow Agreement Between the City of
Muskego and Waste Management of Wisconsin, Inc. Patterson moved for adoption.
Chiaverotti seconded. Slocomb noted revised agreements with dollars amounts filled in and
exhibits attached were distributed. Atty. Molter stated the exhibits must be attached to both
agreements. This is the City’s effort to get water to the Luppnow property. Motion carried 6-0.
Reso. #127-2000 - Resolution to Amend 1997 Subgrantee Agreement Between Waukesha
County and Muskego Historical Society. Sanders moved for adoption. Le Doux seconded.
Slocomb noted the amendment is to change the scope of work previously identified to include
restorations at Luther Parker Cemetery and modifications to work to be done at the Muskego
Historical Settlement Centre. Motion carried 6-0.
Reso. #128-2000 - Approval of Various License Applications for the City of Muskego for the
Licensing Period July 1, 2000 to June 30, 2001. Sanders moved for adoption. Patterson
seconded. Motion carried 6-0.
Reso. #129-2000 - Approval of Final Plat - Lilac Meadows Subdivision, Town of Norway.
Chiaverotti moved for adoption. Sanders seconded. Motion carried 6-0.
Reso. #131-2000 - Approval of Certified Survey Map - Wiza. Chiaverotti moved for adoption.
Wichgers seconded. Motion carried 6-0.
Reso. #132-2000 - Approval of Certified Survey Map - Whitehouse. Chiaverotti moved for
adoption. Patterson seconded. Mr. Turk noted technical corrections needed to be made prior
to the City signing the map. Motion carried 6-0.
Reso. #134-2000 - Establish Traffic Regulations. Patterson moved for adoption. Le Doux
seconded. Patterson moved to defer to send back to the Public Services Committee for
further citizen input. Chiaverotti seconded; motion carried.
Reso. #135-2000 - Approval of Construction Agreement and Letter of Credit for Woods Road
Off-Site Improvements - Quietwood Creek. Sanders moved for adoption. Le Doux seconded.
Motion carried 6-0.
Reso. #136-2000 - A Resolution Waiving Conflict of Interest (Town of Vernon/Village of Big
Bend). Le Doux moved for adoption. Chiaverotti seconded. Motion carried 6-0.
Reso. #137-2000 - Final Resolution Authorizing Installation of Improvements and Levying of
Special Assessments Against Benefited Property (Movie Plex/S67 W19491 Tans Drive).
Chiaverotti moved for adoption. Sanders seconded. Slocomb noted that the City has received
the necessary signed documents. The weather is affecting the time frame to complete the
work. Motion carried 6-0.
Ord. #1030 - An Ordinance to Amend Chapter 4, Sections 4.03(4), 4.04(5) and 4.04(9) of the
Municipal Code of the City of Muskego (Police and Fire Commission). First Reading.
Ord. #1031 - An Ordinance to Amend the Zoning Map of the City of Muskego RS-3/OPD to B-3
(State Financial Bank). First Reading. Mr. Turk noted that stormwater issues will need to be
addressed and the size of the proposed building scaled back. He confirmed that the
residential lot could be used for stormwater purposes. Slocomb requested a more detailed
map of the area.

Ord. #1032 - An Ordinance to Amend Chapter 14 to Add Section 1.5(2)(o) of the Municipal
Code of the City of Muskego Floodplain Zoning Ordinance: Official Map (Jewel Creek). First
Reading. Wichgers stated he would check the status of two properties.
LICENSES
Sanders moved for approval of Salvage and Recycling Permit for the 2000 - 2001 license year
for James Kohne. Le Doux seconded. Motion carried 6-0.
Sanders moved for approval of 1999 - 2000 “Class A” Retailers’ License for the Sale of
Fermented Malt Beverages and Intoxicating Liquors for North Indian Enterprises, Inc. d/b/a J J
Petro, Harjinder K. Ghuman, Agent. Chiaverotti seconded. Motion carried 6-0.
VOUCHER APPROVAL
Sanders moved for approval of payment of General Vouchers in the amount of
$760,045.43. Le Doux seconded. Motion carried 6-0. Sanders moved for approval of Tax
Checks in the amount of $2,146.03. Chiaverotti seconded. Motion carried 6-0. Le Doux
moved for approval of payment of Utility Vouchers in the amount of $391,495.94. Sanders
seconded. Motion carried 6-0.
CITY OFFICIALS’ REPORT
The Clerk-Treasurer requested input from the Aldermen on the new binders used for the
Council materials.
Chiaverotti moved to adjourn at 9:36 p.m. Sanders seconded; motion carried.
