CM041100 COMMON COUNCIL - CITY OF MUSKEGO Approved MINUTES OF MEETING HELD APRIL 11, 2000 The meeting was called to order at 8:11 p.m. by Mayor De Angelis. Also present were Ald. Slocomb, Chiaverotti, Le Doux, Patterson, Pionek, Salentine, and Sanders, City Attorney Molter, Clerk-Treasurer Marenda, Deputy Clerk Blenski, and Plan Director Turk. The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting law on 4/7/2000. Salentine moved for approval of minutes of 3/28/2000. Sanders seconded; motion carried. The Clerk-Treasurer read the closed session notices. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor read Proclamation declaring May as “Green Up Muskego” month. He encouraged residents to return their census forms if they have not already done so. He also noted that information regarding the Community Center site was not available at this time. PERSONAL APPEARANCES Mr. John Larsen of Applied Ecological Services appeared before the Council to give a brief overview of how the City’s Conservation Plan would be prepared. Ord. #1006 - An Ordinance to Amend the Zoning Map of the City of Muskego (College Avenue/Milwaukee SMSA Ltd. Partnership - I-1 to I-1/OIP), on the floor, deferred 3/28/2000. Sanders moved to defer. Slocomb seconded; motion carried. Reso. #74-2000 - Approval to Hire Consultant to Prepare Conservation Plan (Applied Ecological Services/Vandewalle & Associates). Slocomb moved for adoption. Patterson seconded. The Mayor noted that the contract has not been finalized. Attorney Molter is working on the contract and requested a copy of the proposal. Slocomb moved to defer. Patterson seconded; motion carried. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Discussion took place regarding possible alternate sites for the proposed Community Center. Mr. Turk noted that the site west of the high school is not located near the center of the City’s population. There are other appropriate sites out there. He suggested that an assessment to determine the needs of the community and what the private developer could support be done. Mr. Turk stated it could take three to four months and would have to be done by an independent firm. There was concern expressed that the additional time would delay the initiation of the project even more. Council members discussed the need for the center to have sufficient open space. Slocomb asked that a request for proposal to do a needs assessment be done. Discussion continued with Salentine stating she did not support doing an assessment. She encouraged the Council to visit the Oak Creek facility. It was noted that the City has had discussion with two property owners about sites on Janesville. Pionek stated that he questions taking commercial property on Janesville Road off the tax roll. No final determinations were made and Mr. Turk was dismissed at 9:05 p.m. COMMITTEE REPORTS Common Council Minutes Page 2 April 11, 2000 Sanders moved for acceptance of the 4/5/2000 and 4/11/2000 Finance Committee minutes. Slocomb seconded; motion carried. Patterson moved for acceptance of the 4/3/2000 Public Services Committee minutes. Pionek seconded; motion carried. Minutes of the 3/22/2000 Library Board and 4/4/2000 Plan Commission meetings were placed on file. Ord. #1024 - An Ordinance to Repeal and Recreate Chapter 1.05 (1) of the Municipal Code of the City of Muskego (Board of Review). Second Reading. Salentine moved for adoption. Chiaverotti seconded. Motion carried 7-0. Ord. #1025 - An Ordinance to Amend Chapter 26, Sections 26.02(1)(c), (1)(d), (1)(n), (1)(t), 26.02(3)(a), 26.02(8)(b), and 26.02(9)(d) of the Municipal Code of the City of Muskego (Park Rules and Regulations). Second Reading. Le Doux moved for adoption. Slocomb seconded. Motion carried 7-0. Reso. 75-2000 - Award of Bid - City of Muskego Asbestos Abatement Project. Sanders moved for adoption. Slocomb seconded. The Mayor stated that the City will also need to hire a contractor to monitor the air quality in conjunction with this project. Salentine moved to amend to add “contingent upon, if within the Mayor’s judgment, said contract can be coordinated with the other City Hall remodeling contract and the contract is in acceptable form” following the word “project” in the last WHEREAS and at the end of the NOW, THEREFORE, BE IT RESOLVED paragraph. Sanders seconded; motion carried. Reso. #75-2000, as amended, adopted 7-0. Reso. #76-2000 - Amended and Revised Final Resolution Authorizing Installation of Water Main Improvements and Levying Special Assessments Against Benefited Property (Woods Road - East of Racine to Brooke Lane Water Main Project). Sanders moved for adoption. Le Doux seconded. Motion carried 7-0. Reso. #77-2000 - Approval of Assignment and Assumption of Contract Between Town & Country Waste Service (BFI) and the City of Muskego. Patterson moved for adoption. Sanders seconded. Motion carried 7-0. Reso. #78-2000 - Re-approval of Certified Survey Map - Meinen. Salentine moved for adoption. Chiaverotti seconded. Motion carried 7-0. Reso. #79-2000 - Renewal of Extractive Permit and Portable Asphalt Plant for Payne and Dolan. Salentine moved for adoption. Le Doux seconded. Motion carried 7-0. Reso. #80-2000 - Amendment to 2000 Budget. Slocomb moved for adoption. Sanders seconded. The Mayor noted the amendment reflects an increase in expenditures of $134,250 for the Conservation Plan. Motion carried 7-0. Reso. #81-2000 - Resolution to Create Position of City Engineering/Building Inspection Coordinator. Slocomb moved for adoption. Le Doux seconded. Discussion took place Common Council Minutes Page 3 April 11, 2000 regarding the length of time to complete the degree requirement. Patterson moved to amend the position description to add, “completion within reasonable time as determined at date of hire” following the words “university of recognized standing” under the Minimum Training and Experience Required to Perform Essential Job Functions. Le Doux seconded; motion carried. Reso. #81-2000, as amended, adopted 7-0. Ord. #1026 - An Ordinance to Amend the Zoning Map of the City of Muskego (Salentine and Loughney A to RCE and EA to RCE). First Reading. Ord. #1027 - An Ordinance to Amend Chapter 1, Section 1.06(2)(e) 2. and Chapter 2, Sections 2.01 and 2.09(2) of the Municipal Code of the City of Muskego (General Government and the Governing Body). First Reading. LICENSES Slocomb moved for approval of operator’s license for Theresa Kallies, Barbara Yates, Sherice Davis, Michele Bartz, and Candyce Guenzler. Salentine seconded; motion carried. Slocomb moved for approval of Outside Dance Permit for the Broke Spoke for June 3, 2000 and July 28 and 29, 2000 subject to conditions of the 4/5/2000 Finance Committee. He also noted that field parking was approved for 6/17/2000. Le Doux seconded; motion carried. VOUCHER APPROVAL Slocomb moved for approval of payment of General Vouchers in the amount of $483,147.30. Salentine seconded. Motion carried 7-0. Slocomb moved for approval of Tax Checks in the amount of $826,570.40. Sanders seconded. Motion carried 7-0. Sanders moved for approval of payment of Utility Vouchers in the amount of $86,854.81. Le Doux seconded. Motion carried 7-0. CITY OFFICIALS’ REPORTS The Clerk-Treasurer announced that a public hearing would be held at 7:25 p.m. on 4/25/2000 to consider the petition of WFI to rezone the Addis property located in the SW ¼ of Section 34 from A to A/OIP. The following meetings were also noted: Jt. Meeting with Franklin on 4/13/2000, and the Organizational Meeting on 4/18/2000 at 7:00 p.m. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Pionek stated he placed discussion of oversizing costs for sanitary sewer, water mains and storm sewer on the agenda. Slocomb noted that clarification was needed to the language contained in Chapter 18, Sections 18.56, 18.57 and 18.58. The proposed revisions will be reviewed by the Public Utilities Committee. The Clerk stated that a public hearing would be required. It was noted that there was no need to convene into closed session for the community center site issue. Salentine moved to convene into closed session pursuant to §19.85(1)(e) Deliberating or negotiating the purchasing of public properties, the investing of public funds, or Common Council Minutes Page 4 April 11, 2000 conducting other specified public business, whenever competitive or bargaining reasons require a closed session; more specifically negotiating contract with Muskego Volunteer Fire Co. Chiaverotti seconded. Motion carried 7-0. The Clerk-Treasurer and Deputy Clerk were dismissed, as well as the City Attorney. Salentine moved to convene into open session. Chiaverotti seconded. Motion carried 7-0. Reso. #215-99 - Approval of Fire Protection Contract with Muskego Volunteer Fire Company for 2000, on the floor, deferred 3/28/2000. Slocomb moved to amend Agreement to insert revised figure of $249,235 and remove “upon the recommendation of the Finance Committee” from the resolution. Sanders seconded; motion carried.
