CM020800 COMMON COUNCIL - CITY OF MUSKEGO Approved 2/22/2000 MINUTES OF MEETING HELD FEBRUARY 8, 2000 The meeting was called to order at 8:15 p.m. by Mayor De Angelis. Also present were Ald. Slocomb, Chiaverotti, Le Doux, Patterson, Pionek, Salentine, and Sanders, City Attorney Molter, Clerk-Treasurer Marenda, Director of Planning Turk, and Deputy Clerk Blenski. The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting law on 2/4/2000. Salentine moved for approval of minutes of the 1/25/2000 and 1/31/2000 meetings. Sanders seconded. Chiaverotti requested correction to minutes of 1/25/2000 to change “adopt” to “accept” regarding Reso. #17-2000 (Durham Hill Design Guide). Motion to accept minutes as corrected carried. The Clerk-Treasurer read the closed session notice. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor stated that the City of New Berlin has requested a joint Council meeting be held. There were no objections. He presented update on COMM 83 and Smart Growth. The Mayor also noted that the Plan Commission discussed the possibility of a moratorium on new cell tower placements. He presented a legislative update. The City Hall remodeling project will be going out for bid and the Library is expected to open mid-March. COMMITTEE REPORTS Slocomb moved for acceptance of the 2/2/00 and 2/8/00 Finance Committee minutes. Salentine seconded; motion carried. Minutes of the 1/26/00 Library Board and 2/1/00 Plan Commission were received and placed on file. OLD BUSINESS Reso. #229-98 - Approval of Facility Agreement Between the City of Muskego and the Muskego-Norway School District, on the floor, deferred 11/24/98. Slocomb moved to amend to include “as amended and attached” in the BE IT FURTHER RESOLVED. Chiaverotti seconded; motion carried. Reso. #229-98, as amended, adopted 7-0. Reso. #34-2000 - Approval of Superior Emerald Park Landfill Settlement Agreement and Mutual Release, on the floor, deferred 1/25/2000. Slocomb moved to amend to add “BE IT FURTHER RESOLVED that the approval mentioned in No. 1 above and the authorization mentioned in No. 2 above are contingent upon Browning Ferris, Inc. having executed the Amendment to the Contract approved by Resolution #37-2000.” Sanders seconded; motion carried. Reso. #34-2000, as amended, adopted 7-0. Ord. #1006 - An Ordinance to Amend the Zoning Map of the City of Muskego (College Avenue/Milwaukee SMSA Ltd. Partnership - I-1 to I-1/OIP), on the floor, deferred 1/11/2000. Sanders moved to defer. Chiaverotti seconded; motion carried. Common Council Minutes Page 2 February 8, 2000 Ord. #1012 - An Ordinance to Amend the Zoning Map of the City of Muskego (Redmond Construction - RS-2/OOS to B-2). Second Reading. The Mayor stated the City received a request to withdraw the petition to rezone. Slocomb moved for adoption. Sanders seconded. Motion defeated 7-0 in response to the request to withdraw the rezoning petition. Ord. #1013 - An Ordinance to Amend the Zoning Map of the City of Muskego (Country Club Villages - R-2/OPD and RS-2/OPD to RS-3/OPD). Second Reading. Salentine moved for adoption. Sanders seconded. Motion carried 7-0. Ord. #1014 - An Ordinance to Repeal and Recreate Chapter 1, Section 1.05(2) of the Municipal Code of the City of Muskego (Plan Commission). Second Reading. Salentine moved for adoption. Le Doux seconded. Slocomb moved to amend to replace “the president” of the Parks and Recreation Board with “a member” of the Parks and Recreation Board. Pionek seconded; motion carried. Ord. #1014, as amended, adopted 7-0. Ord. #1015 - An Ordinance to Amend Chapter 1 of the Municipal Code of the City of Muskego (Location of Polling Places - District 4 and District 6). Second Reading. Sanders moved for adoption. Le Doux seconded. The Clerk-Treasurer stated that signage would be done to direct voters to new polling places as well as postcards sent to those affected by the temporary relocation. Motion carried 7-0. NEW BUSINESS Ord. #1016 - An Ordinance to Amend Chapter 18, Section 18.42(4), of the Municipal Code of the City of Muskego (Area and Dimensions - OLS and OED Zoning Districts). First Reading. Plan Director Turk was requested to contact those property owners present at the public hearing to review their specific situations. Mr. Turk was dismissed at 8:47 p.m. Reso. #37-2000 - Approval of Amendment to Weekly Refuse Collection and Biweekly Recycling Collection and Disposal Contract Dated October 26, 1993. Slocomb moved for adoption. Patterson seconded. The Mayor noted that the resolution allows for minor changes to be made. It is not certain that $20.08 will be the base rate amount and how the amount to be reimbursed to the City will exactly be calculated. The amendment was forwarded to BFI Tuesday afternoon and the City has not received notification of their approval. Motion to adopt carried 7-0. The Mayor commended Ald. Slocomb for his diligent efforts to represent his constituents and the City with regard to negotiating the agreement with Superior Emerald Park Landfill, Inc. Reso. #38-2000 - Approval of Certified Survey Map - State Financial Bank. Salentine moved for adoption. Patterson seconded. Motion carried 7-0. Common Council Minutes Page 3 February 8, 2000 Reso. #39-2000 - Authorize Execution of the 1999 - 2001 Labor Agreement Between Telecommunicators Unit of Local 2414 AFSCME and the City of Muskego. Slocomb moved for adoption. Patterson seconded. Motion carried 7-0. Reso. #40-2000 - Resolution of Necessity Under §32.06 and §32.07, Wis. Stats., for Acquisition of Land for a Community Center. Sanders moved for adoption. Le Doux seconded. Motion carried 7-0. Reso. #41-2000 - Authorizing the Hiring of an Appraiser and Relocation Expert to Carry Out Resolution of Necessity. Salentine moved for adoption. Sanders seconded. Pionek recommended looking at other properties at the same time. The Mayor stated appraisals for the parcels under consideration can proceed and a determination then be made by the Council. Slocomb suggested discussion continue at the March Committee of the Whole meeting. Motion to adopt carried 7-0. Reso. #42-2000 - Resolution Establishing Salary of Part-Time Seasonal Utility Employees. Sanders moved for adoption. Salentine seconded. Motion carried 7-0. Reso. #43-2000 - Amendment to Park and Open Space Plan. Slocomb moved for adoption. Le Doux seconded. Motion carried 6 in favor and Pionek abstaining. Charter Ordinance #18 - A Charter Ordinance Providing for a Spring Primary Election. First Reading. Ord. #1017 - An Ordinance to Amend the Zoning Map of the City of Muskego (Muirfield Village of Country Club Villages - A to RSA/OPD). First Reading. LICENSES Slocomb moved for approval of Operators’ Licenses for Diane Caminata and Carrie Heschke. Salentine seconded; motion carried unanimously. VOUCHER APPROVAL Slocomb moved for approval of payment of general vouchers in the amount of $534,747.60. Sanders seconded. Motion carried 7-0. Slocomb moved for approval of payment of tax checks in the amount of $9,643.18. Salentine seconded. Motion carried 7-0. Sanders moved for approval of payment of utility vouchers in amount of $162,078.66. Le Doux seconded. Motion carried 7-0. Le Doux seconded. Motion carried 7-0. The Clerk, Deputy, and City Atty. were dismissed. Patterson moved to reconvene into open session. Salentine seconded; motion carried. Reso. #215-99 - Approval of Fire Protection Contract with Muskego Volunteer Fire Company for 2000, on the floor, deferred 1/25/2000. Patterson moved to defer at the fire company’s request.
