CM121499 COMMON COUNCIL - CITY OF MUSKEGO Approved 1/11/2000 MINUTES OF MEETING HELD DECEMBER 14, 1999 The meeting was called to order at 8:03 p.m. by Mayor De Angelis. Also present were Ald. Slocomb, Chiaverotti, Le Doux, Patterson, Pionek, and Sanders, City Attorney Molter, Clerk-Treasurer Marenda, Planning Assistant Wolff, and Deputy Clerk Blenski. Ald. Salentine was absent. The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting law on 12/10/99. Slocomb moved for approval of minutes of the 11/23/99 meeting. Sanders seconded; motion carried. The Clerk-Treasurer read the closed session notices. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor stated that the Superior Emerald Park Landfill Siting Committee met for the final time and approved a proposed settlement agreement. The Mayor also presented an update on the library construction project. COMMITTEE REPORTS Slocomb moved for acceptance of the 12/8/99 and 12/14/99 Finance Committee minutes. Sanders seconded; motion carried. Patterson moved for acceptance of the 12/6/99 Public Services Committee minutes. Pionek seconded; motion carried. Minutes of the 12/7/99 Plan Commission and 11/17/99 Library Board were received and placed on file. Reso. #221-99 - Approval of Certified Survey Map - Wysocki. Slocomb moved for adoption. Sanders seconded. Slocomb clarified wetland area. Motion carried 6-0. Ord. #1006 - An Ordinance to Amend the Zoning Map of the City of Muskego - College Avenue/Milwaukee SMSA Ltd. Partnership (I-1 to I-1/OIP). Second Reading. Slocomb moved for adoption. Chiaverotti seconded. Slocomb moved to defer pending receipt of information from the City’s consultant, Ralph Evans. Patterson seconded; motion carried. Reso. #219-99 - Approval of Preliminary Plat - Quietwood Creek Subdivision. Sanders moved for adoption. Le Doux seconded. Mr. Wolff noted that staff recommends deferral due to outstanding engineering issues. Slocomb requested that the Plan Commission reso. as well as a single sheet layout of the subdivision be provided. Slocomb moved to defer. Patterson seconded; motion carried. Mr. Wolff was dismissed at 8:39 p.m. Reso. #204-99 - Approve New and Revised Positions. Slocomb moved for reconsideration. Chiaverotti seconded. The Mayor outlined the proposed changes. Slocomb moved to amend to add point values for the newly created positions, to change grade of Finance/Information Systems Admin/Clerical position from C&T 10 to Common Council Minutes Page 2 December 14, 1999 C&T 11, to change “part-time” Utilitiy Maintenance position to “full-time,” to change status of Accountant position from exempt to nonexempt with the 1999 hourly rate stated, and to change status of Recreation Supervisor positions from nonexempt to exempt with the 1999 bi-weekly salary stated. Sanders seconded; motion carried. Reso. #204-99, as amended, adopted 6-0. Reso. #211-99 - Preliminary Resolution Declaring Intent to Exercise Special Assessment Police Powers Under §66.60 Wis. Statutes as to Sanitary Sewer Assessment Area for Woods Road - 400 Feet East of Racine Avenue Sewer Project (Project MSS-2-99; Assessment District “SS”). Sanders moved for adoption. Le Doux seconded. Motion carried 6-0. Reso. #212-99 - Approval of Carrier for the City’s Public Officials Insurance for 2000. Slocomb moved for adoption. Sanders seconded. Motion carried 6-0. Reso. #213-99 - Authorize Health Insurance Contract for 2000 (Compcare). Slocomb moved for adoption. Sanders seconded. Motion carried 6-0. Reso. #214-99 - Approval of Fire Protection Contract with Tess Corners Fire Department for 2000. Patterson moved for adoption. Le Doux seconded. During roll call vote, Le Doux initially abstained stating he may have a conflict of interest. Upon further discussion, he rescinded his abstention. Motion carried 6-0. Reso. #215-99 - Approval of Fire Protection Contract with Muskego Volunteer Fire Company for 2000. Sanders moved for adoption. Slocomb seconded. Slocomb moved to defer. Patterson seconded; motion carried. Reso. #216-99 - Resolution to Establish Fees. Slocomb moved for adoption. Sanders seconded. Motion carried 6-0. Reso. #217-99 - Resolution Requiring a Spring Primary Election. Sanders moved for adoption. Le Doux seconded. Clerk-Treasurer provided background that state statute requires City have a charter ordinance in place to hold a primary election for local offices, or act on a resolution each time a primary may be needed. Time did not permit the creation of a charter ordinance prior to the spring election. It was determined that the City would proceed to create a charter ordinance for the future. Motion carried 6-0. Reso. #218-99 - Authorizing Street Name Change (Walter Hagen Drive). Patterson moved for adoption. Le Doux seconded. Motion carried 6-0. Reso. #220-99 - Approval of Certified Survey Map - Babik, Town of Waterford. Slocomb moved for adoption. Sanders seconded. Motion carried 6-0. Reso. #222-99 - Approval of Intergovernmental Cooperation Agreement with the City of Milwaukee for Use of Muskego Firearms Training Facility. Sanders moved for adoption. Slocomb seconded. Sanders seconded. Motion carried 6-0. Reso. #225-99 - Approval of Agreement for Installation and Maintenance of Gaging Station on Private or Public Property. Sanders moved for adoption. Le Doux seconded. Motion carried 6-0. Reso. #226-99 - Intent to Accept Improvements to Qualify for General Transportation Aids. Slocomb moved for adoption noting correct street name “Chick Evans.” Chiaverotti seconded. Motion carried 6-0. Slocomb moved to convene into closed session pursuant to §19.85(1)(c) Considering employment, promotion, compensation, or performance evaluation data of any public employe over which the governmental body has jurisdiction or exercises responsibility, more specifically pay for performance plan for nonrepresented employees. Chiaverotti seconded. Motion carried 6-0. The City Attorney and Deputy were dismissed for the evening. The Clerk was not present for closed session. Slocomb moved to reconvene into open session with the Clerk-Treasurer present. Seconded by Chiaverotti; motion carried 6-0. Reso. #227-99 - Approval of Pay for Performance Program for All Non-Represented Employees of the City of Muskego. Slocomb moved for adoption. Sanders seconded. Motion carried 6-0. LICENSES Slocomb moved for approval of Operators’ Licenses for Frances Gibson and Nancy Guarniere. Sanders seconded; motion carried. Slocomb moved for approval of “Class B” Retailers’ License for the Sale of Fermented Malt Beverages and Intoxicating Liquors for Liborio Mazzarisi d/b/a Villa Italian Restaurant & Pizzeria. Sanders seconded. Motion carried 6-0. VOUCHER APPROVAL Common Council Minutes Page 4 December 14, 1999 Slocomb moved for approval of payment of general vouchers in the amount of $563,684.61. Sanders seconded. Motion carried 6-0. Slocomb moved for approval of payment of tax checks in the amount of $9,649.62. Sanders seconded. Motion carried 6-0. Sanders moved for approval of payment of utility vouchers in amount of $426,864.60. Le Doux seconded. Motion carried 6-0. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Waukesha Vision 2000 - Mayor reported he and Ald. Slocomb attended the presentation on November 30th. The committee will move ahead. Work groups will be created over next couple months to develop specifics of the plan. Slocomb stated after details are learned he believed it has a good chance of success. Mayor wished everyone a safe and happy holiday season. Slocomb moved to convene into closed session pursuant to §19.85(1)(e) Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session; more specifically negotiating contract with Muskego Volunteer Fire Co. Sanders seconded. Motion carried 6-0. The Clerk was dismissed. Slocomb moved to reconvene into open session. Pionek seconded; motion carried unanimously.
