CM102699 COMMON COUNCIL - CITY OF MUSKEGO Approved 11/9/99 MINUTES OF MEETING HELD OCTOBER 26, 1999 The meeting was called to order at 7:39 p.m. by Mayor De Angelis. Also present were Ald. Slocomb, Chiaverotti, Le Doux, Patterson, Pionek, Salentine, and Sanders, City Attorney Molter, Clerk-Treasurer Marenda, and Deputy Clerk Blenski. City Attorney Riffle arrived during the meeting to attend closed session. The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting law on 10/22/99. Slocomb moved for approval of minutes of the 10/12/99 meeting. Sanders seconded; motion carried. It was noted that the 10/21/99 minutes would be placed on the 11/9/99 Council agenda as some revisions were being made. The Clerk-Treasurer read the closed session notices. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor noted dedication of the new middle school was recently held. The school district will initiate a new facility planning committee to review future needs. The Mayor also presented an update on the state budget noting municipalities can anticipate monies not being provided by the state for recycling aids, and shared revenue. COMMITTEE REPORTS The 9/16/99, 9/23/99, and 9/30/99 Committee of the Whole minutes were accepted. Slocomb moved for acceptance of the 10/20/99 and 10/26/99 Finance Committee minutes. Salentine seconded; motion carried. Sanders moved for acceptance of the 10/18/99 and 10/26/99 Public Utilities Committee minutes. Le Doux seconded; motion carried. Pionek moved for acceptance of the 10/19/99 and 10/25/99 Public Works Committee minutes. Chiaverotti seconded; motion carried. Minutes of the 10/19/99 Plan Commission meeting and 10/11/99 Parks and Recreation Board meeting were received and placed on file. Reso. #170-99 - Resolution Declaring Certain Delinquent Personal Property Taxes to be Uncollectible (possible reconsideration). Salentine moved to reconsider. Slocomb seconded; motion carried. Salentine moved to amend to reflect corrected amount of $155.14 to be written off for Metals Transport. Sanders seconded; motion carried. Reso. #170-99, as amended, adopted 7-0. Ord. #1001 - An Ordinance to Amend Chapter 13, Section 13.03, of the Municipal Code of the City of Muskego (Wild Animals Prohibited). Second Reading. Patterson moved for adoption. Chiaverotti seconded. Sanders moved to amend to add “Ocelots (Felis pardalis)” to the list of prohibited animals. Patterson seconded; motion carried. Ord. #1001, as amended, adopted 7-0. Second Reading. Salentine moved for adoption. Sanders seconded. Motion carried 7-0. Ord. #1003 - An Ordinance to Establish Salaries for Certain Elected Officials. Second Reading. Salentine moved for adoption. Sanders seconded. Slocomb moved to amend bi- weekly salary of Municipal Judge to $403.85 effective May 1, 2000 and $423.08 effective May 1, 2001. Le Doux seconded; motion carried. Ord. #1003, as amended, adopted 7-0. Slocomb moved to convene into closed session pursuant to §19.85(1)(c) Considering employment, promotion, compensation, or performance evaluation data of any public employe over which the governmental body has jurisdiction or exercises responsibility, more specifically labor agreement, Local 2414 AFSCME City Hall/Library Unit. Chiaverotti seconded. Motion carried 7-0. Salentine moved to convene into closed session pursuant to §19.85(1)(g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved; more specifically pending and threatened litigation involving Superior Emerald Park Landfill, Inc. Slocomb seconded. Motion carried 7-0. City Attorneys Molter and Riffle were present. The Clerk and Deputy were excused. Slocomb moved to reconvene into open session with the Clerk and Deputy present. Salentine seconded. Motion carried 7-0. Reso. #174-99 - Final Resolution Authorizing Area-Wide Capacity Assessment for Water Services Under Wisconsin Statute 66.60 and Levying Water Capacity Special Assessments Against Benefited Property (WCA) (Fifth Amended WCA District). Sanders moved for adoption. Slocomb seconded. Motion carried 7-0. Reso. #175-99 - Approval Cleaning Service Contract for 2000. Salentine moved for adoption. Sanders seconded. The Mayor noted the contract represented about a 2% increase except for the library. Motion carried 7-0. Reso. #176-99 - Resolution for Urban Forestry Grant Program 2000. Sanders moved for adoption. Le Doux seconded. Motion carried 7-0. Reso. #177-99 - Authorizing Cancellation of Certain Uncollectible Accounts Receivable (1997 Rescue). Slocomb moved for adoption. Sanders seconded. Motion carried 7-0. Reso. #178-99 - Appointment to Citizen Member of the Board of Appeals (Barbara Blumenfield). Le Doux moved for adoption. Chiaverotti seconded. Motion carried 7-0. Reso. #179-99 - Approval of Agreement Between the City of Muskego and Waukesha County for Trunked Radio Services. Sanders moved for adoption. Salentine seconded. Motion carried 7-0. Reso. #180-99 - Authorize Execution of Labor Agreement Between Local 2414 AFSCME City Hall/Library Unit and the City of Muskego - January 1, 1999 - December 31, 2001. The Mayor noted that the revised settlement agreement would be attached to the resolution following discussion at closed session. Reso. #181-99 - Acceptance of Improvements - Park Estates Subdivision (Storm Sewer, Roads, Sanitary Sewer, and Water). Salentine moved for adoption. Sanders seconded. Motion carried 7-0. Reso. #182-99 - Amended and Revised Final Resolution Authorizing Installation of Sewer Improvements and Levying Special Assessments Against Benefited Property (Loomis Road/State Hwy. 45 Sewer Project MSS-1C-96, Assessment District “SO”). Sanders moved for adoption. Slocomb seconded. Motion carried 7-0. Reso. #183-99 - Approval of Agreement Between the City of Muskego and Barrientos Design & Consulting, LLC for Architectural and Engineering Design Services for Interior Remodeling of City Hall. Salentine moved for adoption. Sanders seconded. Sanders moved to amend to reflect changes in the agreement as follows: Article 10.2.1 Reimbursable Expenses amount of $25,000 should be $5,000 and Article 12 delete reference to Exhibit B. Le Doux seconded; motion carried. Reso. #183-99, as amended, adopted 7-0. Ord. #1004 - An Ordinance to Amend Chapter 12 to Repeal Section 12.19 and Create Chapter 31 of the Municipal Code of the City of Muskego (Muskego Cable Television Franchise Ordinance). First Reading. Brief discussion took place with Pionek clarifying that subscribers are in essence paying for the services that Time Warner representative indicated the City was receiving. Other issues the City is dissatisfied with were noted regarding cable service, such as the necessity to have the box for premium channels. The agreement with Time Warner will be at the 11/9/99 Council meeting and it is nonexclusive. Ord. #1005 - An Ordinance to Amend the Zoning Map of the City of Muskego EA to R-1 (Posbrig). First Reading. LICENSES Slocomb moved for approval of Operators’ Licenses for Kathleen Zaren, Lisa Rupp, and Jonelle Rieger. Salentine seconded; motion carried. Slocomb moved for approval of change of agent to Andrew Volanski for “Class B” Retailers’ License for the Sale of Beer and Liquor for Muskego Moose Lodge 1057. Sanders seconded; motion carried. Slocomb moved for approval of “Class A” Retailers’ License for Zoran Radisavcevic d/b/a Crossroads Food & Beverage. Salentine seconded. Motion carried 7-0. VOUCHER APPROVAL Slocomb moved for approval of payment of general vouchers in amount of $292,617.06. Sanders seconded. Motion carried 7-0. Sanders moved for approval of payment of utility vouchers in amount of $341,139.83. Le Doux seconded. Motion carried -0. Common Council Minutes Page 4 October 26, 1999 CITY OFFICIALS’ REPORTS The Clerk-Treasurer stated that a public hearing was scheduled for 7:25 p.m. on 11/23/99 to consider petition of Milwaukee SMSA Ltd. Partnership to rezone property in the NW ¼ of Section 1 to include the OIP overlay for installation of communications tower. The property is currently zoned I-1. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW The consensus of the Council was to cancel the 12/28/99 meeting. The November calendar was reviewed with a Committee of the Whole meeting scheduled for 11/4/99 with Phil Dibb of the Tess Corners Fire Dept. to attend regarding City’s current fire code.
