CM101299 COMMON COUNCIL - CITY OF MUSKEGO Approved 10/26/99 MINUTES OF MEETING HELD OCTOBER 12, 1999 The meeting was called to order at 7:45 p.m. by Mayor De Angelis. Also present were Ald. Slocomb, Chiaverotti, Le Doux, Patterson, Pionek, and Sanders, City Attorney Molter, Clerk-Treasurer Marenda, and Deputy Clerk Blenski. Ald. Salentine was absent. The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting law on 10/8/99. Slocomb moved for approval of minutes of the 9/28/99 meeting noting correction made to paragraph on page 1 regarding closed session motion to include, “Patterson seconded. Motion carried 6-0.” Le Doux seconded. Motion carried. The Clerk-Treasurer read the closed session notice. COMMITTEE REPORTS Slocomb moved for acceptance of the 10/6/99 and 10/12/99 Finance Committee minutes. Sanders seconded; motion carried. Pionek moved for acceptance of the 9/27/99 Public Works Committee minutes. Chiaverotti seconded; motion carried. Patterson moved for acceptance of the 10/4/99 Public Services Committee minutes. Chiaverotti seconded; motion carried. Sanders moved for acceptance of the 10/12/99 Public Utilities Committee minutes. Slocomb seconded; motion carried. Minutes of the 10/5/99 Plan Commission meeting and 9/22/99 Library Board meeting were received and placed on file. Ord. #999 - An Ordinance Relating to the Confidentiality of Information About Income and Expenses Requested by the Assessor in Property Assessment Matters in the City of Muskego. Second Reading. Slocomb moved for adoption. Le Doux seconded. Motion carried 6-0. Ord. #1000 - An Ordinance to Amend Chapter 17, Section 8.20 (7)C. of the Municipal Code of the City of Muskego (Permitted Uses by Conditional Grant - EA District). Second Reading. Slocomb moved for adoption. Chiaverotti seconded. Slocomb moved to amend to include “(7)” in all references to the section number following “8.20” and to add “but specifically excluding mini-warehouse uses” following “15. General Warehousing.” Sanders seconded; motion carried. Ord. #1000, as amended adopted 6-0. Reso. #167-99 - Resolution to Set Public Hearing Date for 2000 Budget (11/8/99 @ 7:00 p.m.). Slocomb moved for adoption. Le Doux seconded. Motion carried 6-0. Reso. #168-99 - Amendment to Deposit & Forfeiture Schedule. Slocomb moved for adoption. Sanders seconded. Patterson stated some of the forfeitures were not enough of a deterrent. He would like to see some of the forfeiture amounts, especially for alcohol- related violations involving minors, be higher. Slocomb stated the Police Department Common Council Minutes Page 2 October 12, 1999 wanted the municipal schedule to be consistent with that of the State to assist the officers when issuing citations. Motion carried 5-1 with Patterson casting the “no” vote. Reso. #169-99 - Authorizing the Issuance of a Summons as to Complaint Regarding the Fermented Malt Beverage License of Charles Schweitzer of Muskego. Sanders moved for adoption. Slocomb seconded. Motion carried 6-0. Reso. #170-99 - Resolution Declaring Certain Delinquent Personal Property Taxes to be Uncollectible. Slocomb moved for adoption. Sanders seconded. Motion carried 6-0. Reso. #171-99 - Award of Bid - Firing Range for Firearms Training Facility. Sanders moved for adoption. Le Doux seconded. Sanders moved to amend to add, “in an amount and on terms and conditions acceptable to the Mayor” to the end of the last WHEREAS and NOW, THEREFORE, BE IT RESOLVED paragraphs. Slocomb seconded; motion carried. Reso. #171-99, as amended adopted 6-0. Reso. #172-99 - Award of Bid - Target System. Sanders moved for adoption. Le Doux seconded. Sanders moved to amend to include same language added to Reso. #171-99. Slocomb seconded; motion carried. Reso. #172-99, as amended, adopted 6-0. Ord. #1001 - An Ordinance to Amend Chapter 13, Section 13.03, of the Municipal Code of the City of Muskego (Wild Animals Prohibited). First Reading. Sanders requested that ocelot be added to the list of prohibited animals. Ord. #1002 - An Ordinance to Amend Chapter 9, Section 9.001(1), of the Municipal Code of the City of Muskego (Orderly Conduct - State Laws Prohibiting Certain Offenses). First Reading. Ord. #1003 - An Ordinance to Establish Salaries for Certain Elected Officials. First Reading. LICENSES Slocomb moved for approval of Operators’ Licenses for Joseph Doerr, Shannon Lesniewski, James Semrad, Anita Nogalski, and Karen Ackerman. Sanders seconded; motion carried. VOUCHER APPROVAL Slocomb moved for approval of payment of general vouchers in amount of $875,327.65. Sanders seconded. Motion carried 6-0. Sanders moved for approval of payment of utility vouchers in amount of $96,146.84. Slocomb seconded. Motion carried 6-0. CITY OFFICIALS’ REPORTS The Clerk-Treasurer announced the following public hearings to be held on 10/26/99: 7:15 p.m. to consider petition of Carl and Bonnie Posbrig to rezone property in the SW ¼ of Section 21 from EA to R-1; 7:20 p.m. to consider amendment to the WCA district; 7:25 p.m. to review cable contract. The Big Muskego Lake quarterly meeting has been scheduled for 11/9/99. The Clerk also noted the Suspension and/or Revocation Liquor License Hearing scheduled before the Council on 10/21/99 at 7:30 p.m. Common Council Minutes Page 3 October 12, 1999 Slocomb moved to convene into closed session pursuant to §19.85(1)(g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved; more specifically pending and threatened litigation involving Superior Emerald Park Landfill, Inc. Le Doux seconded. Motion carried 6-0. City Attorney Molter was present. The Clerk and Deputy were excused at 8:20 p.m. Patterson moved to reconvene into open session. Pionek seconded; motion carried.
