COMMON COUNCIL - CITY OF MUSKEGO Approved 8/24/99
MINUTES OF MEETING HELD AUGUST 10, 1999
The meeting was called to order at 7:34 p.m. by Mayor De Angelis. Also present were
Aldermen Slocomb, Chiaverotti, Patterson, Pionek, Salentine and Sanders, City Attorney
Molter and Clerk-Treasurer Marenda. Alderman Le Doux was absent.
The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting
law on 8/6/99.
Salentine moved for approval of minutes of the 7/27/99 meeting. Sanders seconded;
motion carried.
The Clerk-Treasurer read the closed session notice.
The Mayor had nothing to report under communications. He acknowledged that State
Representative Mark Gundrum was present.
COMMITTEE REPORTS
The 7/22/99 Committee of the Whole minutes were received and placed on file.
Salentine moved for acceptance of the 8/4/99 and 8/10/99 Finance Committee minutes.
Slocomb seconded; motion carried.
Patterson moved for acceptance of the 8/2/99 Public Services Committee minutes. Pionek
seconded; motion carried.
Pionek moved for acceptance of the 7/26/99 Public Works Committee minutes. Salentine
seconded; motion carried.
Minutes of the 7/28/99 Library Board meeting and 8/3/99 Plan Commission meeting were
received and placed on file.
OLD BUSINESS
Ord. #992 - An Ordinance to Amend Chapter 9, Section 9.03 (3) of the Municipal Code of
the City of Muskego (Use of Fireworks). Second Reading. Patterson moved for adoption.
Salentine seconded. Motion carried 6-0.
Slocomb moved to convene into closed session pursuant to §19.85(1)(g) Conferring with
legal counsel for the governmental body who is rendering oral or written advice concerning
strategy to be adopted by the body with respect to litigation in which it is or is likely to
become involved; more specifically, Superior Emerald Park, Inc. landfill litigation, the
pending petition before the Waste Facility Siting Board as to the City of Franklin and
others, and likely resumption of litigation concerning the contested case hearing.
Chiaverotti seconded. Motion carried 6-0. Atty. Molter was present. The Clerk-Treasurer
was excused.
Slocomb moved to reconvene into open session with Clerk-Treasurer present. Salentine
seconded. Motion carried 6-0.
NEW BUSINESS
Reso. #136-99 - Resolution Authorizing the Mayor to Re-Retain Special Counsel and
Reinitiate Proceedings Regarding the Contested Case Hearing. Patterson moved for
adoption. Sanders seconded. Mayor noted Superior Emerald Park, Inc. in the past several

months has decided not to honor the Interim Construction Agreement, and adoption of this
resolution will enable the City to re-petition to file briefs with the DNR along with other
filings if necessary. Motion carried 6-0.
Reso. #137-99 - Appointment of Members to the Capital Budget Committee. Slocomb
moved for adoption. Sanders seconded. Motion carried 6-0.
Reso. #138-99 - Approval of 66.30 Agreement Between the City of Muskego and Muskego-
Norway School District - Liaison Officers 1999-2000. It was noted that the agreement
would be corrected to reflect three officers. Sanders moved for adoption. Salentine
seconded. Motion carried 6-0.
Reso. #139-99 - Approval of Certified Survey Map - Lang. Salentine moved for adoption.
Sanders seconded. Motion carried 6-0.
LICENSES
Slocomb moved for approval of Operators’ Licenses for Christine Burmeister, Aby
Luckenbill, Marie Cortner, Teresa Umbs, Catherine Danko, Terri Kadow, and Suzette
Roushia with the condition that the license is only to allow her to work in Class A
establishments. Salentine seconded; motion carried.
Slocomb moved for approval of Temporary Class “B”/”Class B” Retailer’s License -
Muskego Corvette Club for 8/28/99. Sanders seconded; motion carried.
Slocomb moved for approval of Class “A” Beer License for Clark Retail Enterprises, Inc.
with Kathryn Borchardt as agent. Salentine seconded; motion carried.
VOUCHER APPROVAL
Slocomb moved for approval of payment of general vouchers in amount of $339,916.21.
Sanders seconded. Motion carried 6 -0.
Slocomb moved for approval of payment of tax checks in amount of $3,031,224.26.
Salentine seconded. Motion carried 6 -0.
Sanders moved for approval of payment of utility vouchers in amount of $479,653.39.
Slocomb seconded. Motion carried 6 -0.
CITY OFFICIALS’ REPORTS
The Clerk-Treasurer noted that the Annual Big Muskego Lake/Bass Bay Protection and
Rehabilitation District meeting will be held on 8/30/99 at 7:00 p.m. She also announced
that the following public hearings would be held: 7:15 p.m. on 8/24/99 to consider petition
of the Public Works Committee to create the Storm Water Management Ordinance
(Chapter 34); 7:20 p.m. on 8/24/99 to consider recommendation of the Plan Commission to
amend Chapter 17, Section 4.05 (2)(G) relating to accessory buildings; and 7:30 p.m. on
9/14/99 to consider petition to rezone Tax Key Nos. 2257.999 and 2257.999.001 from R-3
to RS-2.
Sanders moved to adjourn at 8:43 p.m. Salentine seconded; motion carried.
