CM062299 COMMON COUNCIL - CITY OF MUSKEGO (Approved 7/13/99) MINUTES OF MEETING HELD JUNE 22, 1999 The meeting was called to order at 8:20 p.m. by Mayor De Angelis. Also present were Aldermen Slocomb, Chiaverotti, Le Doux, Patterson, Pionek, Salentine and Sanders, City Attorney Molter, Clerk-Treasurer Marenda, and Deputy Clerk Blenski. The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting law on 6/18/99. Salentine moved for approval of minutes of the 6/8/99 meeting. Patterson seconded; motion carried. The Clerk-Treasurer read the closed session notices. COMMUNICATIONS FROM THE MAYOR’S OFFICE Mayor De Angelis presented an update regarding state issues including the impact fee provision presently included in the budget bill and the debate regarding funding for recycling. COMMITTEE REPORTS Slocomb moved for acceptance of the 6/19/99 and 6/22/99 Finance Committee minutes. Sanders seconded; motion carried. Patterson moved for acceptance of the 6/7/99 Public Services Committee minutes. Pionek seconded. Salentine noted that she has received numerous complaints regarding the Saturday drop-off site. Backups have occurred due to only one truck being used. An additional truck needs to be used, or another alternative. Patterson stated he will follow up. Le Doux asked about street lights on Parkland Drive where Gregory Drive and Jacob Court interesect. The Mayor stated he will check to see if included in developer’s agreement. Pionek moved for acceptance of the 6/11/99 Public Works Committee minutes. Chiaverotti seconded; motion carried. Minutes of the 6/15/99 and 6/17/99 Plan Commission meetings were received and placed on file, as well as the minutes of the 5/26/99 Library Board and 6/14/99 Parks and Recreation Board. OLD BUSINESS Ord. #987 - An Ordinance to Amend the Zoning Map of the City of Muskego RS-1/OED, R-1/RS-1/RS-2/L and RS-1 to add the OWP Overlay (Wellhead Protection District). Second Reading. Salentine moved for adoption. Chiaverotti seconded. Motion carried 7-0. Slocomb moved to convene into Closed Session pursuant to §19.85(1)(e) Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, more specifically, discussion with Council Common Council Minutes Page 2 June 22, 1999 representative to the Landfill Siting Committee related to contract issues with Superior Emerald Park. Patterson seconded; motion carried 7-0. Attorney Molter was present for closed session. The Clerk-Treasurer and Deputy Clerk were excused. Slocomb moved to reconvene into open session. Salentine seconded; motion carried 7-0. NEW BUSINESS Reso. #110-99 - Approval of Final Offer of Superior Emerald Park Landfill Siting Committee. Slocomb moved for adoption. Patterson seconded. Slocomb moved to amend to add, “after final approval of the Siting Committee” at the end of the last paragraph. Salentine seconded; motion carried. Motion to adopt Reso. #110-99, as amended, carried 7-0. Reso. #111-99 - Approval of Various License Applications for the City of Muskego for the Licensing Period July 1, 1999 to June 30, 2000. Salentine moved for adoption. Le Doux seconded; motion carried 7-0. Reso. #112-99 - Establish Traffic Regulations. Patterson moved for adoption. Chiaverotti seconded; motion carried 7-0. Reso. #113-99 - Approval of Certified Survey Map - Duve. Salentine moved for adoption. Slocomb seconded. A new map was revised and submitted, however, clarification was requested regarding the floodplain line. Motion to adopt carried 7-0. Reso. #114-99 - Approval of Certified Survey Map - Duve. Salentine moved for adoption. Sanders seconded. The same clarification was requested regarding the floodplain line. Motion to adopt carried 7-0. Reso. #115-99 - Award of Bid - Pioneer Drive/Parks Garage Water Main and Service. Sanders moved for adoption. Slocomb seconded; motion carried 7-0. Reso. #116-99 - Approval of Agreement Between the City of Muskego and Waste Management of Wisconsin, Inc. Sanders moved for adoption. Slocomb seconded. Sanders moved to defer. Salentine seconded; motion carried. Ord. #988 - An Ordinance to Repeal and Recreate Chapter 5 of the City of Muskego of the City of Muskego Municipal Code Relating to Public Records. First Reading. Ord. #989 - An Ordinance to Amend the Zoning Map of the City of Muskego from A to RS-2/OPD (Champions Village Addition No. 2 of Country Club Villages). First Reading. LICENSES Discussion took place with City Attorney about applicant for an operator’s license being issued a citation for false swearing on the application. Attorney Molter stated that if the City was considering not approving the license, the applicant should be given an opportunity to appear and be heard. Patterson moved to send application submitted by Common Council Minutes Page 3 June 22, 1999 Denise Molkentin back to the Finance Committee for further review. Salentine seconded. Sanders objected noting that he heard all the facts. Salentine suggested that the license be approved subject to periodic reviews. Slocomb and Patterson expressed concern that the applicant did not disclose all the facts. Pionek called for the question with there being no objections. Motion failed with Chiaverotti, Le Doux, Salentine, and Sanders voting “no” and Slocomb, Patterson, and Pionek voting “yes.” Slocomb moved for approval of a temporary operator’s license for Julie Bindas and Robert Bankenbusch and a regular operator’s license for Judy Younk, John Lufkin, Leonard Pilak, Karen Jaeger, Hayley Eggert, Patrick Patterson, Rande, Lynn Plemons, Mary Lufkin, Mary Pat Dempsey, and Denise Molkentin. Salentine seconded including a 3, 6, 9 and 12-month review of license for Denise Molkentin with Slocomb agreeing. Patterson moved for separate consideration for license for Denise Molkentin. Pionek seconded. Motion carried with Slocomb and Sanders casting a “no” vote. Motion to approve all operator’s licenses, except license for Denise Molkentin, carried with 6 in favor and Patterson abstaining. Salentine moved for approval of operator’s license for Denise Molkentin subject to a 3, 6, 9 and 12 month review. Le Doux seconded. Motion carried 5 to 2 with Patterson and Pionek casting the “no” votes. Slocomb moved for approval of a Temporary Class “B”/”Class B” Retailer’s License for Little Muskego Lake Assn. for 7/3/99 (7/4/99 rain date) and Muskego Community Festival for 8/27/99 - 8/29/99. Sanders seconded; motion carried. Slocomb moved for approval of a Salvage and Recycling Permit for Kohne Salvage and John Glockner. Salentine seconded; motion carried. VOUCHER APPROVAL Slocomb moved for approval of payment of general vouchers in amount of $1,793,349.85. Sanders seconded; motion carried 7-0. Slocomb moved for approval of payment of tax checks in amount of $1,127.82. Sanders seconded; motion carried 7-0. Sanders moved for approval of payment of utility vouchers in amount of $400,073.49. Le Doux seconded; motion carried 7-0. The Clerk-Treasurer provided information provided by the City of New Berlin regarding a water symposium to be held on 6/23/99. Several aldermen noted their inability to attend due to previously scheduled events. The July calendar was reviewed with a Committee of the Whole meeting scheduled for July 22, 1999. Salentine stated that the Muskego Corvette Club has extended an invitation to the City to provide vehicles for the community festival parade. It was determined the invitation would be accepted. Salentine moved to convene into Closed Session No. 2 §19.85(1)(c) Considering employment, promotion, compensation, or performance evaluation data of any public employe over which the governmental body has jurisdiction or exercises responsibility, more specifically compensation and classification study for represented employees, labor negotiations with represented employees, and pay for performance plan for nonrepresented employees. Sanders seconded. Motion carried 7-0. The Clerk- Treasuer, Deputy Clerk, and City Attorney were excused. Common Council Minutes Page 4 June 22, 1999 Salentine moved to reconvene into Open Session.
