CM042799 COMMON COUNCIL - CITY OF MUSKEGO (Approved 5/11/99) MINUTES OF MEETING HELD APRIL 27, 1999 The meeting was called to order at 7:55 p.m. by Mayor De Angelis. Also present were Aldermen Slocomb, Chiaverotti, Le Doux, Patterson, Pionek, Salentine, and Sanders, City Attorney Molter, Clerk-Treasurer Marenda, and Deputy Clerk Blenski. The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting law. Salentine moved for approval of minutes of the 4/13/99 and 4/20/99 meetings. Slocomb seconded; motion carried. The Clerk-Treasurer read the closed session notices. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor announced his 1999-2000 committee appointments. He read two proclamations recognizing May as “Green-Up Muskego” month as well as “Youth Wellness Month.” Reso. #74-99 - Approval of Certified Survey Map - Spitzner. Salentine moved for adoption. Sanders seconded. Motion carried 7-0. Reso. #78-99 - Approval of Final Plat, Subdivider’s Agreement and Letter of Credit - North Cape Farms. Slocomb moved for adoption. Salentine seconded. Salentine moved to amend to correct the subdivision name in the first BE IT FURTHER RESOLVED to “North Cape Farms” and to add “BE IT FURTHER RESOLVED That approval of this Resolution is subject to the passage and publication of Ordinance #984.” Pionek seconded; motion carried. Reso. #78-99, as amended, adopted 7-0. Ord. #984 - An Ordinance to Amend the Zoning Map of the City of Muskego R-3 to RSE/OPD (Pipke/North Cape Farms). First Reading. COMMITTEE REPORTS Slocomb moved for acceptance of the Finance Committee minutes of 4/21/99 and 4/27/99. Salentine seconded; motion carried. Sanders moved for acceptance of the 4/19/99 Public Utilities Committee minutes. Slocomb seconded; motion carried. Pionek asked about New Berlin residents requesting sewer service from the City of Muskego. Minutes of the 4/12/99 Parks and Recreation Board and 3/31/99 Library Board were received and placed on file with discussion taking place on the comparative statistics provided by the Library Director for the month of February which indicate a decrease from 1998. The 4/20/99 Plan Commission minutes were received with Salentine requesting input on issues such as that of #P.C. 36-99 which was approval for a 12’ high wind generator tower. She asked if department staff should be reviewing and approving since regulation was dictated by state statute. Sanders and Patterson both expressed support for Plan Commission review and approval which allows input from neighboring Common Council Minutes Page 2 April 27, 1999 property owners. Attorney Molter noted that the Plan Commission still has some input regarding this type of issue, although limited. Reso. #61-99 - Appointment of Alderpersons to Various Boards and Committees. Reso. #64-99 - Appointment of Citizen Members to Board of Appeals. Removed from agenda. Reso. #65-99 - Appointment of Citizen Members to Board of Review (H. Posbrig and W. Jasinski). Salentine moved for adoption. Sanders seconded. Motion carried 7-0. Reso. #66-99 - Appointment of Citizen Member to the Plan Commission (R. Gummer). Salentine moved for adoption. Patterson seconded. Reso. #73-99 - Award of Bid - Muskego Public Library Furnishings. Sanders moved for adoption. Patterson seconded. Motion carried 7-0. Reso. #75-99 - Approval of Certified Survey Map - Schaumberg. Salentine moved for adoption. Patterson seconded. Motion carried 7-0. LICENSES Slocomb moved for approval of operators’ licenses for Michael Ihrcke and Gene Romans. Salentine seconded; motion carried. Slocomb moved to deny operator’s license for Jennifer Grabczyk for one year due to two alcohol-related convictions within a one-year period with the applicant not having reached the legal drinking age. Salentine seconded; motion carried. Slocomb moved for outside dance events for Bushy’s Pub for 7/16 - 7/18/99 with conditions established by the Finance Committee and outlined in 4/21/99 minutes. Salentine seconded. Motion carried 7-0. VOUCHER APPROVAL Slocomb moved for approval of General Vouchers in amount of $478,015.47. Sanders seconded. Motion carried 7-0. Slocomb moved for approval of Tax Checks in the amount of $1,981.75. Sanders seconded. Motion carried 7-0. Sanders moved for approval of Utility Vouchers in amount of $458,380.58. Chiaverotti seconded. Motion carried 7-0. CITY OFFICIALS’ REPORTS The Clerk-Treasurer noted that a petition was received from Bill Carity to rezone property in the SE ¼ of Sec. 3 and NE ¼ and SE ¼ of Sec. 10 from RS-3 and RS-2 to RS-3/OPD, RS-2/OPD, and B-3/OPD with a public hearing to be held at 7:25 p.m. on 5/11/99. The May calendar was reviewed with a consensus to hold the next Committee of the Whole meeting on 5/12/99 at 7:00 p.m. Chiaverotti moved to convene into closed session pursuant to §19.85(1)(c) Considering employment, promotion, compensation, or performance evaluation data of any public employe over which the governmental body has jurisdiction or exercises responsibility, more specifically compensation and classification study for represented employees, labor negotiations with represented employees, and pay for performance plan for nonrepresented employees. Slocomb seconded. Motion carried 7-0. Chiaverotti moved to convene into closed session pursuant to §19.85(1)(e) Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, more specifically contract negotiations regarding Superior Emerald Park Landfill, Inc. Salentine seconded. Motion carried 7-0. The Clerk and Deputy were dismissed. Pionek moved to reconvene into open session. Salentine seconded; motion carried.
