MINUTES OF JOINT MEETING WITH CITY OF FRANKLIN
The meeting was called to order individually by Franklin Mayor Patrick Murray, calling
roll of his members present and Mayor De Angelis at 7:05 PM. Present for the City of
Muskego were Aldermen Chiaverotti, Patterson, Pionek, Salentine and Sanders, and
Clerk-Treasurer Marenda. Aldermen Slocomb and Woodard were absent.
The Statement of Public Notice was made by Clerk-Treasurer Marenda.
Mayor Murray stated the purpose of the joint meeting was to discuss items of mutual
interest involving the two cities.
Landfills - Issues with the three landfills were discussed - Metro Landfill in Franklin and
Future Parkland and Superior Emerald Park landfills in Muskego. An area of concern
is the approximate 1000 trucks using the landfills causing increased traffic
enforcement, litter, noise, dust and pollution control. After much discussion, it was
determined as follows: 1) Monthly reports from the monitoring/standing committees will
be shared; 2) Both cities to work with haulers to have them agree to clean up as a
public relations tool; 3) Complaint lists will be shared between the cities; and 4) A
standard complaint form will be created and complaints will be copied to the DNR.
Since much of the litter is on county roads, it becomes a jurisdictional issue. Both
communities will work with their counties.
Planning - Franklin Planning Director Bruce Kanewski stated that due to the widening
of STH 36, a lot of activity may be seen in that area. Franklin is updating their
Comprehensive Master Plan and Economic Strategic Plan. There is initial preliminary
discussions on the possibility of industrial or commercial use in that area, along with
the possibility of sewers. Will work with Muskego’s new planner to coordinate
decisions to be made on the cities’ borders around STH 36.
Mayor De Angelis reviewed the Pipke Farm proposal with 80 acres in Franklin with 21
lots and detention pond in Muskego. Questioned if property in Franklin could be deed
restricted. Bruce responded not if it would increase density in that area. Mayor De
Angelis felt it would work to the advantage of both cities. Mr. Pipke asked if he could
continue to farm the 80 acres and he was informed he could.
Mayor De Angelis stated Muskego has completed a Durham Hill neighborhood plan to
retain the historic nature of the area with roadside shops with parking in rear. As a
result we need to discuss Franklin’s consideration of industrial zoning adjacent to that
area. Would like to find ways to buffer the area of the landfills. It was recommended
that the cities’ planners share information on borders so zoning doesn’t conflict. Mayor
De Angelis agreed to send Bruce a copy of the Durham Hill Neighborhood Plan.
The City of Franklin questioned if Boxhorn Gun Club’s shooting license is forever.
Mayor De Angelis said pretty much so, and the City has had no pressure from residents
to close them down. Franklin noted they do get complaints during the week.

Ald. Patterson asked for coordination of street names along the borders - such as
Loomis Road. Mr. Bennett agreed due to 9-1-1. Franklin had no problem changing to
Loomis Drive. The alderman of the area will check with the property owners.
Land Preservation - BML - Mayor De Angelis advised the DNR is looking at a land
preservation program around Big Muskego Lake. The DNR will purchase land to
protect the BML habitat. A small area in Franklin is listed as a possible acquisition site,
and is referred to as Mud (Dumke) Lake. The property will be removed from the tax
roll, but payment in lieu of taxes will be paid by the DNR at the highest and best use of
value of the property.
Stormwater - Mr. Bennett reported Franklin is now designated by Racine for a
stormwater discharge permit. The City of Muskego has been undesignated.
Mayor De Angelis noted no requests have been received recently from residents along
Woods Rd. in Franklin requested to be connected to Muskego’s sewer.
Mr. Bennett expressed a concern he had about MMSD and sewer rehab programs,
because cities with newer sewer systems might have to share in the cost to rehab older
systems. This is an area contract and non-contract communities have in common.
Mayor De Angelis agreed it is an issue.
Legislation - Franklin noted they perform cigarette checks and when the young attempt
to make cigarette purchases they are cited. A bill has been drafted to be attached to
the State budget bill that will take control of that - another erosion of local control.
Proposed state aid formula legislation discussed. Communities like Franklin and
Muskego with limited commercial properties will be dramatically negatively affected.
The residence bill sponsored by Scott Gunderson is another effort to erode local
control.
Mr. Bennett reported on Com 83 which loosens restrictions for septic tanks which will
have an affect on development. He also reported on a proposal for a non-requirement
to hook up to sewers.
A suggestion was made that at the next Joint Meeting between the communities, the
State Senator and State Representative serving both should be invited to attend.
A number of other issues of mutual interest were discussed, including the building of
the new Muskego library, number of buildable sites, financial health, cell towers, public
access on cable TV, websites, CBRF’s, etc.
Franklin responded to some questions on the decorative lighting in the St. Martins
area. They indicated a St. Martins Planning Committee was formed, a unique zoning
was created for the area to include village-friendly lighting, signage, and Market Square

Park, and CDBG funding was obtained. The high school did the landscape design, and
a high school class designed and built the gazebo. City funds were not expended.
It was decided to hold semi-annual meetings with the two communities.
Alderman Salentine moved to adjourn at 9:35 PM. Ald. Chiaverotti seconded, motion
carried.
