CM032399 COMMON COUNCIL - CITY OF MUSKEGO (Approved 4/13/99) MINUTES OF MEETING HELD MARCH 23, 1999 The meeting was called to order at 8:30 p.m. by Mayor De Angelis. Also present were Aldermen Slocomb, Chiaverotti, Patterson, Pionek, and Salentine, City Attorney Molter, Clerk-Treasurer Marenda, and Deputy Clerk Blenski. Aldermen Sanders and Woodard were absent. The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting law on 3/19/99 and on 3/22/99, as amended. Slocomb moved for approval of minutes of the 3/9/99 meeting. Salentine seconded; motion carried. The Clerk-Treasurer read the closed session notices. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor stated that the rally that took place over the weekend was not City sanctioned. He gave a brief update on state legislative agenda issues COMMITTEE REPORTS Slocomb moved for acceptance of the Finance Committee minutes of 3/17/99 and 3/23/99. Salentine seconded. Pionek stated he would like to see the City Engineer position filled on an interim basis by an individual or hired consultant. Mayor stated the possibility of using someone from Ruekert & Mielke could be explored. Motion carried. Slocomb moved for acceptance of the 3/15/99 Public Utilities Committee minutes. Chiaverotti seconded; motion carried. Minutes of the 3/16/99 Plan Commission meeting and 3/8/99 Parks and Recreation Board were received and placed on file. OLD BUSINESS Ord. #980 - An Ordinance to Amend Chapter 17 to Add Section 9.11 and Amend Section 2.02 of the Municipal Code of the City of Muskego (Wellhead Protection District). On the floor, deferred 3/9/99. Slocomb moved to amend to add “single family residential” before “fuel oil storage tank” in 9.11(7) A. 2. and to amend 9.11(7) A. 8. to read “Requirements for existing facilities prohibited by Sec. 17:9.11(7) A. 7. b. and c. as listed above are as follows.” Chiaverotti seconded; motion carried. Ord. #980, as amended, adopted 5-0. Ord. #981 - An Ordinance to Amend Chapter 28, Section 28.02 of the Municipal Code of the City of Muskego (Water Utility - Control of Water Quality, Wellhead Protection District). On the floor, deferred 3/9/99. Motion to adopt carried 5-0. NEW BUSINESS Reso. #40-99 - Approval of Continuation of Police Liaison Officer Program. Salentine moved for adoption. Pionek seconded. Motion carried 5-0. Reso. #41-99 - Final Resolution Authorizing Installation of Sewer Improvements and Levying of Special Assessments Against Benefited Property (Loomis Road/State Hwy. Common Council Minutes Page 2 March 23, 1999 45 Sewer Project MSS-1C-96, Assessment District “SO”). Slocomb moved for adoption. Chiaverotti seconded. The Mayor noted that the assessment roll was amended to reflect changes in response to input from the public hearing. The changes were: Eckstein - reduction in frontage due to nonbuildable area in wetlands; Machulak - removed from roll changing method of service to Bethlehem Church resulting in assessments for the church and Krause properties being changed, Durham Hill Nursery - reduction in commercial frontage. Slocomb explained the alternate route of the project to service the church. The Mayor noted that the Public Utilities Committee did review the initial votes of the property owners regarding the project which indicated a 50-50 split. Motion carried 5-0. Reso. #42-99 - Award of Bid - Loomis Drive/State Hwy. 45 Sewer Project. Salentine moved for adoption. Slocomb seconded. Motion carried 5-0. Reso. #44-99 - Approval of Lease Agreement Between the City of Muskego and Water Bugs Ski Team, Inc. Salentine moved for adoption. Patterson seconded. Motion carried 5-0. Reso. #45-99 - Appointment to Superior Emerald Park Landfill, Inc. Siting Committee (Dustin Wolff). Slocomb moved for adoption. Salentine seconded. Motion carried 5-0. Reso. #46-99 - Authorization to Hire Special Prosecutor (E. Joseph Kershek). Slocomb moved for adoption. Chiaverotti seconded. Motion carried 4 in favor with Salentine abstaining. Ord. #982 - An Ordinance to Amend the Zoning Map of the City of Muskego - I-2, RS1/RS-3/OIP, RS-1/OPD, RS-1/OED, RS-1/R-I/L/RS-2, RS-1/OIP, RS-1/A, RS-1, RS- 2, RS-2/R-1, RS-3, RS-3/OIP, RS-3/OPD, R-1, RCE, RCE/OA, RCE/OIP, EA and EA/R- 1/L to Add the OWP Overlay (Wellhead Protection District). First Reading. Ord. #983 - An Ordinance to Amend Chapter 20, Section 20.02 (3) of the Municipal Code of the City of Muskego (Additional Regulations - Motorboats). First Reading. LICENSES Slocomb moved for approval of operators’ licenses for Deborah Zayechek, Kathleen Pollack, Matthew Stanczyk, Steve Kersky, Liborio Mazzarisi, Ann Stachewicz, and Common Council Minutes Page 3 March 23, 1999 Annmaire Giuliani (subject to 3, 6, 9, 12 mo. review). Salentine seconded; motion carried. Slocomb moved for approval of amendment to premise description of “Class B” Liquor and Beer License for Richard Lucht (The Lakeview Tavern). Salentine seconded. Motion carried 5-0. VOUCHER APPROVAL Slocomb moved for approval of General Vouchers in amount of $626,140.06. Salentine seconded. Motion carried 5-0. Slocomb moved for approval of Tax Checks in the amount of $681.97. Pionek seconded. Motion carried 5-0. Slocomb moved for approval of Utility Vouchers in amount of $116,157.56. Salentine seconded. Motion carried 5-0. CITY OFFICIALS’ REPORTS The April calendar was reviewed with a Committee of the Whole meeting scheduled for 4/14/99 at 7:00 p.m. Salentine moved to convene into closed session pursuant to §19.85(1)(c) Considering employment, promotion, compensation, or performance evaluation data of any public employe over which the governmental body has jurisdiction or exercises responsibility, more specifically compensation and classification study for represented employees. Patterson seconded. Motion carried 5-0. Slocomb moved to convene into closed session pursuant to §19.85(1)(g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved, more specifically Superior Emerald Park, Inc. contested case. Chiaverotti seconded. Motion carried 5-0. The Clerk and Deputy were dismissed. Slocomb moved to reconvene into open session. Chiaverotti seconded; motion carried.
