CM022399 COMMON COUNCIL - CITY OF MUSKEGO (Approved - 3/9/99) MINUTES OF MEETING HELD FEBRUARY 23, 1999 The meeting was called to order at 8:02 p.m. by Mayor De Angelis. Also present were Aldermen Slocomb, Chiaverotti, Patterson, Pionek, Salentine, and Sanders, City Attorney Molter, Clerk-Treasurer Marenda, and Deputy Clerk Blenski. Alderman Woodard was absent. The Clerk-Treasurer stated the meeting was noticed in accordance with the open meeting law. Salentine moved for approval of minutes of the 2/9/99 meeting. Sanders seconded; motion carried. The Clerk-Treasurer read the closed session notice. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor noted that the City received a grant for tree landscaping. The following people have been appointed to serve on the Tree Committee: Rick Petfalski, Ron Schneider, Heather Schuster, Betty Czarapata, Ron Wisniewski, and Ray Christenson. Mr. Zagar will coordinate activities. The Mayor stated that the main well at Bay Lane Middle School went out. The City has been able to provide temporary water service and school will not have to be canceled. The Mayor reported that the Cities of New Berlin and Brookfield are being sued for the economic incentive provided regarding the reserve liquor license fee. There is a movement in the state legislature to make the fee optional. PERSONAL APPEARANCES Mr. Donald Vilione appeared before the Council to present a summary of the 1997 TIF audited data and estimated 1998 operations. COMMITTEE REPORTS The Committee of the Whole minutes were received. Slocomb moved for acceptance of the Finance Committee minutes of 2/17/99 and 2/23/99. Salentine seconded; motion carried. Chiaverotti moved for reconsideration of acceptance of the 2/23/99 Finance Committee minutes. Patterson seconded; motion carried. Chiaverotti moved for individual consideration of paragraphs regarding cell phone and business card policy. She stated the issue should be reviewed during next year’s budget process. Motion died for lack of second. Motion to accept 2/23/99 minutes carried. Sanders moved for acceptance of the Public Utilities Committee minutes of 2/15/99. Slocomb seconded; motion carried. Minutes of the 2/16/99 Plan Commission, 1/27/99 Library Board, and 2/8/99 Parks & Recreation Board were received and placed on file. Ord. #980 - An Ordinance to Amend Chapter 17, to Add Section 9.11 and Amend Section 2.02 of the Municipal Code of the City of Muskego (Wellhead Protection District). Second Reading. Salentine moved for adoption. Sanders seconded. Common Council Minutes Page 2 February 23, 1999 Slocomb moved to defer as he has not had an opportunity to review support documentation. Salentine seconded; motion carried. Reso. #27-99 - Approval of Preliminary Plat - Rosewood Estates. Salentine moved for adoption. Slocomb seconded. Slocomb moved to defer as plat map was not available for review. Chiaverotti seconded. Motion carried with Slocomb, Chiaverotti, Patterson, and Sanders voting “yes,” Salentine voting “no” and Pionek abstaining. Sanders asked about location. Pionek noted that the Council typically does not receive copies of plat maps. The Mayor agreed noting that it usually is displayed and available for review at the meeting. The deputy was directed to obtain the plat map. Reso. #27-99, deferred, on the floor. Motion to adopt carried with 5 in favor and Pionek abstaining. Reso. #28-99 - Approval of Certified Survey Map - Whitehouse. Salentine moved for adoption. Slocomb seconded. Motion carried 6-0. Reso. #29-99 - Approval of Certified Survey Map - Champions Village of Country Club Villages. Salentine moved for adoption. Slocomb seconded. Motion carried 6-0. Reso. #30-99 - Authorization to Execute Easement. Sanders moved for adoption. Salentine seconded. Motion carried 6-0. Reso. #31-99 - Resolution Objecting to Public Service Commission’s Proposed Area Code Boundaries. Sanders moved for adoption. Pionek seconded. Mayor provided boundary map and update on issue noting a decision will be made within the next few weeks. He will forward resolution to the PSC. Motion carried 6-0. Reso. #32-99 - Resolution as to Land Offered to the City by Waukesha County. Slocomb moved for adoption. Salentine seconded. Slocomb noted that adjoining property owners could pursue on their own if interested. Attorney Molter noted that the problems encountered are typical with tax delinquent, remnant parcels. Motion carried 6-0. Reso. #33-99 - Second Amended and Revised Final Resolution Authorizing Installation of Sewer Improvements and Levying Special Assessments Against Benefited Property (Loomis Road/Drive Sewer Project MSS-1A-96) (Assessment District “SM”). Slocomb moved for adoption. Sanders seconded. Motion carried 6-0. Reso. #34-99 - Authorization to Execute Agreement with Southeastern Wisconsin Regional Planning Commission (SEWRPC) and Waukesha County - Topographic Mapping. Salentine moved for adoption. Sanders seconded. Slocomb requested verification that “AutoCAD R14 format” referred to in (4) is proper format. Slocomb moved to amend to include language authorizing the Mayor to make change to (4) of the Agreement if necessary regarding format. Chiaverotti seconded; motion carried. Pionek questioned the 2’ contour interval and believed it was going to be 1’. Slocomb moved to amend to allow Mayor to verify contour internal. Pionek seconded; motion carried. Reso. #34-99, as amended, adopted 6-0. First Reading. Slocomb requested impact to parcels that will be affected. LICENSES Slocomb moved for approval of operators’ licenses for Franz Jones, Jr., Theodore Brown, and Tammy King. Salentine seconded; motion carried. VOUCHER APPROVAL Slocomb moved for approval of General Vouchers in amount of $797,064.48. Salentine seconded. Motion carried 6-0. Slocomb moved for approval of Tax Checks in the amount of $5,913,587.29. Sanders seconded. Motion carried 6 -0. Sanders moved for approval of Utility Vouchers in amount of $217,438.59. Slocomb seconded. Motion carried 6 -0. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW The March calendar was reviewed. Slocomb moved to convene into closed session pursuant to §19.85(1)(c) Considering employment, promotion, compensation, or performance evaluation data of any public employe over which the governmental body has jurisdiction or exercises responsibility, more specifically compensation and classification study for represented employees. Salentine seconded. Motion carried 6-0. Mr. Gethmann was present for closed session. The clerk and deputy were dismissed. Patterson moved to reconvene into open session.
