CM062398 COMMON COUNCIL - CITY OF MUSKEGO (Approved 7/14/98) MINUTES OF MEETING HELD JUNE 23, 1998 The meeting was called to order at 8:28 p.m. by Mayor De Angelis. Also present were Aldermen Slocomb, Chiaverotti, Patterson, Salentine, Sanders, and Woodard, City Attorney Molter, Clerk-Treasurer Marenda, and Deputy Clerk Blenski. Alderman Pionek was absent. The Clerk-Treasurer stated the meeting was noticed in accordance with the Open Meeting Law on 6/19/98. Salentine moved for approval of the minutes of 6/9/98. Woodard seconded; motion carried. The Clerk-Treasurer read the notice of closed session. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor wished everyone a safe and enjoyable Fourth of July and reminded citizens that a permit to display fireworks is required. Permit can be obtained through the Mayor’s office with proof of liability insurance and $25 fee. COMMITTEE REPORTS Slocomb moved for acceptance of the minutes of the 6/17/98 and 6/23/98 Finance Committee meetings. Sanders seconded. Salentine requested correction be made to the 6/17/98 minutes to add “Alderman Salentine seconded; motion carried” to the Amann’s Beach Club issue on page 1. Salentine moved to send paragraph entitled “Discuss Membership in The Management Association, Inc.” (page 2) back to the committee for clarification. Slocomb seconded; motion carried. Motion to accept corrected minutes without said paragraph carried unanimously. Sanders moved for acceptance of the minutes of the 6/15/98 Public Utilities Committee meeting. Slocomb seconded. Salentine requested that the word “proposed” in the paragraph regarding Dreamland Development (page 3, line 5) be corrected to read “potential.” Motion carried. Minutes of the 6/16/98 Plan Commission meeting, 5/27/98 Library Board meeting, and 6/8/98 Parks & Recreation Board meeting were received and placed on file. Slocomb requested vote for “Scoreboard” issue on page 3 under New Business be corrected at the next Parks & Recreation Board meeting; it appears three members voted “yes.” Ord. #962 - An Ordinance to Amend Chapter 33 of the Municipal Code of the City of Muskego to Create Section 33.00 through Section 33.12 (Business Occupancy Registration). Second Reading. Patterson moved for adoption. Slocomb seconded. Motion carried 6-0. Reso. #115-98 - A Resolution Supporting the Protection of Local Control of Zoning Related to the Fair Housing Act. Patterson moved for adoption. Slocomb seconded. Patterson stated this was modeled after a resolution passed by the City of Greenfield in an attempt to give some zoning control back to municipalities. Salentine noted that Common Council Minutes Page 2 June 23, 1998 there are references in the resolution to other documentation that the Council has not seen. How can the Council support? Slocomb questioned if the City’s building and fire codes could be overridden by federal housing act. Sanders stated that the resolution could be streamlined to one page. He agreed that there is background documentation that the Council has not seen and does not have. Patterson asked for direction as to what areas the Council members wanted streamlined. Salentine asked why we were using what someone else wrote. She suggested we put our own language in the resolution. It was requested that this item be placed on the 6/25/98 Committee of the Whole agenda for further review. Slocomb moved to defer. Sanders seconded. Motion carried with Patterson voting “no.” Reso. #116-98 - Approval of Various License Applications for the City of Muskego for the Period July 1, 1998 to June 30, 1999. Salentine moved for adoption. Chiaverotti seconded. Motion carried 6-0. Reso. #117-98 - Reapproval of Certified Survey Map - Baranowski. Salentine moved for adoption. Slocomb seconded. Motion carried 6-0. Reso. #118-98 - Appointment of Citizen Member to Board of Review. Removed from agenda. Reso. #119-98 - Award of Bid - Well No. 2 Pump Replacement. Sanders moved for adoption. Salentine seconded. Motion carried 6-0. Reso. #120-98 - Approval of 66.30 Agreement Between the City of Muskego and Muskego-Norway School District - Liaison Officers 1998-1999. Sanders moved for adoption. Slocomb seconded. Motion carried 6-0. Reso. #121-98 - Approval of Contract Between Humane Animal Welfare Society and the City of Muskego. Slocomb moved for adoption. Salentine seconded. Motion carried 6-0. Ord. #963 - An Ordinance to Amend the Zoning Map of the City of Muskego (B-2 to B- 2/OIP - Muskego Public Library). First Reading. No additional research was requested. Ord. #964 - An Ordinance to Amend Chapter 28, Section 28.05(2)(a) and Section 28.05(4)(c) of the Municipal Code of the City of Muskego. First Reading. No additional research was requested. LICENSES Slocomb moved for approval of Operators’ Licenses for Erik Anderson, Carrie Gaura, Gail Hierl, Ellen Sennebogen, and Diane Anderson. Salentine seconded; motion carried. Slocomb moved for approval of Class “B”/Class “B” Retailer’s License for Little Common Council Minutes Page 3 June 23, 1998 Muskego Lake Assn. for 7/3/98, with a rain date of 7/8/98, and Muskego Community Festival for 8/28/98, 8/29/98, 8/30/98. Chiaverotti seconded; motion carried. Slocomb moved for approval of Outside Dance permit for Favre & Associates for 8/8/98. Woodard seconded; motion carried. VOUCHER APPROVAL Slocomb moved for approval of General Vouchers in the amount of $470,664.22. Salentine seconded. Carried 6-0. Slocomb moved for approval of Tax Checks in the amount of $513.88. Salentine seconded. Carried 6-0. Sanders moved for approval of Utility Vouchers in amount of $68,177.71. Woodard seconded. Carried . CITY OFFICIALS’ REPORTS The Clerk-Treasurer stated that a petition has been submitted by Duane Gliniecki to rezone a portion of the Badertscher property located in the NE ¼ of Section 7 from EA to A. Public hearing scheduled for 7/14/98 at 7:20 p.m. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW The Mayor stated a draft of the July calendar would be available at Thursday’s Committee of the Whole meeting. The joint meeting between the Council and the Town of Norway is scheduled for July 15. Slocomb moved to convene into closed session pursuant to §19.85(1)(c) Considering employment, promotion, compensation, or performance evaluation data of any public employe over which the governmental body has jurisdiction or exercises responsibility, more specifically employee compensation and classification study. Sanders seconded. Motion carried 6-0. The City Attorney, Clerk and Deputy Clerk were dismissed. Salentine moved to convene into open session. Sanders seconded. Motion carried 6- 0.
